MAYOR’S STATEMENT AS TO COMPLIANCE WITH P.L. 1975
Adequate Notice of this Meeting has been provided according to the Open Public Meetings Act, Assembly Bill 1030. Notice of this Meeting was included in the Annual Meeting Notice sent to the New Jersey Herald and the Daily Record on January 6, 2016 and was placed on the Official Bulletin Board in the Municipal Building.
In the event the Mayor and Council have not addressed all items on this Agenda by 11:00 PM and they are of the opinion that they cannot complete the Agenda in a reasonable time period, the Mayor and Council may exercise their option to continue this meeting at an agreed to date, time and place within ten (10) days of this meeting. Please turn off all cell phones for the duration of this meeting.

CITIZENS TO BE HEARD
Mayor Maio opened the meeting to the public after advising attendees that there is a five (5) minute time limit for each speaker.
Don Drake, 2 Summit Street, stated there is a resolution on the agenda this evening for the milling and paving of Sagamore Road. Mr. Drake asked if this is due to the complaints received from the residents regarding the cosmetics of the road. Mayor Maio stated this issue has nothing to do with cosmetics; it is the condition of the road with the bubbling of the road surface. Mr. Drake is of the opinion the funds should be used to repair the parking lot area behind the deli on Main Street to enhance the businesses. Councilwoman Kuncken stated the Governing Body is very careful with regard to how funds are spent. Several attempts have been made to correct the situation and nothing has worked. This has not been taken lightly. Mayor Maio stated the Borough Engineer has the parking area on his watch list and it has not reached the point where he is ready to make a recommendation to take action.
Nancy Hoyt, 33 Lawrence Avenue, stated the Council Chambers is very stark and suggested the room be decorated. Mayor Maio stated there just has not been time to address the hanging of artwork. Mayor Maio asked Administrator McNeilly to add this to his to do list. Administrator McNeilly stated it is on the list but it is not at the top of the list. Administrator McNeilly suggested perhaps a committee should be formed to determine the type of artwork desired.
Seeing no one from the public wishing to speak, Mayor Maio closed the public portion of the meeting.

