Adequate Notice of this Meeting has been provided according to the Open Public Meetings Act, Assembly Bill 1030. Notice of this Meeting was included in the Annual Meeting Notice sent to the New Jersey Herald and the Daily Record on January 4, 2017 and was placed on the Official Bulletin Board in the Municipal Building.
In the event the Mayor and Council have not addressed all items on this Agenda by 11:00 PM and they are of the opinion that they cannot complete the Agenda in a reasonable time period, the Mayor and Council may exercise their option to continue this meeting at an agreed to date, time and place within ten (10) days of this meeting. Please turn off all cell phones for the duration of this meeting.

PUBLIC HEARING AND ADOPTION OF THE 2017 MUNICIPAL BUDGET

RESOLUTION OF THE MAYOR AND COUNCIL OF THE BOROUGH OF STANHOPE AUTHORIZING READING OF THE MUNICIPAL BUDGET BY TITLE
WHEREAS, N.J.S.40A:4-8 provides that the budget may be ready by title only at the time of the public hearing if a resolution is passed by not less than a majority of the full Governing Body, provided that at least one (1) week prior to the date of public hearing a complete copy of the approved budget, as advertised, has been posted in the Municipal Building and copies have been made available by the Clerk to persons requesting them; and
WHEREAS, these conditions have been met;
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stanhope, County of Sussex, State of New Jersey, that the 2017 Municipal Budget shall be read by title at this Public Hearing for same.
On motion by Councilwoman Kuncken, seconded by Councilman Romano, and unanimously carried by the following roll call vote, the foregoing resolution was duly adopted.

Resolution of the Mayor and Council of the Borough of Stanhope Adopting the 2017 Municipal Budget
BE IT RESOLVED by the Governing Body of the Borough of Stanhope, County of Sussex, that the budget herein before set forth is hereby adopted and shall constitute an appropriation for the purposes stated of the sums therein set forth as appropriations, and authorization of the amount of $4,868,668.00 for municipal purposes.
On motion by Councilwoman Thistleton, seconded by Councilwoman Zdichocki, and unanimously carried by the following roll call vote, the foregoing resolution was duly adopted.

CITIZENS TO BE HEARD
Mayor Maio opened the meeting to the public after advising attendees there is a five (5) minute time limit for each speaker.
Marion Murdock, Blue Heron Antiques, asked if they could place a sign at the far end of Route 206 on weekends only to advertise their business. The signs would be put out in the morning and taken back in at the end of the business day. Business has been dropping off and they are on the verge of closing. Mrs. Murdock stated she is concerned about the condition of the home on Kelly Place which is collapsing. There are children living in the home and there are piles of junk placed outside which is an eyesore. Mayor Maio stated the Borough is aware of the home on Kelly Place and the issue is being addressed by the Construction Official and the Code Enforcement Official. The sign request can be discussed by the Council. Mayor Maio is of the opinion that accommodating the request would result in signs all over the Borough again which the Governing Body worked so long on to eliminate. Mrs. Murdock stated she is of the opinion other businesses would not be willing to put the signs in and out each day. Mrs. Murdock asked if perhaps they could use the signs for a trial period. Councilwoman Zdichocki suggested the Blue Heron plaque on the Borough sign could be moved to another position which may help it to be more noticeable. Administrator McNeilly confirmed their sign can be moved to a different position. The Borough envisioned the top spots as being the prime spots but if the Murdock’s would like the sign in a lower spot that can be accommodated. Mrs. Murdock replied she would like the plaque moved as long as it was not going to upset another business. Administrator McNeilly stated there are several municipal signs which can be moved. Mayor Maio stated the Borough worked with the Chamber of Commerce to eliminate the smaller signs and the Chamber would also have to be part of the discussion. The Governing Body stated they are sorry to hear that business is declining.
Seeing no one further from the public wishing to speak, Mayor Maio closed this public portion of the meeting.
BOROUGH AUDITOR BUDGET REPORT
Mayor Maio invited Raymond Sarinelli, Borough Auditor, forward to present the budget report.
Mr. Sarinelli stated the budget this year is $4,868,000 which is $153,000 more than last year. The tax levy was $3,350,000 which is only $26,000 more than last year. This is approximately 8/10ths of 1%. This is very good by most standards and one of the lowest he has seen so far this year. The average tax payer increase will be $19.00. The reason for the $153,000 increase in the budget was due to the one time increase in the fund balance. Of the $153,000, $138,000 is specifically appropriated from fund balance to cover certain things. The debt service payment was increased and the capital funding was increased. The reliance on the sale of asset money was reduced by $10,000. The reserve on uncollected taxes was increased. The entire rest of the budget, except for those four items, was increased by only $15,000. Many line items remained the same or were reduced. The funds were reclassified. This is as austere a budget as could be hoped for. In this environment 2% seems to be the benchmark and the Borough has come in under that. The expenses have been managed very carefully and still maintained a very solid fund balance. This is good planning and there are good people watching over the finances and the town and things turn out well. Mayor Maio stated some of the credit goes to Mr. Sarinelli who has lectured the Governing Body over the past several years and we have learned our lesson. Mr. Sarinelli congratulated the Governing Body and stated this is another good budget. Mayor Maio thanked Mr. Sarinelli for his assistance and attending tonight’s meeting.

