MAYOR’S STATEMENT AS TO COMPLIANCE WITH P.L. 1975
Adequate Notice of this Meeting has been provided according to the Open Public Meetings Act, Assembly Bill 1030. Notice of this Meeting was included in the Annual Meeting Notice sent to the New Jersey Herald and the Daily Record on January 4, 2017 and was placed on the Official Bulletin Board in the Municipal Building.
In the event the Mayor and Council have not addressed all items on this Agenda by 11:00 PM and they are of the opinion that they cannot complete the Agenda in a reasonable time period, the Mayor and Council may exercise their option to continue this meeting at an agreed to date, time and place within ten (10) days of this meeting. Please turn off all cell phones for the duration of this meeting.

Mayor Maio thanked Ellen Horak, Borough Clerk, and Administrator McNeilly for framing the photographs for the Council Chamber. The Governing Body also thanked the DPW for hanging the artwork.
CITIZENS TO BE HEARD
Mayor Maio opened the meeting to the public after advising attendees there is a five (5) minute time limit for each speaker.
Jim & Kathy Obitz, 19 New Street, stated they are experiencing problems on New Street with truck issues. The street is virtually unusable for anyone who lives there. Cars cannot be parked in the street. Several neighbors have experienced property damage. The trucks being used are 53 foot sleeper cabs. The road is not wide enough. Mayor Maio stated the road will not be widened and the Zoning Official is aware of the issue and has been working with the property owners. Mrs. Obitz stated there is damage to their property in the grass and on their driveway. Mayor Maio stated those issues should be reported to the Police Department. Mr. Obitz stated the truck problems are occurring two to three times a week. Mayor Maio stated there is an existing resolution which stays with the property and therefore the new owner must abide by the resolution or go before the Land Use Board to request relief. Much discussion took place regarding this issue. Mr. Obitz stated parking on the street runs the risk of having their vehicles get hit. Mr. Obitz stated in all fairness to the new owner, he has spoken with her and she has stated she will make every effort to use a smaller base cab, which they did initially. Mr. Obitz is of the opinion due to the nature of their business, transferring from a sleeper cab and sending it to a warehouse to be broken down into a smaller truck is cost prohibitive. Mayor Maio stated unfortunately the new owners purchased a property with restrictions which must be adhered to. Mayor Maio stated the Borough is working with the new owners. Mr. Obitz stated he is also working with them by not parking his car in the street which would prevent deliveries being made. Mrs. Obitz stated they do not want to impede the business. Mr. & Mrs. Obitz are just asking for relief from the size of the trucks. Mayor Maio stated the issue is now in the hands of the Zoning Official. Mr. & Mrs. Obitz thanked the Governing Body.
Nancy Hoyt, 33 Lawrence Avenue, asked what is happening with the Borough owned property located behind her home. Mayor Maio stated the Borough Engineer has been asked to provide a concept study for the pluses and minuses of the property. Several years ago the Governing Body and the Open Space Committee discussed using the property as a passive park with trails. At this time no decisions have been made. The Borough is exploring the possibilities. Mrs. Hoyt stated it is a lovely wildlife sanctuary. Mrs. Hoyt is of the opinion the Borough is not maintaining the existing property along Canfield Street. There is garbage along the street and the Borough is not cleaning it up. Administrator McNeilly stated the grass along the guardrails is maintained all throughout the Borough. Garbage is not picked up anywhere along the streets. Mrs. Hoyt stated she has heard there will be a parking area with 25-30 cars which she is not in favor of. Administrator McNeilly stated this is a concept study. Mayor Maio stated various options are being reviewed. The Governing Body was not envisioning a parking lot of that size. Administrator McNeilly stated the size and scale of the lot would not fit the environmental constraints of the property.
Georgiana (Chris) Mailander, 5 Kelly Place, stated in the past two weeks there were two huge trucks which were stuck trying to make the turn near her home. One of the drivers had to call a tow truck. Mayor Maio stated, as discussed earlier, the issue is being addressed by the Zoning Official and the conditions of the resolution stand. Administrator McNeilly stated the truck which was stuck received a ticket due to the fact he entered an area that was posted “No Trucks”. The second truck must have gotten himself unstuck. Councilwoman Kuncken stated sometimes the GPS sends the drivers in the wrong direction.
Anthony Riccardi, 4 Lawrence Avenue, stated there are streets in the Borough which have issues. Mr. Riccardi stated he is aware the Borough has received a TAP Grant for the area along Sparta Avenue which will provide much needed speed controls. The pavement of East Drive and Hickory Drive are in need of repair. Mr. Riccardi asked what the plans are for those areas. Mayor Maio stated those two streets have been discussed. These two roads are not scheduled for repair at this time. The Engineer and the Administrator, on an annual basis, conduct a review of all the streets in the Borough. They are graded by traffic, priority and condition.
Jim Obitz, 19 New Street, asked for a status on the steel bridge repair. Mayor Maio stated the State of New Jersey told the Borough the bridge repair was going to take place last October. Administrator McNeilly stated once the work begins it will take almost a year.
Seeing no one further from the public wishing to speak, Mayor Maio closed this public portion of the meeting.