On motion by Councilwoman Thistleton, seconded by Councilwoman Zdichocki and unanimously carried by voice vote, the list of correspondence was accepted and ordered placed on file.
COUNCIL COMMITTEE REPORTS
Public Safety – Councilwomen Kuncken/Thistleton
(Police, Fire, Ambulance, Court & Violations Bureau, Emergency Management)
Councilwoman Kuncken reported for the month of May the Fire Department answered 7 calls, they had 32 ¼ man hours, no mutual aid calls, 3 assists for EMS, 5 drills and 19 special details. The hours totaled 278 ¾.
Councilwoman Kuncken stated the Police Department report consists of various calls for the month. The majority of the calls are motor vehicle stops which totaled 368.
Councilwoman Kuncken stated the May Ambulance Squad report lists 20 calls in Stanhope, 38 in Netcong, for a total of 58 and 3 out of town calls in Hopatcong. The basic life support calls totaled 18 and there were 10 advanced life support calls for a total of 28 patients and 28 trips to the hospital. They travelled 839 miles for a total of 260 hours and 47 minutes of volunteer hours. According to the Ambulance Squad report there was 1 assist from the Stanhope Fire Department.
Finance & Administration – Councilman Romano/Councilwoman Kuncken
Councilman Romano stated no report was submitted for water or taxes this month. The Finance Committee met this past week regarding Municipay which is on the agenda this evening for Council Discussion.
Community Development – Councilwoman Zdichocki/Councilman Thornton
(Zoning, Construction, Code Enforcement, Economic Development, Chamber of Commerce, Downtown Revitalization)
Councilwoman Zdichocki stated the sign ordinance will take affect this Friday. The new Borough sign at the corner of Main Street is full and looks beautiful. No Zoning permit information was available this month,
Municipal Infrastructure – Councilman Thornton/Councilwoman Zdichocki
(Water Distribution, Sewer Collection System, Road Construction & Maintenance, Buildings & Grounds)
Councilman Thornton had no report.
Information Technology – Councilmen Depew/Romano
Councilman Depew stated Administrator McNeilly has been in contact with Curio Electro regarding the website development. Councilman Thornton stated he received an email this afternoon with a link to the test site for the new website.
Councilman Romano stated he had the opportunity to test the new website today and he is pleased with the look and feel of the site. The search engine worked well. Councilman Romano stated he searched for items such as dog licensing, tonight’s agenda and meeting minutes and all the information was available in three clicks. The tax maps are available and downloadable. Councilman Romano stated he would like the email addresses to be active links. The new site is very close to launching and Councilman Romano stated he is pleased with the new site.
Administrator McNeilly stated the email with the test site was sent to the members of the Technology Committee earlier today. Once the committee reviewed the site an additional email was sent out this evening to the Governing Body.
Mayor Maio stated she reviewed the site and her only concern is the format of the agenda and the minutes. There is no format to the documents. Mayor Maio stated she did not have any other issues with the site. Administrator McNeilly stated he will look into the issue. Administrator McNeilly stated Linda Chirip has been reviewing the content in detail which has eliminated a lot of issues. Administrator McNeilly stated he likes that there are multiple ways to ask a question. The designer has stated the biggest challenge with the site has been the Nixle widget. Administrator McNeilly stated he and Ms. Chirip will be able to add a message in bold red lettering across the top of the webpage to advertise an alert. There will be a link to take the viewer to another page for additional information regarding the alert. The site is also ADA compliant which was another requirement reviewed by the Technology Committee.
Administrator McNeilly asked the Governing Body to review the site and provide their feedback. The target for launching the new site is on schedule for the first week of July.
Councilman Romano asked Administrator McNeilly what type of problem has been encountered with the Nixle box. Administrator McNeilly stated the goal was to have the Nixle box in the corner with the message. The box is not size responsive. The Borough’s website will be viewable on a computer, tablet or phone and it will resize automatically. The Nixle widget cannot resize and it will just place itself on top of the other content.
Mayor Maio stated she is of the opinion the issues mentioned should be addressed and the launch should wait until the second week of July. Administrator McNeilly stated Ms. Chirip will receive training as soon as possible.
Boards/Commissions – Councilwoman Thistleton/Councilman Depew
Councilwoman Thistleton stated the Board of Health approved the payment for Animal Control Services for April and May. The backup documentation was not received and that issue is being looked into. Administrator McNeilly stated an email was sent to the Administrator addressing this concern. Administrator McNeilly stated in the future the bill should not be paid unless the backup documentation is received.
Councilwoman Thistleton stated Family Fun Day will be held on July 10th at Musconetcong Park.
Councilwoman Zdichocki stated the Recreation Commission is still accepting applications for summer camp. Mayor Maio asked Councilwoman Zdichocki to find out how many children from Stanhope are registered for camp. Mayor Maio is concerned the figures will be lower this year due to the fact camp is not being held at Stanhope School. Councilwoman Zdichocki stated as of the second sign up day there are 36 weeks of camp scheduled. Children can continue to register throughout the summer as long as they do so one week prior to when they plan to attend.
ADMINISTRATOR’S REPORT
DPW – Administrator McNeilly stated the water connection for Mr. Walker has been prepared and the cost of the connection has been provided. Mr. Walker is responsible for the connection from the curb box and he will have to contact the Plumbing Inspector.
Route 206/Route 183 – Administrator McNeilly stated the resolution has been sent to NJDOT regarding Route 206/Route 183. As of this date, no response has been received.
Sagamore Road – Administrator McNeilly stated Eric Keller, Borough Engineer, has provided the cost estimates for the milling and paving of Sagamore Road from Spencer Street to the cul-de-sac. The CFO has confirmed the funds are available. The resolution is on tonight’s agenda.
Safe Routes to Schools – Administrator McNeilly stated the Stanhope resolution and the Sussex County resolution have been uploaded with the grant packet for the Safe Routes to Schools grant. In addition, the Stanhope School HSA President has provided a letter of support. Councilman Romano asked what the timeline is for a response. Administrator McNeilly stated a response could take a minimum of six months.
2015 Condominium Services – Administrator McNeilly stated he has completed the data collection for the 2015 condominium services. The figures have been forwarded to Mr. Stein, Borough Attorney, for Stonegate and Highpoint. Mr. Stein stated he is in the process of preparing the agreements which will be sent to Stonegate and Highpoint shortly.
Budget 2017 – Administrator McNeilly stated it is time to begin the budget process for 2017. Administrator McNeilly provided the timeline for the budget. This year a resolution for a temporary capital budget will be included on the reorganization agenda. A first reading will be held on January 10th and the second reading will take place on January 24th. The funds will be available on February 28th. This will provide a more favorable bidding cycle for the spring 2017 projects.
Musconetcong Dam Project – Administrator McNeilly received a call from Don DeLuca to follow up on the final agreements for the Musconetcong Dam Project.
Bungalow on Route 206 – Administrator McNeilly stated the issue with the house on Route 206 has been handed over to Mr. Stein, Borough Attorney, and Thomas Pershouse, Construction Official, to begin the demolition process. Mayor Maio asked Mr. Stein how long the process will take. Mr. Stein stated a title search must be done to determine who has an interest in the property. A complaint must be prepared to set a hearing within 30 days of the complaint. This must be signed by the Construction Official, it is then recorded with the County, it must be published and it has to be served to those who have an interest. The public hearing will be held and depending on the outcome of the hearing, time will be provided for repair or demolition. If no action is taken by the end of the allotted time, the Borough can go out to bid to hire a contractor to demolish the house and take it away.