COUNCIL COMMITTEE REPORTS
Public Safety – Councilwomen Kuncken/Thistleton
(Police, Fire, Ambulance, Court & Violations Bureau, Emergency Management)
Councilwoman Kuncken stated the Police Department for the month of March reported a total of 313 calls.
Councilwoman Kuncken stated the Ambulance Squad for the month of March reported 20 calls in Stanhope, 29 calls in Netcong and 2 stand-bys for a total of 51 calls. There were 4 out of town calls; 3 to Hopatcong and 1 of the calls was to Hanover Township, which is unusual. There were 11 Advanced Life Support Patients, 30 Basic Life Support Patients, 32 trips to the hospital, 33 patients, travelled 974 miles and had a total of 436 hours 30 minutes of volunteer hours. There were no assists from the Stanhope Fire Department or the Netcong Fire Department.
Councilwoman Kuncken stated no report was received from the Fire Department.
Finance & Administration – Councilman Romano/Councilwoman Kuncken
Councilman Romano stated the tax collections as of 3/31/17 are $154,758.71. The year to date tax collections are $3,032,996.98. The percentage of tax collections for the first quarter is 96% which is slightly higher than last year. The delinquencies are down.
Councilman Romano stated the water collections for the month of March are $87,057.05. The sewer collections for the month of March are $122,170.04.
Community Development – Councilwoman Zdichocki/Councilman Thornton
(Zoning, Construction, Code Enforcement, Economic Development, Chamber of Commerce, Downtown Revitalization)
Councilwoman Zdichocki stated activity in the Construction Department is increasing for the season. Five Zoning Permit Applications have been received. Eight violations have been sent out and the issues at Kelly Place are being addressed. The Clean-up Day and Shred Day were held this past weekend and the event went well.
Municipal Infrastructure – Councilman Thornton/Councilwoman Zdichocki
(Water Distribution, Sewer Collection System, Road Construction & Maintenance, Buildings & Grounds)
Councilman Thornton stated leaf and brush pick up will take place for one week only and will begin on May 1st. The Nixle message has been sent out as a reminder.
Information Technology – Councilmen Depew/Romano
Councilman Depew stated he had no report.
Boards/Commissions – Councilwoman Thistleton/Councilman Depew
Councilwoman Thistleton stated the Clean Communities event went very well. The Easter Egg Hunt was attended by more children than ever before. The Recreation Commission did a great job. The Board of Health held the free Rabies Clinic and received more animals than in past years and as usual the weather was cold. The Bus Trip to the Sands Casino will be taking place this Saturday and it is sold out.
ADMINISTRATOR’S REPORT
JIF Training – Administrator McNeilly stated Wayne Dietz has set up a joint annual training session at the Hopatcong Senior Center for May 3rd at 6:00PM. The Mayor and Council all stated they are available at that time to participate in the training.
Budget Presentation Recap – Administrator McNeilly stated the CFO has provided a summary of the 2017 budget and copies were distributed to the Mayor and Council.
Mayor Maio asked Administrator McNeilly if budget information has been received from the Valley Road School or Lenape Valley High School. The average homeowner will only see a $19 increase from the Borough but when the tax bills are received the increases from the other entities will be included. Administrator McNeilly confirmed when the other 65% – 68% is added to the tax bill it will not be $19.38. The municipal budget is a small portion of the overall tax obligation. The Borough has not received budget information from the county, county health tax, county library, etc. Administrator McNeilly stated it seems like the equalization for the high school is pretty consistent and similar to last year. Councilwoman Kuncken stated the population for the Valley Road School is just over 300.
Dilapidated Properties – Administrator McNeilly stated he has been working with the Zoning Official, the Tax Assessor, the Construction Official and the Borough Attorney to focus on the following properties: 5 Ridge Road, 13 Delaware Avenue, 264 Route 206, 7 Kelly Place and the house at the end of Highland Avenue #37 (Hoer Property). The Construction Official has determined that 5 Ridge Road, 264 Route 2016 and 37 Highland Avenue should be scheduled for demolition hearings. There are technicalities to be worked out with the attorney for the Route 206 property. The house on Delaware is a cosmetic issue. Administrator McNeilly stated now that the property is abandoned we will have to track down an owner.
