CALL TO ORDER

SALUTE TO COLORS
Mayor Maio invited all those present to stand in a salute to the colors.

MAYOR’S STATEMENT AS TO COMPLIANCE WITH P.L. 1975
Adequate Notice of this Meeting has been provided according to the Open Public Meetings Act, Assembly Bill 1030. Notice of this Meeting was included in the Annual Meeting Notice sent to the New Jersey Herald and the Daily Record on January 6, 2016 and was placed on the Official Bulletin Board in the Municipal Building.

In the event the Mayor and Council have not addressed all items on this Agenda by 11:00 PM and they are of the opinion that they cannot complete the Agenda in a reasonable time period, the Mayor and Council may exercise their option to continue this meeting at an agreed to date, time and place within ten (10) days of this meeting. Please turn off all cell phones for the duration of this meeting.

CITIZENS TO BE HEARD
Mayor Maio opened the meeting to the public after advising attendees that there is a five (5) minute time limit for each speaker.

Peggy Spooner, 87 Main Street, asked if the new electric company is lowering the Borough’s bills. Mayor Maio stated the electric co-op is only for residential customers. The Borough is enrolled with a different co-op. Mrs. Spooner stated she has some questions regarding the ordinance rezoning for Main Street. Mayor Maio stated a public hearing is going to be held later on tonight’s agenda and Mrs. Spooner can ask her questions at that time.

Seeing no one further from the public wishing to speak, Mayor Maio closed the public portion of the meeting.

On motion by Councilwoman Kuncken, seconded by Councilwoman Thistleton and carried by voice vote the above listed minutes were approved.

CORRESPONDENCE (List Attached)
On motion by Councilman Thornton, seconded by Councilman Depew and unanimously carried by voice vote, the list of correspondence was accepted and ordered placed on file.

Mayor Maio asked for clarification regarding the content of the July 18th DOT letter. Ms. Horak stated any correspondence pertaining to property within the Borough would have been copied to the Governing Body. Ms. Horak will copy the letter and place it in the Governing Body’s mailboxes. Administrator McNeilly stated he is of the opinion the letter is from the Commissioner of the NJDOT confirming the legislator’s letter. The council did confirm receipt of that letter.

COUNCIL COMMITTEE REPORTS

Public Safety – Councilwomen Kuncken/Thistleton
(Police, Fire, Ambulance, Court & Violations Bureau, Emergency Management)
Councilwoman Kuncken reported for the month of June the Fire Department answered 12 calls, had 4 mutual aid calls, 1 assist for EMS, 6 drills and 23 total activities. The volunteer hours totaled 292.75.

Councilwoman Kuncken stated Virgil Rome, County Fire Marshal, reported one inspection for the month of June for the street fair.

Councilwoman Kuncken stated the Police Department report consists of various calls for the month. The majority of the calls are motor vehicle stops which totaled 191. The combined total for all activities was 330.

Councilwoman Kuncken stated the Ambulance Squad report was not submitted this month.

Finance & Administration – Councilman Romano/Councilwoman Kuncken
No report was given.

Community Development – Councilwoman Zdichocki/Councilman Thornton
(Zoning, Construction, Code Enforcement, Economic Development, Chamber of Commerce, Downtown Revitalization)

Councilwoman Zdichocki stated a Clean Communities meeting was held this past Monday with the Coordinator, Dana Mooney. Councilwoman Zdichocki, Mayor Maio and Councilman Thornton met with Ms. Mooney to discuss the past programs such as the May clean-up, park clean-up and paper shredding event. The Borough receives grant funding from the Clean Communities Program. How the money is used and potential projects were discussed. Suggestions were made to provide additional waste receptacles in the parks, paper shredding event, educational programs for the schools, the senior citizens and the general public. A follow-up meeting is scheduled for August 23rd to prepare the next three month plan.

Municipal Infrastructure – Councilman Thornton/Councilwoman Zdichocki
(Water Distribution, Sewer Collection System, Road Construction & Maintenance, Buildings & Grounds)

Councilman Thornton stated a bid was received for the Port Morris Reclamation. The awarding of the bid is on tonight’s agenda.