Musconetcong Watershed – Administrator McNeilly stated he was contacted by the Musconetcong Watershed Ambassador and informed that the annual water chestnut pull will be held on July 16th. Administrator McNeilly stated the information will be posted.
Drought Conditions – Administrator McNeilly stated at the MSA meeting last week discussion took place regarding drought conditions which are starting to appear. The river is low and there is a tug of war going on with Lake Hopatcong because they want to hold back the water. This affects our lake and the river. The MSA needs to draw water and so does Hackettstown. Fortunately, the river temperature has to be maintained for the fish which does benefit our situation.
Mayor Maio stated Fish, Game & Wildlife representatives have been attending the past few Lake Board meetings and they are adamant that the flow is going to be maintained. This is an ongoing issue between Fish, Game & Wildlife and the DEP.
Administrator McNeilly stated he spoke with Jason Titsworth, DPW Supervisor, today and the Borough well pumps are in excellent shape. At this time even if the pumps are shut off, the water is still coming up. We are not over pumping and residents are conserving nicely. If there are any breaks they are minor and the DPW is staying on top of any issues. Administrator McNeilly stated he has noticed some of the surrounding towns, which are surface water towns, have already put restrictions in place. The Borough’s system is in good shape.
Councilman Romano asked if there are a minimum number of gallons which have come out of Lake Hopatcong. Administrator McNeilly stated it is measured in feet. Mr. Stein stated there is a specific amount of cubic feet per second required by the DEP. Administrator McNeilly stated 12 is needed for our purposes downstream but they can go to 8 ½. Anything less requires a great deal of supervision. Mayor Maio stated Fish, Game & Wildlife is holding them to 12 unless there is an extreme event.
Domestic Violence Program – Councilwoman Zdichocki stated at the conclusion of 2015 a representative gave a presentation regarding domestic violence. At the April 12th meeting a discussion took place regarding the standard operating procedures (SOP). An SOP was provided for the April 26th meeting. Another discussion was held and another SOP was provided, which was exactly the same as the first one. On June 28th pamphlets and additional information were given to the Police Chief but to date no response has been received. The changes were submitted to the Police Chief on April 27th and the forms were provided to him on May 2nd. Councilwoman Zdichocki stated it is almost July and we are no further along than we were in 2015.
Mayor Maio stated the Police Chief has informed the Governing Body that the SOP will not be released until the changes from the State are provided.
Administrator McNeilly stated there was a Public Safety meeting in May. The Police Chief stated at that time he was waiting for information from the Prosecutor’s Office. Councilwoman Zdichocki asked Administrator McNeilly to obtain the current status for the project.
COUNCIL DISCUSSION
Zone Change: Village Business District – Mayor Maio stated, as a result of the Master Plan Re-examination, it has been recommended to extend the commercial zone in the Village Business District straight through to the other end of Route 183. Mayor Maio stated the Land Use Board is of the opinion this change will be good for future growth as homes turn over on Main Street. Extending this as a mixed use business district/commercial will be to the Borough’s advantage. The ordinance is on the agenda tonight for introduction. Mayor Maio asked the Governing Body if there were any questions. The Governing Body had no issues with the change in zone.
NJLM Conference – Mayor Maio stated information has been provided regarding reservations for the NJLM Conference. In the past, the majority of the Governing Body and the staff have stayed at the Tropicana, mainly because this was the least expense choice of all the hotels. Mayor Maio is of the opinion the Borough should designate the Tropicana as the choice hotel and if anyone chooses to stay elsewhere they will be responsible for covering the cost difference on their own.
Councilwoman Kuncken stated if someone is more comfortable staying elsewhere that is their choice but the rate set by the Tropicana should be the standard rate for the Borough. Councilwoman Zdichocki stated last year the room she had was unacceptable. Councilwoman Zdichocki stated she has stayed at the Tropicana many times but in her opinion the hotel has gone downhill. Councilwoman Zdichocki stated she would agree to have a specific dollar amount set to be covered by the Borough with the option to stay elsewhere and cover the difference individually. Councilwoman Thistleton stated she spoke with a representative from the Tropicana recently and the North Tower has been renovated and the South Tower is also being renovated. Mayor Maio stated the Borough owes it to the taxpayers to make the reservation at the hotel which is most cost effective. Councilwoman Kuncken stated as a reminder the Borough pays for two nights. If anyone chooses to extend their stay, those charges must be reimbursed to the Borough Clerk. Mayor Maio asked for a consensus on her recommendation. The Governing Body agreed to set a standard rate.
Mayor Maio suggested the Governing Body members speak with the Borough Clerk to determine whose hotel expenses are covered this year. Councilwoman Zdichocki stated in her opinion all the Governing Body members costs should be covered.
Municipay – Councilman Romano stated a meeting was held with Dana Mooney, CFO, regarding Municipay and Mr. Stein’s recommendations have been taken into consideration. Councilman Romano stated this is not a perfect situation. There are problems which concern Mr. Stein. Some of the issues have been alleviated, but not all of them. A list of the other municipalities who are using Municipay has been reviewed. There are still some parts of the agreement where we want the language and responsibility to be consistent all the way through. Councilman Romano stated this is not perfect but it is a service for our constituents. Councilman Romano stated in his experience with these types of agreements they are always written in favor of the banks.
Mr. Stein stated the agreements are written as if the municipality is a merchant. The financing company recently used for the police vehicles actually had documents specifically written for a government customer. Mr. Stein stated Ms. Mooney has emailed Municipay with the last few items to be addressed. No reply has been received to date. Mayor Maio stated she would like to have all the answers by the next scheduled meeting in order for the Governing Body to make a decision regarding the use of the service.
NJLM Conference – Councilwoman Zdichocki suggested, due to the fact the Governing Body did not use the funds budgeted to attend the Sussex County League of Municipalities meetings this year, she would like those funds to be used toward covering some of the costs for the NJLM Conference.
On motion by Councilwoman Zdichocki, and seconded by Councilman Romano, a motion was made to utilize unused funds which were budgeted for the SCLM meetings to cover the costs for other Governing Body members to attend the NJLM Conference.
Councilwoman Kuncken stated she is of the opinion that is how the situation became confused in the past. The end result of that situation led the Governing Body to make the decision to have the costs covered for the Mayor and three Governing Body members. Councilwoman Zdichocki stated in the past the unused funds have been used for the NJLM. Councilman Romano stated he is of the opinion that Councilwoman Zdichocki is correct with how the funds were used in the past. Ellen Horak, Borough Clerk, stated the extra funds, if utilized, would have to be divided up among all those attending. Mayor Maio stated at this time we do not know the amount of funds available. Councilwoman Kuncken suggested the motion be tabled to provide time to determine what funds are available. Mayor Maio asked the Borough Clerk to add this topic for discussion on the next scheduled meeting and to provide the availability of funds as soon as possible.