Mayor Maio asked for the timeline of the properties slated for demolition. Administrator McNeilly stated there are some issues to be discussed with the Borough Attorney, Ursula Leo. Administrator McNeilly stated they are focusing on a few homes at a time. Administrator McNeilly stated the number of homes needing attention have decreased from 25 down to 6 or 7. The mortgage companies are getting better with management and the registration process is working. There are still homes that are sitting and getting worse.
Clean-Up Day – Administrator McNeilly stated Clean-up Day went well. DPW picked up all the trash and recycling the following day and brought it directly to Raimo’s to be weighed and disposed of.
Electronics Recycling – Administrator McNeilly stated the electronics recycling event held this past weekend collected a great deal of computers, printers, phones and VCR’s. Only 1 tube television was brought to the event which had to be turned away. Green Vision came and collected the electronics at 10:00AM Monday morning. In the interim this is a good way to collect the electronics to keep them from being dumped. Mayor Maio stated there is apparently a stray television in the canal which has to be removed. Administrator McNeilly will follow up on the removal of the television.
Administrator McNeilly stated he has not received electronic waste information from the NJDEP to date. Councilwoman Kuncken asked if the Borough can work with Green Vision again in the future. Administrator McNeilly stated he will explore the issue further. Working with Green Vision requires the electronics collection to be done in conjunction with another event. Perhaps an event can be planned for the fall.
Shredding – Administrator McNeilly stated the shredding was done by SK Paper Shred this year.
Budget Timeline – Administrator McNeilly stated the following: May 5th salary increase for non-represented employees; May 9th capital 2nd reading; May 12th retroactive salary checks; May 19th self-funded capital money available; May 30th bonded capital money available (Administrator McNeilly stated he will then ask Eric Keller, Borough Engineer, to schedule Tilcon.); July 21st send out initial budget and capital request forms; August 31st all operating and capital requests due to CFO and September 13th basic budget sheet requests to Borough Council.
Pet Licensing – Administrator McNeilly stated beginning in May, fines will be imposed on dog and cat licenses which were not renewed by the end of April.
Lakeside Park – Councilwoman Zdichocki stated trash cans need to be ordered for Lakeside Park. Administrator McNeilly stated the trash cans have already been ordered. Councilwoman Zdichocki asked when the fence will be installed. Administrator McNeilly stated he will discuss the fence issue with the DPW Supervisor.
COUNCIL DISCUSSION
Fire Department Bucket Drop – Mayor Maio stated the Fire Department has requested permission to conduct a bucket drop on Friday, Saturday, Sunday and Monday for the July 4th weekend. The Fire Department will be located on Brooklyn Road near Route 183. They will not be on Route 183 or any other state road. They will be on Sparta Road near Brooklyn Road; Linden Avenue between McKinley Street and Route 183 and Dell Road toward the bottom close to Route 183. The Governing Body agreed to the dates and locations for the bucket drop. Administrator McNeilly stated the resolution has to be included on the agenda for the first meeting in May. Councilwoman Kuncken asked Administrator McNeilly to obtain a copy of the map for the bucket drop. Mayor Maio stated she is of the opinion a map has been submitted to the Police Department.
Ordinance Appointing Municipal Clerk as Issuing Authority for Raffle Licenses – Mayor Maio asked the Governing Body to consider adopting a resolution appointing the Borough Clerk as the authority to approve raffle license applications. This would eliminate last minute scrambling by applicants trying to get the applications submitted in time for approval by the Governing Body. Councilman Romano stated he has filed for licenses in towns where a meeting is not required and it is easier for the organizations. The Clerk ensures the rules are being followed on the State side. Mayor Maio stated she has a copy of Netcong Borough’s resolution appointing the Clerk as the authority for licensing raffles which can be used as a sample. Mayor Maio gave Ms. Leo, Borough Attorney, a copy of the resolution. Mayor Maio asked to have the resolution available for the May Business Meeting Agenda.