Information Technology – Councilmen Depew/Romano
Councilman Depew stated the new website is up and running. Councilman Depew stated he has received only positive feedback from people who have accessed the new website. Councilman Depew thanked Mayor Maio, Councilman Romano and Administrator McNeilly for their assistance in getting the new website in place. Mayor Maio stated it was a long time in coming.

Boards/Commissions – Councilwoman Thistleton/Councilman Depew
Councilwoman Thistleton stated fun was had by all those who attended Family Fun Day.

Councilwoman Thistleton stated Camp Lenape registration is usually broken down by weeks but the Recreation Commission was able to break down the numbers by campers, as per Mayor Maio’s request. This year there were 28 campers from Stanhope who attended camp for a total of 75 weeks. Camp is still running for another three weeks and residents can still register. In 2015, there were 31 campers attending for a total of 86 weeks. In 2014, there were 35 campers who attended for a total of 102 weeks. Councilwoman Thistleton stated the numbers have dropped. Mayor Maio is concerned the numbers have dropped due to the fact camp was not held in Stanhope this year. Councilwoman Zdichocki stated there are still three weeks left. Some discussion took place regarding the fact that the demographics have changed. The number of students enrolled at the elementary school has declined. The economy may also be having an effect on the enrollment.

Mayor Maio thanked Councilwoman Thistleton for obtaining the camp information.

ENGINEER’S REPORT
Mayor Maio invited Eric Keller, Borough Engineer, to come forward to give his report.

Reclamation Project – Mr. Keller stated the reclamation project is on the agenda for this evening. A preconstruction meeting will be scheduled after the ordinance is adopted and the contract and required paperwork has been received from DeSantis. This should be accomplished by early to mid-August. The contract is for 45 days. At the outside this could take until mid-October. The streets included in the project are: Spring Street, Coursen Street, Port Morris, Hillside Avenue, Spring Lane and Lake Street.

Crosswalk Rehabilitation – Mr. Keller stated the crosswalk rehabilitation project went out to bid on the same day as the reclamation project. There were no bidders for this project. Mr. Keller stated he had discussions with the manufacturer’s representative. The approved installers typically work for a paver. The only pavers the representative knew of are located in South Jersey. Mr. Keller stated he has spoken with Administrator McNeilly and informed him the paving portion of the project is fairly small. The cost is low and therefore it could be done without going to bid due to the fact it will be below the bidding threshold. Mr. Keller has been contacting contractors for estimates. The existing crosswalks can be milled and paved and then the Borough can go back out to bid. The authorization to re-bid the project is on tonight’s agenda. The milling and paving will be eliminated from the bid. The bid will be to install the crosswalks and stripe them. Councilman Thornton stated the representative had stated there are pavers in Pennsylvania that they work with. Mr. Keller stated the Pennsylvania contractors were not willing to travel to New Jersey for such a small job. Mr. Keller stated he was not made aware during prior discussions of the paving issue.

Main Street Lighting – Mr. Keller stated the Main Street Lighting project is out to bid right now. The bid opening is scheduled for this Thursday at 2PM. One of the bidders raised an issue with regard to the form of the performance bond. Mr. Keller stated a letter was received from the bidder’s insurance agency quoting case law and stating it was not a proper form. Mr. Keller stated he spoke with Administrator McNeilly and the information was sent to Ursula Leo, Attorney, for review. A new clarification was issued with a new performance bond and some other minor changes within the body of the specifications to deal with this. This was done to avoid any issues, questions or objections to the bid. This has been in the contracts forever but this is the first time this issue has ever been brought up. The information has been provided to the Borough Clerk however, the bid has to be rescheduled due to the fact this is happening two days prior to the bid.

Mayor Maio stated now there are two projects which are being delayed until the fall. Mr. Keller stated the lighting was not expected to be done prior to the fall due to the fact there is a twelve week lead time to get the lights. They are no longer a stock item. Most lighting is changing over to LED’s which is not what the Borough has. Mayor Maio stated she is concerned the project will not be completed this year. Mr. Keller stated this is not a re-bid, it is a delayed bid opening. Some contractors have already purchased bid packets and they will receive the updated information. The bid opening will be held on August 9th at 10AM. The awarding of the bid will be prepared for the August 23rd council meeting.