AN ORDINANCE OF THE BOROUGH OF STANHOPE, SUSSEX COUNTY,
NEW JERSEY AMENDING CODE SECTION 57-7 REGARDING
AFFORDABLE HOUSING DEVELOPMENT FEES
BE IT ORDAINED by the Mayor and Council of the Borough of Stanhope, Sussex County, New Jersey, as follows:
SECTION 1.
Section 57-7 “Eligible Extraction, Ineligible Extraction and Exemptions” is hereby amended by the addition of a new subsection D to read as follows:
D. Owner occupied residential structures demolished and replaced as a result of a fire, flood or natural disaster shall be exempt from paying a development fee.
SECTION 2. This Ordinance shall take effect upon passage and publication as required by law.
On motion by Councilwoman Kuncken, seconded by Councilwoman Thistleton, and unanimously carried by the following roll call vote, the foregoing ordinance was adopted.

Ordinance 2016-06
AN ORDINANCE OF THE BOROUGH OF STANHOPE, SUSSEX COUNTY,
NEW JERSEY AMENDING CHAPTER 100 OF THE CODE OF THE
BOROUGH OF STANHOPE ENTITLED “LAND DEVELOPMENT”
BY EXPANDING THE VILLAGE BUSINESS ZONE
WHEREAS, the Borough of Stanhope Land Use Board heretofore undertook a Master Plan Re-Examination pursuant to the provisions of N.J.S.A. 40:55D-89; and
WHEREAS, the Governing Body of the Borough of Stanhope has accepted the findings, conclusions and recommendations of the Master Plan Re-Examination Report; and
WHEREAS, said Master Plan Re-Examination Report recommended the expansion of the Village Business zone;
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Stanhope as follows:
SECTION 1. The following properties are hereby re-zoned from the Historic Village Residential (HVR) zone to the Village Business (VB) zone:
- Block 11206, Lots 1 through 5
- Block 11303, Lots 1 and 2
- Block 11302, Lots 1 through 8
- Block 11304, lots 18 through 31
SECTION 2. The Borough Zoning Map established in Section 100-51 “District Boundaries Established” of the Land Development Ordinance of the Borough of Stanhope is hereby revised to incorporate the property zone changes set forth in Section 1 of this Ordinance.