SECTION 2. Salaries and wages for all Borough employees and officials shall be paid in bi-weekly installments as nearly equal as possible.
SECTION 3. Unless otherwise provided herein, remuneration for all employees shall be retroactive to January 1st of each year.
SECTION 4. The salaries and wages herein established shall be in lieu of any and all fees to which the respective incumbents of said offices might otherwise be entitled by statute or ordinance; which fees shall immediately upon collection thereof be paid over to the Treasurer for use of the Borough except as otherwise provided herein.
SECTION 5. The Borough shall pay medical insurance premiums in accordance with State law, collective bargaining agreements and the Borough’s elected participation in any State health benefit program for all eligible employees and their eligible dependents.
SECTION 6. The terms and conditions of all collective bargaining agreements negotiated between the Borough and any bargaining unit representing Borough employees are hereby incorporated into this Ordinance.
SECTION 7. All Ordinances and Resolutions, or parts thereof, inconsistent herewith are hereby repealed.
SECTION 8. This Ordinance shall become effective immediately upon final adoption and publication as required by law

Mayor Maio offered the following ordinances for Introduction and First Reading which were read by title:

Ordinance 2017-03
BOND ORDINANCE APPROPRIATING $170,000, AND AUTHORIZING THE ISSUANCE OF $161,500 BONDS OR NOTES OF THE BOROUGH, FOR VARIOUS IMPROVEMENTS OR PURPOSES AUTHORIZED TO BE UNDERTAKEN BY THE BOROUGH OF STANHOPE, IN THE COUNTY OF SUSSEX, NEW JERSEY
BE IT ORDAINED BY THE BOROUGH COUNCIL OF THE BOROUGH OF STANHOPE, IN THE COUNTY OF SUSSEX, NEW JERSEY (not less than two-thirds of all the members thereof affirmatively concurring), AS FOLLOWS:
Section 1. The several improvements described in Section 3 of this bond ordinance are hereby respectively authorized as general improvements to be made or acquired by The Borough of Stanhope, New Jersey. For the said several improvements or purposes stated in said Section 3, there are hereby appropriated the respective sums of money therein stated as the appropriations made for said improvements or purposes, said sums, except as described in said Section 3, being inclusive of all appropriations heretofore made therefor and amounting in the aggregate to $170,000 including the aggregate sum of $8,500 as the several down payments for said improvements or purposes required by law and more particularly described in said Section 3 and now available therefor by virtue of provision in a previously adopted budget or budgets of the Borough for down payment or for capital improvement purposes.
Section 2. For the financing of said improvements or purposes and to meet the part of said $170,000 appropriations not provided for by application hereunder of said down payments, negotiable bonds of the Borough are hereby authorized to be issued in the principal amount of $161,500 pursuant to the Local Bond Law of New Jersey. In anticipation of the issuance of said bonds and to temporarily finance said improvements or purposes, negotiable notes of the Borough in a principal amount not exceeding $161,500 are hereby authorized to be issued pursuant to and within the limitations prescribed by said Local Bond Law.
Section 3. The improvements hereby authorized and the several purposes for the financing of which said obligations are to be issued, the appropriation made for and estimated cost of each such purpose, and the estimated maximum amount of bonds or notes to be issued for each such purpose, are respectively as follows:
IMPROVEMENT OR PURPOSE (a) Acquisition by purchase and installation, as necessary, of new and additional equipment including turnout gear for use by the Fire Department of the Borough and signs and banners for use by the Buildings and Grounds Department of the Borough, together with all equipment, appurtenances and accessories necessary therefor or incidental thereto, all as shown on and in accordance with the specifications therefor on file or to be filed in the office of the Borough Clerk and hereby approved
APPROPRIATION AND ESTIMATED COST: $29,000
ESTIMATED MAXIMUM AMOUNT OF BONDS AND NOTES: $27,550
IMPROVEMENT OR PURPOSE (b) Improvement of various roads in and by the Borough by the construction or reconstruction therein of roadway pavements at least equal in useful life or durability to a roadway pavement of Class B construction (as such term is used or referred to in Section 40A:2-22 of said Local Bond Law) including, without limitation, Hill Road, McKinley Road and Linden Road, together with all structures, appurtenances, milling, curb and sidewalk reconstruction, drainage improvements, retaining walls, equipment, work and materials necessary therefor or incidental thereto, all as shown on and in accordance with the plans and specifications therefor on file or to be filed in the office of the Borough Clerk and hereby approved