On motion by Councilwoman Thistleton, seconded by Councilwoman Kuncken and carried by a majority voice vote the above listed minutes were approved. Councilman Thornton abstained from the minutes of July 11th. Councilman Romano and Councilwoman Zdichocki abstained from the minutes of July 25th.

COUNCIL COMMITTEE REPORTS
Public Safety – Councilwomen Kuncken/Thistleton
(Police, Fire, Ambulance, Court & Violations Bureau, Emergency Management)
Councilwoman Kuncken stated the County Fire Marshal report for the month of August indicates several inspections have been made to the businesses in the Borough and there are re-inspections which have been followed up on. Councilwoman Kuncken stated, according to the list, she is of the opinion just about all the businesses requiring fire inspections have been inspected.
Councilwoman Kuncken stated the Police Department for the month of July has reported a total of 294 calls.
Councilwoman Kuncken stated no report was submitted by the Fire Department or the Ambulance Squad.
Finance & Administration – Councilman Romano/Councilwoman Kuncken
Councilman Romano stated the water collections for the month of July totaled $45,305.57. The year to date total is $341,523.31. The sewer collections for the month of July totaled $63,776.42. The year to date total is $483,456.31.
Councilman Romano stated the tax collections for the month of July totaled $519,962.79. The year to date total is $6,329,737.10. The Borough is solvent.
Community Development – Councilwoman Zdichocki/Councilman Thornton
(Zoning, Construction, Code Enforcement, Economic Development, Chamber of Commerce, Downtown Revitalization)
Councilwoman Zdichocki stated a portion of her report she will leave for discussion during the Administrator’s Report.
Councilwoman Zdichocki stated the Zoning Department report states there were 14 zoning applications received and 9 violations issued. The excess rain is resulting in property maintenance issues with regard to overgrown grass.
Councilwoman Zdichocki stated the Fireman’s Challenge took place over the weekend. Councilwoman Zdichocki extended her thanks to the Fire Department for a job well done.
Municipal Infrastructure – Councilman Thornton/Councilwoman Zdichocki

Councilman Thornton stated the newly paved roads have all been striped and are completed.
Information Technology – Councilmen Depew/Romano