Ordinance 2016-07

NEW JERSEY AMENDING CHAPTER 44 OF THE CODE OF THE
BOROUGH OF STANHOPE ENTITLED “BOARD OF RECREATION
COMMISSIONERS” TO REQUIRE BACKGROUND INVESTIGATIONS
OF RECREATION COMMISSION MEMBERS AND VOLUNTEERS
BE IT ORDAINED by the Mayor and Council of the Borough of Stanhope as follows:
SECTION 1.
Chapter 44 of the Code of the Borough of Stanhope entitled “Board of Recreation Commissioners” is hereby amended by the addition of a new subsection 44-6 to be entitled “Background Investigations” to read as follows:
44-6. Background Investigations. All Recreation Commission members, applicants to become Recreation Commission members, Recreation Commission volunteers and applicants to become Recreation Commission volunteers shall be required to submit to a background investigation conducted by the Borough of Stanhope. All initial investigations shall include such information as shall be required to conduct the investigation. The results of the background investigations shall be provided to the Borough Clerk for any further action that may be required. The cost of the background investigation shall be paid by the Borough.
SECTION 2. This Ordinance shall take effect upon passage and publication as required by law.
On motion by Councilman Depew, seconded by Councilwoman Kuncken, and carried by a majority roll call vote, the foregoing ordinance was introduced.