Musconetcong Dam – Mr. Keller stated he spoke with the DEP’s consultant and clarified the Borough’s points with respect to the walkway. No stone dust on top of the rip rap, four trees are to be installed as part of the contract along with the shrubs and other items which were discussed previously. The old rubble wall will be cleaned up. Mr. Keller is waiting to receive revised plans. According to Mr. Keller’s notes from the meeting with DEP, which was held back in March, they are planning a late fall start.

Administrator McNeilly stated once the plans are received and approved, Mr. Keller will provide a letter stating his requirements are complete. Mr. Stein will provide a letter when the construction easement is complete. At that time a resolution for adoption will be placed on the agenda.

Sidewalk Project Route 183 and Route 206 – Mr. Keller stated he and Administrator McNeilly have been working to reach an agreement with Stanhope Mountain Associates. Mr. Keller had drafted a memo regarding their concerns with the retaining wall. From a design perspective a retaining wall has to be installed due to the steepness. Their lot is located on the ramp from Route 183 to Route 206. Stanhope Mountain’s concern is they may want to have driveway access in the future. Mr. Keller stated he has informed them the state will probably not permit an opening in that area. Mr. Keller sent the memo this afternoon. Stanhope Mountain has asked their local engineer, Dykstra Walker, to review the issue.

Mayor Maio asked if any information has been received regarding the status of the grant. Mr. Keller stated due to the shutdown of the Transportation Trust Fund (TTF), Local Aid is not permitted to work on TTF projects which are funded by the state. Mayor Maio stated the project will not be able to be completed this year. Mr. Keller confirmed this. At this point, even if the TTF was not shut down, the two easements have not been obtained. Councilwoman Kuncken stated the Governing Body is concerned about being able to hold onto those funds. Mayor Maio stated the Borough is beyond the deadline for beginning the project and this happened long before the shutdown of the TTF. Mr. Keller confirmed this and stated the detailed chronology of all the steps the Borough has gone through with the easements was submitted.

Sagamore Road Milling and Paving – Mr. Keller stated the request to Tilcon for the paving of Sagamore Road to be done through the co-op has been submitted. Tilcon then contacted Mr. Keller and requested he fill out their forms which he has done. Originally the estimate was for $36,000. The new estimate with the current pricing is under $26,000. All the measurements have been rechecked. Mr. Keller stated he has contacted Tilcon twice regarding the scheduling. The DPW has done work to the catch basins and some other prep work. Mayor Maio asked how much notice will be given to the Borough. Mr. Keller stated he will receive a few days notice. Mayor Maio stated the residents need to have more than a couple days notice. Much discussion took place regarding how the residents will be noticed. Mayor Maio stated she would like a notice to be delivered to the residents now letting them know the scheduling of the project is pending and the Borough may have a week’s notice or it could be just a few days. Mr. Keller stated the project will be done over two days. The road will be milled the first day and paved on the second day.

Councilman Depew asked Mr. Keller when the reclamation project for Port Morris is expected to be completed. Mr. Keller stated the work should be completed by mid-October at the latest. Mr. Keller stated once the reclamation is done there is a short amount of time available to complete the paving. Administrator McNeilly stated once work begins the work will be done quickly.

ADMINISTRATOR’S REPORT
DPW – (Lawrence Avenue Drainage) Administrator McNeilly stated the DPW is scheduled to receive the slit drain pipe this week. Once received, Bill Storms, Superintendent, will schedule the installation. Mr. Storms will make neighborhood notification to the three effected homeowners.

DPW – (Lakeside Park) Administrator McNeilly stated the improvements for the parking area will take place after the Lawrence Avenue drainage project. This will include a stone surface, a delineated edge with the two foot high posts with roping in between. Mayor Maio stated waste receptacles are needed for the park and suggested the same black trash can and blue can for recycling should be purchased as was done in the past. Funding is available from Clean Communities. Administrator McNeilly stated he is reaching out to JCP&L regarding the light pole.