Boards/Commissions – Councilwoman Thistleton/Councilman Depew
Councilwoman Thistleton stated the Sands Bus Trip and the Halloween Parade will be coming up in October.
ADMINISTRATOR’S REPORT
Morris Canal Greenway Corridor Study – Administrator McNeilly stated he attended the NJTAP Municipal Outreach Meeting held last Tuesday in Wharton. The group consisted of representatives from Clifton to Stanhope and has been active for the past five years planning a usable route for a trail to follow the canal for the full 102 miles from Jersey City to Phillipsburg. They are now looking at local identifiable resources, as well as interconnected trails. They are tasked with completion of the planning documents by spring of 2018. This will be a trail master plan which will be available to each municipality that contains an element of the trail. The trail master plan will aid in applying for grants. Administrator McNeilly provided each member of the Governing Body with a copy of the canal map.
AED – Administrator McNeilly stated the issue regarding the AED is ongoing. The data download has been reviewed by the manufacturer. The next step is to purchase new pads and clear the codes. After final review by the manufacturer, a recommendation will be made to accept the donation by resolution.
Tax Sale – Administrator McNeilly stated the date of the Tax Sale has been set for Tuesday, October 24, 2017. As reported by the CFO, the date is later this year due to the late certification of the tax rate.
13 Delaware Avenue – Administrator McNeilly stated the current owner of 13 Delaware Avenue has walked away from the property. The owner was in court during the past year for maintenance violations. The owner paid the fine, made some effort on the yard, and then stopped. The property continues to deteriorate. Administrator McNeilly provided a copy of an email from Code Enforcement. The bank has stated they will not foreclose because it is not worth their effort. Therefore they will not maintain the property. There is a lien on the property and the lien holder has stated they will not maintain the property either. Administrator McNeilly asked for direction on how to proceed due to the fact there is no active foreclosure, and there is no interested party to work with. Mayor Maio asked Attorney Leo what can be done in this situation. Attorney Leo stated due to the new statute, until a complaint of foreclosure is filed nothing can be done. Administrator McNeilly stated this is a unique issue which will require further discussion in the future.
Ridge Road Property – Mayor Maio asked for the status of the property on Ridge Road which was approved for demolition. Administrator McNeilly stated he will contact the Construction Official for the status.
Brooklyn Road – Councilwoman Kuncken stated there is a property on Brooklyn Road with a sign posted on the door by a property maintenance company. Administrator McNeilly stated the Zoning Official is aware of this property which is located near the water tower.
Mosquito Control – Administrator McNeilly stated late this afternoon the Sussex County Commission of Mosquito Control faxed a memo stating tomorrow between the hours of 5pm – 11pm they will be spraying for mosquitos. They call out the roads and “its connecting roads”. The roads they will be on, in addition to the multiple roads listed for Hopatcong, are Lenape Drive, Grove Road, Musconetcong Avenue and Dell Road. The information has already been placed on the Borough website. A Nixle has been prepared and the information is at the front counter. The Borough only received 24 hour notice. The spraying will be done from a truck mount.
Budget 2018 – Administrator McNeilly stated on August 15th the CFO sent out the Initial Budget and Capital Request Forms. On September 29th the Operating & Capital Requests are due to the CFO. The Budget Books will be prepared in early October.
Air Quality Report – Mayor Maio asked Administrator McNeilly for the status on the Air Quality Report which was conducted at Borough Hall approximately a year ago. Administrator McNeilly stated everything was fine except for some housecleaning issues. Mayor Maio asked if there are plans to have duct cleaning done. Administrator McNeilly stated duct cleaning was not part of the recommendations. The report stated filter changes, rug cleaning and issues such as that were recommended. Mayor Maio asked if those items have been addressed. Administrator McNeilly stated he could not answer at this time. He will speak with Ward to find out if the carpets have been cleaned. Mayor Maio asked the Clerk to include this topic for follow-up at the next scheduled meeting.
Half Way to St. Patrick’s Day Fund Raiser – Councilwoman Zdichocki stated the Half Way to St. Patrick’s Day Fund Raiser Dinner will be to support the Armed Forces Relief Committee and our community. The event will be held on September 23rd. Anyone interested in purchasing tickets can contact Councilwoman Zdichocki or the Fire Department.
COUNCIL DISCUSSION