Ordinance 2016-08
CAPITAL ORDINANCE APPROPRIATING $8,659.77 FOR MILLING
AND PAVING OF VARIOUS ROADS AUTHORIZED TO BE UNDERTAKEN BY THE BOROUGH OF STANHOPE, IN THE COUNTY OF SUSSEX, NEW JERSEY
BE IT ORDAINED by the Borough Council of the Borough of Stanhope, in the County of Sussex, New Jersey, AS FOLLOWS;
Section 1. The several improvements described in Section 3 of this capital ordinance are hereby respectively authorized as general improvements to be made or acquired by the Borough of Stanhope, New Jersey. For the said several improvements or purposes stated in said Section 3, there are hereby appropriated the respective sums of money therein stated as the appropriations made for said improvements or purposes, said sums being inclusive of all appropriations heretofore made therefore and amounting in the aggregate to $8,659.77, which has heretofore been set aside for the improvement or purpose stated in Section 3 and now available therefore by virtue of provision in a previously adopted budget or budgets of the Borough for capital improvement purposes.
Section 2. For the financing of said improvements or purposes and to meet the part of said $8,659.77 appropriations, the Borough will use $8,659.77 from the General Capital Reserve for Road Improvements, as described in Section 3.
Section 3. The improvements hereby authorized and the several purposes for the allocation of which said obligations are to be spent, the appropriation made for an estimated cost of each such purpose, and the estimated maximum amount of funds to be spent for each such purpose, are respectively as follows:
Milling and Paving of various roads, including
Sagamore Road $ 8,659.77 Reserve for Road Improvements
All the aforestated improvements or purposes where applicable, are in accordance with specifications on file in the office of the Borough Clerk, which specifications are hereby approved.
Section 4. The following additional matters are hereby determined, declared, recited and stated:
(a) The said purposes described in Section 3 of this capital ordinance are capital expenses and are each a property or improvement which the Borough may lawfully acquire or make as a general improvement, and no part of the cost thereof has been or shall be specifically assessed on property specially benefited thereby.
(b) The average period of usefulness of said purposes within the limitations of said Local bond Law and taking into consideration the respective amounts of the said obligations authorized for the several purposes, according to the reasonable life thereof computed by this capital ordinance, is five (5) years.
Section 5. This capital ordinance shall take effect ten (10) days after the publication thereof after final adoption.
On motion by Councilman Thornton, seconded by Councilwoman Kuncken, and unanimously carried by the following roll call vote, the foregoing ordinance was introduced.
Councilwoman Kuncken stated the amount read by Mr. Stein is different than the figure listed on the agenda. The Borough Clerk confirmed the amount of $8,659.77 listed on the ordinance is correct.

Mayor Maio offered the following resolutions which were read by title:
Resolution 111-16
RESOLUTION ACCEPTING MASTER PLAN RE-EXAMINATION REPORT
WHEREAS, the Municipal Land Use Law, N.J.S.A. 40:55D-89 provides that the Governing Body of every municipality shall, at least every ten years, provide for the general re-examination of its Master Plan and development regulations by its Planning Board or Land Use Board; and
WHEREAS, the Land Use Board of the Borough of Stanhope duly undertook a Master Plan Re-Examination Report conducted by the Borough Planner, William H. Hamilton, PP, AICP, LLA of Bowman Consulting; and
WHEREAS, Mr. Hamilton prepared a Master Plan Re-Examination Report dated March 8, 2016; and
WHEREAS, the Land Use Board conducted a public hearing on said Master Plan Re-Examination Report; and
WHEREAS, by resolution adopted April 11, 2016 and memorialized on May 9, 2016, the Land Use Board adopted the Master Plan Re-Examination Report prepared by Bowman Consulting and further served same upon the Mayor and Council of the Borough of Stanhope; and
WHEREAS, the Mayor and Council of the Borough of Stanhope have duly considered the March 8, 2016 Master Plan Re-Examination Report and resolution adopted by the Land Use Board of the Borough of Stanhope; and
WHEREAS, the Governing Body is in agreement with the findings, conclusions and recommendations of the Master Report as referred by the Land Use Board;
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stanhope that the Borough does hereby adopt the Master Plan Re-Examination Report prepared by Bowman Consulting dated March 8, 2016 as recommended by the Stanhope Borough Land Use Board.

RESOLUTION OF THE MAYOR AND COUNCIL OF THE
BOROUGH OF STANHOPE AUTHORIZING THE RENEWAL OF
LIQUOR LICENSES TO LICENSE HOLDERS IN THE BOROUGH
WHEREAS, the liquor license renewal applications submitted are complete in all respects, the renewal fees have been paid, Tax Clearance Certificates received, the licenses have been reviewed, and the premises inspected;
NOW, THEREFORE, BE IT RESOLVED that the statutory requirements thereto having been fulfilled, the applications for renewal of liquor licenses be granted and the Borough Clerk be authorized to complete, sign and deliver said licenses on behalf of the Mayor and Council to the below named applicants, said licenses being renewed for the period July 1, 2016 to June 30, 2017 in the Borough of Stanhope, County of Sussex, New Jersey:

Mayor Maio asked the Borough Clerk which licenses are not being renewed at this time. Ms. Horak, Borough Clerk, stated Sal’s Pizzeria and Ted’s Deli are not included on the resolution. Both establishments will have to obtain an ad-interim by midnight on June 30th. Mayor Maio asked if the owners are aware of this situation. Ms. Horak stated she will send a letter tomorrow. Both owners were aware of today’s deadline. Administrator McNeilly stated Ms. Horak has been very thorough in advising all the license holders of the deadline.