Loss Control – Administrator McNeilly stated the Morris County JIF performed the 2016 Loss Control Survey. The inspection went well with only three minor infractions at the public works garage involving an exit light out and missing load rating identification tags. These issues have been taken care of. Parks and Grounds came through with only minor mention to a broken plastic retaining wall panel. We are searching for a place to purchase replacement parts.

Damaged Main Street Light – Administrator McNeilly stated on Wednesday, July 20th, a tractor trailer came down Linden Avenue onto High Street and turned right onto Main Street by the Stanhope House striking one of the decorative street lights. The driver stopped and the police responded to the call. The driver’s insurance information has been obtained. The DPW was called in to remove the downed light and bypass the wiring to maintain function of the remaining lights. The crew did a great job securing the light base. The claim will be processed once the police report is released. Administrator McNeilly stated the lead time to receive the new light pole is going to be just as long as the other lights.

OPEIU Local 32 – Administrator McNeilly stated he has received formal notification from the union representative, KB Barnes, wishing to open negotiations.

Budget 2017 – Administrator McNeilly stated the initial budget letters and capital request forms have been distributed to all the department heads, boards and commissions.

Lighting – Councilwoman Zdichocki asked Administrator McNeilly if there is a minimum order amount required to order the lights. Administrator McNeilly stated a minimum order is not required. Councilwoman Zdichocki suggested purchasing a second light to have as a backup. Administrator McNeilly stated the budget does not allow for ordering an additional light. The lights cost $10,000 each. The pole is not the lead item it is the head of the light fixture. Due to the uniqueness of the Borough’s light fixture setup the head is the lead item. The heads have to be made. Mayor Maio asked if the heads were purchased from an electric supply company when they were switched out and why wouldn’t the Borough do that again. Administrator McNeilly confirmed the previous purchase was from the electric supplier however, the item is no longer a stock item. Mr. Keller stated the manufacturers are focusing on LED lights now and they are no longer stocking the type of the lights used by the Borough.

Mayor Maio asked why the light cannot be ordered right now. Administrator McNeilly replied there are no funds available. Once the police report is received the insurance claim will be submitted. The light fixture cannot be replaced until the insurance funds are received. Mayor Maio asked Administrator McNeilly to speak with the CFO to determine if there are emergency funds available to order the light now. Administrator McNeilly stated he will affect every possible means to put the light fixture back in as fast as humanly possible.

Mayor Maio asked the Borough Clerk to add the Main Street Light issue to the next agenda for Council Discussion.

Route 206 Bungalow – Councilman Depew asked for an update on the bungalow located on Route 206. Administrator McNeilly stated the issue has been turned over to Mr. Stein, Borough Attorney. The building is in the preliminary stages for a condemnation hearing. The title search has been completed.

COUNCIL DISCUSSION
Mayor Maio asked the Governing Body if there were any other issues to be discussed. There were none.

Mayor Maio offered the following ordinances for Public Hearing and Final Adoption which were read by title:

Ordinance 2016-06
AN ORDINANCE OF THE BOROUGH OF STANHOPE, SUSSEX COUNTY, NEW JERSEY AMENDING CHAPTER 100 OF THE CODE OF THE BOROUGH OF STANHOPE ENTITLED “LAND DEVELOPMENT” BY EXPANDING THE VILLAGE BUSINESS ZONE

WHEREAS, the Borough of Stanhope Land Use Board heretofore undertook a Master Plan Re-Examination pursuant to the provisions of N.J.S.A. 40:55D-89; and

WHEREAS, the Governing Body of the Borough of Stanhope has accepted the findings, conclusions and recommendations of the Master Plan Re-Examination Report; and

WHEREAS, said Master Plan Re-Examination Report recommended the expansion of the Village Business zone;

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Stanhope as follows:

SECTION 1. The following properties are hereby re-zoned from the Historic Village Residential (HVR) zone to the Village Business (VB) zone:

  • Block 11206, Lots 1 through 5
  • Block 11303, Lots 1 and 2
  • Block 11302, Lots 1 through 8
  • Block 11304, lots 18 through 31

SECTION 2. The Borough Zoning Map established in Section 100-51 “District Boundaries Established” of the Land Development Ordinance of the Borough of Stanhope is hereby revised to incorporate the property zone changes set forth in Section 1 of this Ordinance.