Sanitary Sewer Inspections (Sump Pumps) – Mayor Maio invited Eric Keller, Borough Engineer, forward to discuss the sanitary sewer issue. Mr. Keller stated he has been working on the plan. Mr. Keller stated there is a portion of the system which has been impacted by the high flows. Flow meters will be installed at various locations within the system to determine where the problems exist. Video has been taken at the Port Morris Pump Station along the lake at the point which will be reviewed to determine if there is running water from the laterals. Mr. Keller will have to arrange with a consultant for the meters. The meters will be in the ground for approximately four (4) weeks. Smoke testing will be conducted to determine if there are leaks in the system. If there is an area with significant flow, we can go house to house to determine if sump pumps are an issue. Mayor Maio asked Administrator McNeilly to put a notice in with the water bill mailing providing information about sump pumps. The notice should state if a resident has a sump pump which is connected to the sanitary sewer system, they are in violation and it needs to be corrected. A phone number should be listed for them to contact with any questions. Residents need to be made aware that this is a problem. Mr. Keller stated the notice should also state inspections will be made. Administrator McNeilly stated the Borough Code very clearly states the minute a connection is made to the sewer system, the municipality is guaranteed access to review anything to do with the sewer system. Mayor Maio stated this problem is going to be corrected and the necessary steps have to be taken. Administrator McNeilly suggested a meter be placed at the mouth of the Musconetcong Pump Station. Mr. Keller stated half a dozen meters can be installed by early September. Some meters may be read and then relocated to other locations. Administrator McNeilly stated readings later in September should provide information during rain storms. Mayor Maio asked the Clerk to add this topic for discussion at the September 12th meeting. Mr. Keller stated the meters will be installed by that time. If all six meters are not available by that time, the meters available will be installed to begin monitoring. Mayor Maio asked Ms. Leo, Borough Attorney, if she needs to review the notice which will be sent out. Ms. Leo stated she will review the notice to make sure it matches the ordinance.
TAP Grant (Sparta Road) – Mayor Maio stated the Governing Body advertised and met at the site on Sparta Road regarding the TAP Grant. The Governing Body witnessed how quickly cars were moving across the bridge into the Borough. There will be a Welcome to Stanhope sign installed just past the bridge and a flashing traffic sign will be installed showing the speed the cars are travelling indicating they need to slow down. Mr. Keller stated the plan is to narrow the traffic lanes by widening up the shoulder line to create a visual narrowing of the roadway to reinforce the fact a slower speed is required. More speed limit signs will be posted so there is no question as to what the speed limit is. Other striping options are being reviewed such as a bike lane or to reinforce the edge from a visual perspective to create a traffic calm. Mr. Keller stated in order to slow people down when turning onto Lenape Drive the road opening could be narrowed. The Governing Body stated they were unsure why this was an issue. Mr. Keller stated he was walking across Lenape Drive one afternoon and only one car turned onto the road but a pedestrian crossing this road is in the roadway for 120 ft. The road itself is approximately 34 feet wide but the curb returns are so big a pedestrian is out on the pavement for a long period of time, which is not safe. Administrator McNeilly stated by decreasing the size of the entrance to the road, people will have to slow down to make a proper turn. Mr. Keller discussed the lighting needs with regard to spacing and the number of lights. The plan is to place 24 lights approximately 100 feet apart. Mayor Maio asked Mr. Keller if the plan for the placement of the lights could be made available for the next scheduled meeting. Mr. Keller asked if the layout is to alternate sides, 100 feet apart and then visit the site to verify the location. The Governing Body agreed. Mayor Maio stated the exact number of lights required needs to be determined. Mr. Keller stated two extra lights will be ordered over what is required. This will provide for an immediate replacement in the event that one of the lights is damaged as the result of a motor vehicle accident. The fixtures will be LED.
Mayor Maio asked Mr. Keller to prepare a concept for the Welcome To Stanhope sign and to prepare visual options for the flashing speed limit sign, the layout for the lights and the squaring up of the curb openings at the Little League Field and at Lenape Drive. The Governing Body would also like to know how wide the shoulder areas will be. Mayor Maio asked Mr. Keller to have this information available for the work session on September 12th. Councilman Thornton asked about the addition of a fire hydrant. Mayor Maio stated the Fire Department has requested an additional fire hydrant to be installed on the Lenape Valley High School side of the road when the road is milled and paved, as part of the other grant project. Mr. Keller stated the fire hydrant can be added to the local aid portion of the grant. The Borough’s estimate, with our 15% for the local aid portion, was $305,000 in construction costs. The Borough received a grant for $180,000. The Borough’s costs will be $125,000. The TAP Grant estimate was $830,000 and the Borough received $825,000. Mr. Keller stated the hydrant cost is approximately $6,000. Thirty feet of pipe would be required along with fittings. The costs can be included as part of the contract. The estimate for Sparta Road included sidewalks, ADA improvements, landscaping, wrapping sanitary manholes to seal the castings and to replace inlet castings which is required under the stormwater regulations whenever a road is repaved. Mr. Keller stated the grant will cover the costs of the milling and paving at $180,000. The curb work, sidewalks etc. are going to be paid for with Borough funds. Administrator McNeilly stated the hydrant will be listed as an item to be included in the project.
Mayor Maio stated discussion will continue at the September 12th meeting. The meeting will start at 6:00pm. The Clerk will advertise the time change.