The excess of the appropriation made for each of the improvements or purposes aforesaid over the estimated maximum amount of bonds or notes to be issued therefor, as above stated, is the amount of the said down payment for said purpose.
Section 4. The following additional matters are hereby determined, declared, recited and stated:
- The said purposes described in Section 3 of this bond ordinance are not current expenses and each is a property or improvement which the Borough may lawfully acquire or make as a general improvement, and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby.
- The average period of usefulness of said purposes within the limitations of said Local Bond Law and taking into consideration the respective amounts of the said obligations authorized for the several purposes, according to the reasonable life thereof computed from the date of the said bonds authorized by this bond ordinance, is 10.85 years.
- The supplemental debt statement required by said Local Bond Law has been duly made and filed in the office of the Borough Clerk and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey, and such statement shows that the gross debt of the Borough as defined in said Local Bond Law is increased by the authorization of the bonds and notes provided for in this bond ordinance by $161,500, and the said obligations authorized by this bond ordinance will be within all debt limitations prescribed by said Local Bond Law.
- Amounts not exceeding $25,000 in the aggregate for interest on said obligations, costs of issuing said obligations, engineering costs and other items of expense listed in and permitted under Section 40A:2-20 of said Local Bond Law may be included as part of the costs of said improvements and are included in the foregoing estimate thereof.
Section 5. All bond anticipation notes issued hereunder shall mature at such times as may be determined by the Chief Financial Officer, provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the Chief Financial Officer. The Chief Financial Officer shall determine all matters in connection with the notes issued pursuant to this bond ordinance, and the Chief Financial Officer’s signature upon the notes shall be conclusive evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. 40A:2-8. The Chief Financial Officer is hereby authorized to sell part or all of the notes from time to time at public or private sale at not less than par and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the dates of delivery thereof. The Chief Financial Officer is directed to report in writing to the governing body of the Borough at the meeting next succeeding the date when any sale or delivery of the notes pursuant to this bond ordinance is made. Such report must include the principal amount, interest rate and maturities of the notes sold, the price obtained and the name of the purchaser.
Section 6. The full faith and credit of the Borough are hereby pledged to the punctual payment of the principal of and interest on the said obligations authorized by this bond ordinance. Said obligations shall be direct, unlimited obligations of the Borough, and the Borough shall be obligated to levy ad valorem taxes upon all the taxable property within the Borough for the payment of said obligations and interest thereon without limitation of rate or amount.
Section 7. The capital budget or temporary capital budget of the Borough is hereby amended to conform with the provisions of this ordinance to the extent of any inconsistency herewith and the resolutions promulgated by the Local Finance Board showing all detail of the amended capital budget or temporary capital budget and capital program as approved by the Director, Division of Local Government Services, are on file with the Borough Clerk and are available for public inspection.
Section 8. This bond ordinance shall take effect twenty (20) days after the first publication thereof after final adoption, as provided by said Local Bond Law.

CAPITAL ORDINANCE APPROPRIATING 91,000.00 FOR VARIOUS IMPROVEMENTS OR PURPOSES AUTHORIZED TO BE UNDERTAKEN BY THE BOROUGH OF STANHOPE, IN THE COUNTY OF SUSSEX, NEW JERSEY
BE IT ORDAINED by the Borough Council of the Borough of Stanhope, in the County of Sussex, New Jersey, AS FOLLOWS;
Section 1. The several improvements described in Section 3 of this capital ordinance are hereby respectively authorized as general improvements to be made or acquired by the Borough of Stanhope, New Jersey. For the said several improvements or purposes stated in said Section 3, there are hereby appropriated the respective sums of money therein stated as the appropriations made for said improvements or purposes, said sums being inclusive of all appropriations heretofore made therefore and amounting in the aggregate to $91,000.00, which has heretofore been set aside for the improvement or purpose stated in Section 3 and now available therefore by virtue of provision in a previously adopted budget or budgets of the Borough for capital improvement purposes.
Section 2. For the financing of said improvements or purposes and to meet the part of said $91,000.00 appropriations, the Borough will use $39,000.00 from the General Capital Improvement Fund, $26,000 from Water Capital Outlay, $6,000.00 from Sewer Capital Outlay, and $20,000.00 from the Sewer Capital Improvement Fund, as described in Section 3.
Section 3. The improvements hereby authorized and the several purposes for the allocation of which said obligations are to be spent, the appropriation made for an estimated cost of each such purpose, and the estimated maximum amount of funds to be spent for each such purpose, are respectively as follows:

Section 4. The following additional matters are hereby determined, declared, recited and stated:
- The said purposes described in Section 3 of this capital ordinance are capital expenses and are each a property or improvement which the Borough may lawfully acquire or make as a general improvement, and no part of the cost thereof has been or shall be specifically assessed on property specially benefited thereby.
- The average period of usefulness of said purposes within the limitations of said Local bond Law and taking into consideration the respective amounts of the said obligations authorized for the several purposes, according to the reasonable life thereof computed by this capital ordinance, is five (5) years.
Section 5. This capital ordinance shall take effect ten (10) days after the publication thereof after final adoption.

RESOLUTION AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $2,641,550 BOND ANTICIPATION NOTES OF THE BOROUGH OF STANHOPE, IN THE COUNTY OF SUSSEX, NEW JERSEY
BE IT RESOLVED BY THE BOROUGH COUNCIL OF THE BOROUGH OF STANHOPE, IN THE COUNTY OF SUSSEX, NEW JERSEY, AS FOLLOWS:
Section 1. Pursuant to a bond ordinance of the Borough of Stanhope, in the County of Sussex (the “Borough”), entitled “Bond ordinance appropriating $421,900, and authorizing the issuance of $230,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on July 21, 2009 (#2009-08), bond anticipation notes of the Borough in a principal amount not exceeding $85,400 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 3. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $500,000, and authorizing the issuance of $285,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on May 25, 2010 (#2010 04), bond anticipation notes of the Borough in a principal amount not exceeding $169,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 4. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional equipment by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $90,000 therefor and authorizing the issuance of $85,500 bonds or notes of the Borough for financing such appropriation”, finally adopted on November 23, 2010 (#2010-13), bond anticipation notes of the Borough in a principal amount not exceeding $47,850 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 5. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional fire fighting equipment by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $37,000 therefor and authorizing the issuance of $35,200 bonds or notes of the Borough for financing such appropriation”, finally adopted on July 12, 2011 (#2011-13), bond anticipation notes of the Borough in a principal amount not exceeding $22,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 6. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system (Sparta Road – Phase II) in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $120,000 therefor and authorizing the issuance of $120,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on May 22, 2012 (#2012-10), bond anticipation notes of the Borough in a principal amount not exceeding $62,500 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 7. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional vehicular equipment for use by the water utility of the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $60,000 therefor and authorizing the issuance of $60,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on June 26, 2012 (#2012-14), bond anticipation notes of the Borough in a principal amount not exceeding $31,050 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 8. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $359,000, and authorizing the issuance of $341,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the county of Sussex, New Jersey”, finally adopted on June 26, 2012 (#2012-15), bond anticipation notes of the Borough in a principal amount not exceeding $283,700 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 9. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $2,300,000 therefor and authorizing the issuance of $2,300,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on November 27, 2012 (#2012-18), bond anticipation notes of the Borough in a principal amount not exceeding $46,150 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 10. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional equipment for use by the water utility of the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $140,000 therefor and authorizing the issuance of $140,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on July 9, 2013 (#2013-11), bond anticipation notes of the Borough in a principal amount not exceeding $93,800 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system (Maple Terrace/Mountain Terrace) in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $104,000 therefor and authorizing the issuance of $104,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on April 8, 2014 (#2014-07), bond anticipation notes of the Borough in a principal amount not exceeding $73,500 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 13. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of Maple Terrace/Mountain Terrace in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $245,000 therefor and authorizing the issuance of $233,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on April 8, 2014 (#2014-08), bond anticipation notes of the Borough in a principal amount not exceeding $222,001.09 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 14. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system (James Street) in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $256,000 therefor and authorizing the issuance of $256,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on June 24, 2014 (#2014-11), bond anticipation notes of the Borough in a principal amount not exceeding $211,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 15. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of James Street in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $392,000 therefor and authorizing the issuance of $133,300 bonds or notes of the Borough for financing such appropriation”, finally adopted on June 24, 2014 (#2014-12), bond anticipation notes of the Borough in a principal amount not exceeding $127,243.91 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 16. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $465,000, and authorizing the issuance of $191,955 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on August 12, 2014 (#2014 13) bond anticipation notes of the Borough in a principal amount not exceeding $185,955 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 17. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $35,000, and authorizing the issuance of $35,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on August 12, 2014 (#2014 14) bond anticipation notes of the Borough in a principal amount not exceeding $31,600 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 18. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $114,002.59 therefor and authorizing the issuance of $38,100 bonds or notes of the Borough for financing such appropriation”, finally adopted on August 26, 2014 (#2014 18) bond anticipation notes of the Borough in a principal amount not exceeding $34,700 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 19. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $271,750, and authorizing the issuance of $258,150 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on April 28, 2015 (#2015 10) bond anticipation notes of the Borough in a principal amount not exceeding $253,150 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 20. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $128,000, and authorizing the issuance of $128,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on April 28, 2015 (#2015 08) bond anticipation notes of the Borough in a principal amount not exceeding $124,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 21. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional vehicular equipment for use by the sewer utility of the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $68,000 therefor and authorizing the issuance of $68,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on April 28, 2015 (#2015-09), bond anticipation notes of the Borough in a principal amount not exceeding $34,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 22. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of various roads in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $120,000 therefor and authorizing the issuance of $114,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on July 28, 2015 (#2015-14), bond anticipation notes of the Borough in a principal amount not exceeding $112,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 23. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $338,034, and authorizing the issuance of $305,200 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on April 26, 2016 (#2016-04), bond anticipation notes of the Borough in a principal amount not exceeding $305,200 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 24. All bond anticipation notes (the “notes”) issued hereunder shall mature at such times as may be determined by the treasurer, the chief financial officer or the acting chief financial officer of the Borough (the “Chief Financial Officer”), provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the Chief Financial Officer and shall be signed and sealed by officials and officers of the Borough in any manner permitted by N.J.S.A. §40A:2-25. The Chief Financial Officer shall determine all matters in connection with the notes issued hereunder, and the Chief Financial Officer’s signature upon the notes shall be conclusive evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. §40A:2-8. The Chief Financial Officer is hereby authorized to sell part or all of the notes at not less than par from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price. Section 25. Any note issued pursuant to this resolution shall be a general obligation of the Borough, and the Borough’s faith and credit are hereby pledged to the punctual payment of the principal of and interest on the notes and, unless otherwise paid or payment provided for, an amount sufficient for such payment shall be inserted in the budget and a tax sufficient to provide for the payment thereof shall be levied and collected.
Section 26. The Chief Financial Officer is hereby authorized and directed to do all other matters necessary, useful, convenient or desirable to accomplish the delivery of the notes to the purchasers thereof as promptly as possible, including (i) the preparation, execution and dissemination of a Preliminary Official Statement and Final Official Statement with respect to the notes, (ii) preparation, distribution and publication, if necessary, of a Notice of Sale with respect to the notes, (iii) execution of a Continuing Disclosure Undertaking, with respect to the notes in accordance with Rule 15c2 12 promulgated by the Securities and Exchange Commission and (iv) execution of an arbitrage and use of proceeds certificate certifying that, among other things, the Borough, to the extent it is empowered and allowed under applicable law, will do and perform all acts and things necessary or desirable to assure that interest paid on the notes is not included in gross income under Section 103 of the Internal Revenue Code of 1986, as amended.
Section 27. All action heretofore taken by Borough officials and professionals with regard to the sale and award of the notes is hereby ratified, confirmed, adopted and approved.
Section 28. This resolution shall take effect immediately.