SECTION 3. This Ordinance shall take effective upon passage and publication as required by law.

On motion by Councilwoman Kuncken, seconded by Councilman Depew, and unanimously carried by the following roll call vote, the foregoing ordinance was adopted.

Mayor Maio opened this portion of the meeting to the public for discussion on this item only.

Peggy Spooner, 87 Main Street, asked for clarification on the zoning of Main Street. Mrs. Spooner stated the zoning for her home is not changing and it will remain residential. Administrator McNeilly explained to Mrs. Spooner the reason her block and lot is not listed on the ordinance and is not changing is due to the fact her home is already zoned Village Business. Mrs. Spooner asked what the difference is between business and commercial. Mayor Maio stated there is no difference. Mrs. Spooner asked how this will affect the water billing. Administrator McNeilly explained Mrs. Spooner lives in her home which is a residential use permitted in the zone and her water bill will continue to be calculated at the residential rate. Income properties, businesses and rental properties, are charged at the commercial rate and will continue to be charged the commercial rate. In the future if someone sells or changes the use of their home and it becomes an income property the water billing would be based on the commercial rate.

Mrs. Spooner stated when they purchased their home the zoning was listed as historic, which is no longer part of the wording. Administrator McNeilly stated the word historic did not mean anything but in many communities historic districts have very strict requirements regarding what homeowners can and cannot do to their homes. The Borough had listed the area as historic only because of the age of the homes in this area.

Ordinance 2016-07
AN ORDINANCE OF THE BOROUGH OF STANHOPE, SUSSEX COUNTY, NEW JERSEY AMENDING CHAPTER 44 OF THE CODE OF THE BOROUGH OF STANHOPE ENTITLED “BOARD OF RECREATION COMMISSIONERS” TO REQUIRE BACKGROUND INVESTIGATIONS OF RECREATION COMMISSION MEMBERS AND VOLUNTEERS

BE IT ORDAINED by the Mayor and Council of the Borough of Stanhope as follows:

SECTION 1.

Chapter 44 of the Code of the Borough of Stanhope entitled “Board of Recreation Commissioners” is hereby amended by the addition of a new subsection 44-6 to be entitled “Background Investigations” to read as follows:

44-6. Background Investigations. All Recreation Commission members, applicants to become Recreation Commission members, Recreation Commission volunteers and applicants to become Recreation Commission volunteers shall be required to submit to a background investigation conducted by the Borough of Stanhope. All initial investigations shall include such information as shall be required to conduct the investigation. The results of the background investigations shall be provided to the Borough Clerk for any further action that may be required. The cost of the background investigation shall be paid by the Borough.

SECTION 2. This Ordinance shall take effect upon passage and publication as required by law.

On motion by Councilwoman Kuncken, seconded by Councilwoman Thistleton, and unanimously carried by the following roll call vote, the foregoing ordinance was adopted.

Ordinance 2016-08
CAPITAL ORDINANCE APPROPRIATING $8,659.77 FOR MILLING AND PAVING OF VARIOUS ROADS AUTHORIZED TO BE UNDERTAKEN BY THE BOROUGH OF STANHOPE, IN THE COUNTY OF SUSSEX, NEW JERSEY

BE IT ORDAINED by the Borough Council of the Borough of Stanhope, in the County of Sussex, New Jersey, AS FOLLOWS;

Section 1. The several improvements described in Section 3 of this capital ordinance are hereby respectively authorized as general improvements to be made or acquired by the Borough of Stanhope, New Jersey. For the said several improvements or purposes stated in said Section 3, there are hereby appropriated the respective sums of money therein stated as the appropriations made for said improvements or purposes, said sums being inclusive of all appropriations heretofore made therefore and amounting in the aggregate to $8,659.77, which has heretofore been set aside for the improvement or purpose stated in Section 3 and now available therefore by virtue of provision in a previously adopted budget or budgets of the Borough for capital improvement purposes.