Reminder – Mayor Maio stated there will be a farewell luncheon on August 21st in Council Chambers for Sgt. Charlie Zweigle’s retirement from the Police Department.
School Consolidation – Mayor Maio stated she received a memo and a copy of a resolution from the Mayor of Newton. Newton’s Mayor is asking the Borough to consider the possibility of a consolidation of school administration on a county level. He is suggesting one Superintendent for the County and a County Business Administrator. All schools would maintain a Principal. Mayor Maio asked the Clerk to distribute a copy of the sample resolution to the Governing Body and add this topic to the agenda for the next scheduled meeting.

Ordinance 2017-06 AN ORDINANCE OF THE BOROUGH OF STANHOPE, SUSSEX COUNTY, NEW JERSEY AMENDING SECTION 105-2.A OF THE CODE OF THE BOROUGH OF STANHOPE TO REFLECT CHANGES TO PARK HOURS AT MUSCONETCONG AND LAKESIDE PARKS
WHEREAS, the Borough Council desires to amend the current township code in order to permit legal fishing activities at night;
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Stanhope, Sussex County, New Jersey, as follows:
SECTION 1.
Section 105-2.A is deleted in its entirety and replaced as follows:
A. Parks shall be open daily to the public from 8:00am to sunset. No person shall enter or remain in any park before 8:00am or after sunset, except that individuals may be present at the parks beyond the 8:00am to sunset hours for legal fishing activities only.
SECTION 2 – SEVERABILITY
If any provision of this Ordinance or the application of this Ordinance to any person or circumstances is held invalid, the remainder of this Ordinance shall not be affected and shall remain in full force and effect.
SECTION 3 – REPEALER
All ordinances or parts of ordinances or resolutions that are inconsistent or in opposition to the provisions of this Ordinance are hereby repealed in their entirety.
SECTION 4: EFFECTIVE DATE
This Ordinance shall take effect immediately upon adoption and publication in accordance with law.

Ordinance 2017-07 AN ORDINANCE OF THE BOROUGH OF STANHOPE, SUSSEX COUNTY, NEW JERSEY AMENDING SECTION 133-37.1 OF THE CODE OF THE BOROUGH OF STANHOPE TO ELIMINATE PERMIT PARKING IN MUNICIPAL LOTS
WHEREAS, the Borough Council has reviewed the permit parking requirements in municipal lots and has determined that revisions are necessary;
NOW THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Stanhope, Sussex County, New Jersey as follows:

Section 133-37.1, in accordance with 133-11.1, is revised by the deletion of the following:

RESOLUTIONS
CONSENT AGENDA (All items listed on the Consent Agenda are considered routine by the Borough Council and were enacted by one motion of the Borough Council with no separate discussion.)
Resolution 140-17 RESOLUTION OF THE MAYOR AND COUNCIL OF THE BOROUGH OF STANHOPE IN SUPPORT OF THE (F.O.P.) FIBRODYSPLASIA OSSIFICANS PROGRESSIVA AWARENESS INITIATIVE
WHEREAS, Fibrodysplasia Ossificans Progressive (FOP) is a rare genetic condition in which the body makes additional bone in locations where bone should not form, such as within muscles, tendons, ligaments and other connective tissues, which in time produces a ‘second skeleton’ that immobilizes the joints of the body; and
WHEREAS, one in every seven Americans suffers from a musculoskeletal impairment causing physical disability and severe long-term pain; and
WHEREAS, the symptoms of FOP usually begin in the first or second decade of life, with the majority of patients diagnosed by age 10, depriving children of normal development; and
WHEREAS, FOP is considered an orphan disease whereby it affects so few people and there are less than 12 diagnosed cases in New Jersey and approximately 200 in the nation; and
WHEREAS, musculoskeletal research is close to achieving major breakthroughs that likely will change and simplify the way bone and joint disorders are treated and prevented throughout the world; and
WHEREAS, there is a need for greater awareness of this disorder, its symptoms and the obstacles faced by persons and families affected by this disorder;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Stanhope, County of Sussex, New Jersey hereby applaud and recognize Gary W. Whyte as an outstanding individual for his tenacious drive to support and help so many within the community for the awareness of Fibrodysplasia Ossificans Progressiva (FOP) and urge the medical community to continue researching for treatment and a cure for this rare genetic disorder.
Resolution 141-17 RESOLUTION AUTHORIZING REFUND OF REDEMPTION MONIES TO OUTSIDE LIEN HOLDER
WHEREAS, the Tax Collector has received payment for the redemption of Tax Title Lien No. 2016-019, representing 2015 property taxes and/or utility charges on Block 11501, Lot 2, C0081, known as 581 Dell Place, currently assessed to Jacquelyn M Nascimento, and;
WHEREAS, the Tax Collector certifies that reimbursement is now required to be made to the following lien holder for the required redemption amounts as shown below:

PAYMENT OF BILLS
Resolution 145-17 RESOLUTION OF THE MAYOR AND COUNCIL OF THE BOROUGH OF STANHOPE AUTHORIZING PAYMENT OF BILLS
WHEREAS, the Chief Finance Officer has certified that funds are available in the proper account; and
WHEREAS, the Chief Finance Officer has approved payment upon certification from the Borough Department Heads that the goods and/or services have been rendered to the Borough;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope that the current bills list, dated August 8, 2017 and on file and available for public inspection in the Office of the Chief Finance Officer and approved by the Chief Finance Officer for payment, be paid.

ATTORNEY’S REPORT
Ursula Leo, Borough Attorney, stated she had no report.
CITIZENS TO BE HEARD
Mayor Maio opened the meeting to the public after advising attendees that there is a five (5) minute time limit for each speaker.
Anthony Riccardi, 4 Lawrence Avenue, suggested the sump pump information being sent to the residents should show the correct and the incorrect way for the sump pumps to be connected and contact information should be provided. Mayor Maio stated the residents can contact the Borough. The residents will most likely need to contact a plumber and the Borough cannot recommend specific contractors.
Nancy Hoyt, 33 Lawrence Avenue, asked if Sparta Road is going to be narrowed. Mayor Maio stated the physical roadway is not going to be narrowed. Currently, there is parking on Sparta Road on the Lenape Woods side of the road. It is the Governing Body’s intent to calm the traffic. The shoulder on that side of the road will be widened and the width of the shoulder on the other side of the road will be increased. This will reduce the driving lanes to 10 feet in each direction instead of 12 feet each. The high school side of the road where there is no parking permitted will be a bike lane. The street lights will be installed from Brooklyn Road to the main entrance at the high school.
Mrs. Hoyt asked who is responsible for cutting back the brush along the sidewalk on High Street near the gas station. Administrator McNeilly stated the property owner has been notified.
Seeing no one further from the public wishing to speak, Mayor Maio closed the public portion of the meeting.