RESOLUTION AUTHORIZING THE RELEASE OFTHE PERFORMANCE BOND OF J.C. CONTRACTING, INC. FOR THE MAIN STREET LIGHTING PHASE II PROJECT
WHEREAS, the Mayor and Council had deemed it necessary for J.C. Contracting, Inc. to submit a performance bond prior to the commencement of the Main Street Lighting Phase II Project; and
Whereas, J.C. Contracting, Inc. did produce and the Borough did accept a performance bond guaranteeing the quality and completeness of the work; and
WHEREAS, the Borough Engineer has inspected the project site and deemed the project has been completed in general compliance with the contract; and
WHEREAS, the Borough Attorney has advised the Mayor and Council that a maintenance bond be required in the amount of $123,205.27 to be effective for one year from the date of issuance to ensure the quality of the work.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope, County of Sussex, State of New Jersey, at the concurrence of the Borough Attorney do hereby authorize the release of the performance bond to J.C. Contracting, Inc. for the Main Street Lighting Phase II Project.

RESOLUTION AUTHORIZING THE ACCEPTANCE OF MAINTENANCE BOND OFFERED BY J.C. CONTRACTING, INC. FOR THE MAIN STREET LIGHTING PHASE II PROJECT
WHEREAS, the Mayor and Council heretofore authorized the release of a performance bond submitted by J.C. Contracting, Inc.; and
Whereas, J.C. Contracting, Inc. has substantially completed the Main Street Lighting Phase II Project; and
WHEREAS, J.C. Contracting, Inc. has offered to the Borough a Maintenance Bond in the amount of $123,205.27, which amount has been specified by the Borough Attorney; and
WHEREAS, the Borough Attorney has reviewed and approved of the form of said Maintenance Bond.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope, County of Sussex, State of New Jersey, that the Borough does hereby accept the Maintenance Bond issued by J.C. Contracting, Inc. in the amount of $123,205.27 for the Main Street Lighting Phase II Project.

RESOLUTION APPROVING SETTLEMENT WITH SALVATORE CORVINO
WHEREAS, Salvatore Corvino filed a claim against the Borough of Stanhope in the Superior Court of New Jersey, Law Division, Special Civil Part, under Docket Number SSX-DC-000110-17 regarding water and sewer charges; and
WHEREAS, in an effort to avoid further costs, the parties have reached an agreement whereby the Borough will pay Mr. Corvino the sum of $3,000 and the matter will be dismissed, in full and complete settlement of the matter, as set forth in the attached Settlement Agreement.
NOW THEREFORE BE IT RESOLVED, the Borough Council hereby authorizes the Settlement Agreement between the Borough and Salvatore Corvino, authorizing payment of $3,000, and the Mayor is authorized to execute the Settlement Agreement.

RESOLUTION SUPPORTING THE CLICK IT OR TICKET SEAT BELT MOBILIZATION FOR MAY 22 THROUGH JULY 4, 2017
WHEREAS, a large percentage of the motor vehicle occupants killed in traffic crashes were not wearing a safety belt; and
WHEREAS, use of a safety belt remains the most effective way to avoid death or serious injury in a motor vehicle crash; and
WHEREAS, the State of New Jersey will participate in the nationwide Click It or Ticket seat belt mobilization from May 22 through July 4, 2017 in an effort to raise awareness and increase seat belt usage through a combination of enforcement and education; and
WHEREAS, the Division of Highway Traffic Safety has set a goal of increasing the seat belt usage rate by 1.5%; and
WHEREAS, a further increase in seat belt usage in New Jersey will save lives on our roadways;
THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Stanhope declares its support for the Click It or Ticket seat belt mobilization both locally and nationally from May 22 through July 4, 2017 and pledges to increase awareness of the mobilization and the benefits of seat belt use.
BE IT FURTHER RESOLVED that the Mayor and Council of the Borough of Stanhope authorizes the filing of an application for a grant for Click It or Ticket 2017 Seat Belt Mobilization.

Ursula Leo, Borough Attorney, stated she had no report at this time.
CITIZENS TO BE HEARD
Mayor Maio opened the meeting to the public after advising attendees that there is a five (5) minute time limit for each speaker.
Nancy Hoyt asked how residents can dispose of wood. Administrator McNeilly stated construction materials, such as wood, have to be brought to the Sussex County Municipal Utilities Authority (SCMUA) in Lafayette.
Seeing no one further from the public wishing to speak, Mayor Maio closed the public portion of the meeting.
CLOSED SESSION
WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231 P.L. 1975 permits the exclusion of the public from a meeting in certain circumstances; and
WHEREAS, this public body is of the opinion that such circumstances presently exist.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope, County of Sussex, New Jersey as follows:
1. The public shall be excluded from discussion of and action upon the hereinafter-specified subject matter(s).
2. The general nature of the subject matter(s) to be discussed is as follows:

3. It is anticipated at this time that the above stated subject matter(s) will be made public at the conclusion of each individual specified subject matter.

The Mayor and Council went into Closed Session at 7:45 P.M.
RETURN TO OPEN SESSION
At the conclusion of the Closed Session, the Mayor and Council reconvened the public meeting at 7:56 P.M. with all present.
Council Chamber Historic Pictures – Mayor Maio asked Administrator McNeilly to arrange to have the historic pictures reframed and hung in the Council Chambers with the assistance of the Clerk and Deputy Clerk. Mayor Maio asked for a status report to be provided for the next scheduled meeting.