Section 2. For the financing of said improvements or purposes and to meet the part of said $8,659.77 appropriations, the Borough will use $8,659.77 from the General Capital Reserve for Road Improvements, as described in Section 3.

Section 3. The improvements hereby authorized and the several purposes for the allocation of which said obligations are to be spent, the appropriation made for an estimated cost of each such purpose, and the estimated maximum amount of funds to be spent for each such purpose, are respectively as follows:

Milling and Paving of various roads, including

Sagamore Road $ 8,659.77 Reserve for Road Improvements

All the aforestated improvements or purposes where applicable, are in accordance with specifications on file in the office of the Borough Clerk, which specifications are hereby approved.

Section 4. The following additional matters are hereby determined, declared, recited and stated:

  1. The said purposes described in Section 3 of this capital ordinance are capital expenses and are each a property or improvement which the Borough may lawfully acquire or make as a general improvement, and no part of the cost thereof has been or shall be specifically assessed on property specially benefited thereby.
  2. The average period of usefulness of said purposes within the limitations of said Local bond Law and taking into consideration the respective amounts of the said obligations authorized for the several purposes, according to the reasonable life thereof computed by this capital ordinance, is five (5) years.

Section 5. This capital ordinance shall take effect ten (10) days after the publication thereof after final adoption.

On motion by Councilman Thornton, seconded by Councilwoman Zdichocki, and unanimously carried by the following roll call vote, the foregoing ordinance was adopted.

Councilwoman Kuncken stated the amount read by Mr. Stein is different than the figure listed on the agenda. The Borough Clerk confirmed the amount of $8,659.77 listed on the ordinance is correct.

NEW BUSINESS

RESOLUTIONS

Mayor Maio offered the following resolutions which were read by title:

Resolution 122-16
RESOLUTION AUTHORIZING EXECUTION OF REIMBURSEMENT
AGREEMENTS WITH STONEGATE CONDOMINIUM ASSOCIATION

WHEREAS, the Stonegate Condominium Association is located in the Borough of Stanhope; and

WHEREAS, pursuant to the provisions of the Qualified Community Act, N.J.S.A. 40:67-23.2, the Stonegate Condominium Association is entitled to receive certain services from the Borough or to receive compensation for said services in lieu of the Borough providing same; and

WHEREAS, the Borough has elected to reimburse the condominium association for street lighting, leaf removal and snow plowing for the internal roadways in the condominium; and

WHEREAS, the Borough has also elected to reimburse the Stonegate Condominium Association for the collection and disposal of solid waste; and

WHEREAS, the Borough and the Stonegate Condominium Association have agreed on formulas for the calculation of reimbursement; and

WHEREAS, the Borough has prepared a reimbursement agreement for the calendar year 2015 for street lighting, leaf removal and snow plowing for the internal roadways in the condominium;

WHEREAS, the Borough has also prepared a reimbursement agreement for the calendar year 2016 for the collection and disposal of solid waste; and

WHEREAS, said reimbursement agreements have been offered to the Stonegate Condominium Association and have been signed by the Association and returned to the Borough;

NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope that the Mayor and Clerk be and the same are hereby authorized to execute a reimbursement agreement with the Stonegate Condominium Association for street lighting, leaf removal and snow plowing for the internal roadways in the condominium for the calendar year 2015; and

BE IT FURTHER RESOLVED by the Mayor and Council of the Borough of Stanhope that the Mayor and Clerk be and the same are hereby authorized to execute a reimbursement agreement with the Stonegate Condominium Association for the calendar year 2016 for collection and disposal of solid waste.

On motion by Councilwoman Thistleton, seconded by Councilwoman Kuncken and unanimously carried by the following roll call vote, the foregoing resolution was duly adopted.

Resolution 123-16
RESOLUTION AUTHORIZING PUBLIC BIDDING FOR MAIN STREET
PEDESTRIAN CROSSWALKS RECONSTRUCTION

WHEREAS, the Borough of Stanhope has determined to undertake the reconstruction of Pedestrian Crosswalks on Main Street; and

WHEREAS, the scope and extent of the work requires that the work be publically bid pursuant to the Local Public Contracts Law; and

WHEREAS, the Borough Engineer has prepared bid plans and specifications for bidding pursuant to the Local Public Contracts Law for the proposed work; and

WHEREAS, the Governing Body wishes to proceed with the proposed reconstruction of Pedestrian Crosswalks on Main Street as designed by the Borough Engineer;

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stanhope that the Borough shall publically bid for the reconstruction of Pedestrian Crosswalks on Main Street with bids to be received on a date to be determined by the Borough.

On motion by Councilman Thornton, seconded by Councilman Depew and unanimously carried by the following roll call vote, the foregoing resolution was duly adopted.

Resolution 124-16
RESOLUTION AUTHORIZING CONTRACT FOR PORT MORRIS AREA,
SPRING LANE & LAKE STREET PAVEMENT RECLAMATION PROJECT

WHEREAS, the Borough of Stanhope heretofore advertised for the receipt of sealed competitive bids for The Port Morris Area, Spring Lane & Lake Street Pavement Reclamation Project; and

WHEREAS, the Borough accepted sealed, competitive bids on July 19, 2016 for the Port Morris Area, Spring Lane & Lake Street Pavement Reclamation Project; and

WHEREAS, the Borough received one (1) sealed competitive bid from DeSantis Construction, Inc. in the amount of $136,438.70; and

WHEREAS, the Borough Attorney has reviewed the bid for compliance with the Local Public Contracts Law and the Borough’s bidding requirements; and

WHEREAS, DeSantis Construction, Inc. is the lowest responsive, responsible bidder for the Borough’s request for bids on July 19, 2016; and

WHEREAS, the Borough Engineer concurs in the recommendation of the award of a bid to DeSantis Construction, Inc.;

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stanhope that the Borough does hereby award a bid to DeSantis Construction, Inc. in the amount not to exceed $136,438.70 for the Port Morris Area, Spring Lane & Lake Street Pavement Reclamation Project.

BE IT FURTHER RESOLVED that the award of this bid is subject to certification of the availability of funds by the Chief Financial Officer.

RESOLUTION OF THE MAYOR AND COUNCIL OF THE BOROUGH OF
STANHOPE AUTHORIZING PAYMENT OF BILLS

 WHEREAS, the Chief Finance Officer has certified that funds are available in the proper account; and

WHEREAS, the Chief Finance Officer has approved payment upon certification from the Borough Department Heads that the goods and/or services have been rendered to the Borough;

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope that the current bills list, dated July 26, 2016 and on file and available for public inspection in the Office of the Chief Finance Officer and approved by the Chief Finance Officer for payment, be paid.

On motion by Councilwoman Kuncken, seconded by Councilwoman Thistleton and unanimously carried by the following roll call vote the foregoing resolution was duly adopted.

CITIZENS TO BE HEARD
Mayor Maio opened the meeting to the public after advising attendees that there is a five (5) minute time limit for each speaker.

Peggy Spooner, 87 Main Street, asked if the crosswalks in question are the same ones which were installed a few years ago. Mayor Maio stated the crosswalks were installed approximately six years ago and they have a five to six year life span. The crosswalks will be milled and replaced with a new product. Mrs. Spooner asked why the crosswalks can’t be paved over and striped. Mayor Maio stated when Main Street was redone the Governing Body made the decision to begin creating a decorative street scape. Councilwoman Kuncken stated the crosswalks go along with the decorative lighting on Main Street in an effort to create a specific look for the downtown area.

Seeing no one further from the public wishing to speak, Mayor Maio closed the public portion of the meeting.

On a motion by Councilwoman Kuncken, seconded by Councilwoman Thistleton, and unanimously carried by voice vote the meeting was adjourned at 7:52 P.M.