Resolution 113-16
RESOLUTION DESIGNATING SHELBY LOFTIS AS MISS STANHOPE 2016
WHEREAS, the Queen of the Fair Pageant is held each year as part of the New Jersey State Fair; and
WHEREAS, participants in the Queen of the Fair Pageant are usually selected through pageants held in each municipality in Sussex County; and
WHEREAS, the Borough of Stanhope has not conducted a municipal pageant; and
WHEREAS, Shelby Loftis is a resident of the Borough of Stanhope and is otherwise eligible to compete in the Queen of the Fair Pageant; and
WHEREAS, Queen of the Fair Pageant rules allow a municipality that does not conduct a pageant to have the Governing Body designate a young lady as that municipality’s representative to participate in the Queen of the Fair Pageant; and
WHEREAS, Shelby Loftis has made the only request to the Governing Body to be designated as Miss Stanhope 2016 for purposes of entering the Queen of the Fair Pageant;
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stanhope on this 28th day of June, 2016 that the Governing Body does hereby designate Shelby Loftis as Miss Stanhope 2016; and
BE IT FURTHER RESOLVED that the Governing Body wishes Miss Loftis all good luck in representing Stanhope in the 2016 Queen of the Fair Pageant.
Resolution 114-16
RESOLUTION AUTHORIZING USE OF CO-OP PUBLIC BID FOR
SAGAMORE ROAD MILLING AND PAVING PROJECT
WHEREAS, the Borough of Stanhope is in need of roadway milling and paving for the portion of Sagamore Road from Spencer Street through the cul de sac (“Sagamore Road Project”); and
WHEREAS, the Borough is a member of the Morris County Co-Op which has already publically bid milling and paving services for the year 2016 and has awarded a contract therefore; and
WHEREAS, the Borough may utilize the Co-Op bid price as a member of the Co-Op without the need for further public bidding; and
WHEREAS, the Borough Engineer has recommended the use of the Co-Op bid for the Sagamore Road Project;
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stanhope, that the Borough shall utilize the Co-Op awarded bid for milling and paving for 2016 for the Sagamore Road Project at the Co-Op awarded bid price.

RESOLUTION AUTHORIZING REFUND OF PAYMENT OF SUMMER CAMP FEE
WHEREAS, Nicole Harris had presented $1,030.00 to pay for six (6) weeks of Summer Camp, and
WHEREAS, the family is moving out of the area at the end of July and their daughter will not be able to attend the last three (3) weeks of camp; and
WHEREAS, the cost of three (3) weeks of camp is $180.00 each for a total of $540.00;
NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Stanhope, that a warrant be drawn to the homeowner listed below in the designated amount representing a refund of Summer Camp Fees:

WHEREAS, the Chief Finance Officer has certified that funds are available in the proper account; and
WHEREAS, the Chief Finance Officer has approved payment upon certification from the Borough Department Heads that the goods and/or services have been rendered to the Borough;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope that the current bills list, dated June 28, 2016 and on file and available for public inspection in the Office of the Chief Finance Officer and approved by the Chief Finance Officer for payment, be paid.

ATTORNEY REPORT
Mr. Stein stated he has two items to discuss with the Council this evening in Closed Session. One is litigation and one is pending litigation. Mr. Stein stated he will be away for the second meeting in July but he will be attending the first meeting in July.
CITIZENS TO BE HEARD
Mayor Maio opened the meeting to the public after advising attendees that there is a five (5) minute time limit for each speaker.
Seeing no one from the public wishing to speak, Mayor Maio closed the public portion of the meeting.
CLOSED SESSION
WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231 P.L. 1975 permits the exclusion of the public from a meeting in certain circumstances; and
WHEREAS, this public body is of the opinion that such circumstances presently exist.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope, County of Sussex, New Jersey as follows:
1. The public shall be excluded from discussion of and action upon the hereinafter-specified subject matter(s).
2. The general nature of the subject matter(s) to be discussed is as follows:
