CALL TO ORDER

MAYOR’S STATEMENT AS TO COMPLIANCE WITH P.L. 1975

Adequate Notice of this Meeting has been provided according to the Open Public Meetings Act, Assembly Bill 1030. Notice of this Meeting was included in the Annual Meeting Notice sent to the New Jersey Herald and the Daily Record on January 8, 2020 and was placed on the Official Bulletin Board in the Municipal Building.

Furthermore, notice of the change in the meeting to an electronic meeting via Zoom was sent to the New Jersey Herald and Daily Record on May 1, 2020 and was placed on the official website of the Borough of Stanhope.

In the event the Mayor and Council have not addressed all items on this Agenda by 10:00 PM and they are of the opinion that they cannot complete the Agenda in a reasonable time period, the Mayor and Council may exercise their option to continue this meeting at an agreed to date, time and place. Please turn off all cell phones for the duration of this Meeting.

Mayor Zdichocki read aloud the list of minutes being presented for approval.

On motion by Councilman Wronko, seconded by Councilman Romano and unanimously carried by voice vote, the above listed minutes were approved.

ADMINISTRATOR’S REPORT

Elected Official’s Training – Administrator McNeilly stated the Elected Official’s Training scheduled for this evening has been cancelled. A one month extension has been granted by the underwriter and JIF. Administrator McNeilly will work with Wayne Dietz to reschedule the training. The meeting may take place via Zoom.

Hydrant Flushing – Administrator McNeilly stated the hydrant flushing was completed as of last night. The next hydrant flushing will take place in the Fall.

Leaf/Brush Pickup – Administrator McNeilly stated the leaf and brush pickup has been extended for another week due to manpower issues caused by the split shift schedule. Pickup will be completed by this Friday.

Webinars– Administrator McNeilly stated he has been attending numerous webinars regarding finances and the most recent topic of returning to work, as well as continuing operations.

Finance – Administrator McNeilly stated the Bond Anticipation Notes (BANS) were due and request for proposals were sent out. The street quote was 2.49% which was higher than usual. The Municipal Excess Liability Fund, which our JIF is a part of, put together a framework and received approval for the Joint Cash Management Investment Program (JCMI) to bid and they acquired Stanhope’s BANS at a rate of 1.900%. This is our own Joint Insurance Funds money being used to help out our own municipalities. In the case of the Morris County Joint Insurance Fund, the bylaws state this arrangement is only available to members of the Joint Insurance Fund. This is a cash savings for the Borough.

COMMITTEE REPORTS

Finance & Administration – Councilman Romano/Councilwoman Kuncken

Councilman Romano stated he has three months of reports and read the figures for April. For the month of April the month to date taxes collected total $810,704.77. We have collected 96.899% for the 1st quarter and 28.189% for the 2nd quarter.

Administrator McNeilly stated that he spoke with the CFO and cash management is important. The first quarter tax collection is at 97.07% which is excellent. The second quarter, as of today, is 87.16%. Today would have been the end of the grace period if it had not been extended to June 1st. Last year the rate was 89.72%. The collections are in the ballpark and by June 1st the figures should hit the 2019 rate. The big question now will be how the third and fourth quarter will do. The overall tax collection rate as it stands today is 92.15% to date. The next fiscal health of the community will come with the water/sewer bills which will be mailed out on May 29th. June will tell us where we are with money coming in. The water/sewer bills have a one month grace period and therefore no action has to be taken for an extension. One of the things which will help the Borough is the fact that the governing body put together a very fiscally tight budget year after year. The departments respond accordingly but we will have to drill down tighter on money going out and keep a close eye to make sure we have just what we need and watch expenses to help out as much as possible. The departments are ready to help.

Mayor Zdichocki stated she had a discussion with the Finance Committee and another meeting should be held to review the situation and tighten things down as much as possible.

Public Safety – Councilwoman Kuncken/CouncilmanThornton

(Police, Fire, Ambulance, Court & Violations Bureau, Emergency Management)

Councilwoman Kuncken stated the Police Department reported 226 calls for the month of March and 111 for the month of April.

Councilwoman Kuncken stated the Fire Department reported for the month of February that they had 4 calls, 1 mutual aid, 3 drills and 1 meeting.

Councilwoman Kuncken stated the Sussex County Fire Marshal had no inspections for the month of April due to the virus. They ceased doing inspections mid-March.

Councilwoman Kuncken stated the Ambulance Squad for the month of February had 65calls; 28 in Stanhope and 40 in Netcong. For the month of March there were 45 calls; 17 in Stanhope, 28 in Netcong, and 1 out of town call in Hopatcong.

Community Development – Councilman Wronko/Councilman Riccardi

Councilman Wronko had no report.

Municipal Infrastructure – Councilman Thornton/Councilman Wronko

(Water Distribution, Sewer Collection System, Road Construction & Maintenance, Buildings & Grounds)

Information Technology – Councilman Riccardi/Councilman Cipollini

Councilman Riccardi had no report.

Boards/Commissions – Councilman Cipollini/Councilman Romano

ENGINEER’S REPORT

Eric Keller, Borough Engineer, stated he sent Administrator McNeilly and the Borough Clerk a report today. Administrator McNeilly stated the report has not been forwarded to the Mayor and Council as yet. Mr. Keller stated there are five projects planned and budgeted. Two projects are carryovers from last year. They are the speed humps on Musconetcong Avenue and Young Drive. These projects required a QPA and public bids. Dell Road has multiple parts including, ADA ramps which will go through the QPA process. There is also milling, restriping, resurfacing which will be done through the Morris County C-op. Mr. Keller stated Tilcon is in the co-op and he is waiting for their schedule. When that is complete the speed humps will be reinstalled on Dell Road. The other resurfacing project through the co-op is Roberts Place, Lakeview Terrace and Central Avenue and they are ready to go. Authorization for the public bid for the water system on Brooklyn Road and Baker Place is on the agenda tonight. The balance of the paperwork will be ready soon. Mr. Keller stated he has worked with Administrator McNeilly and Borough Attorney, Ursula Le on the form of the notice to bidders. Typically, the contractors would drop the bids off at Borough Hall. However, we are not permitting that because Borough Hall is currently closed so a different procedure will be used for this bid. The actual bid opening will take place outside or virtually.

Mr. Keller stated the other project that will go to public bid is also on the agenda tonight and that is for the pavement reclamation and resurfacing for Highland Avenue, Baker Avenue and North Central Avenue. This cannot go out to bid until the water system work is completed. Mr. Keller stated the Baker Place work overlaps. The water main has to be replaced before the pavement work can be done.

Mr. Keller stated the last item on the agenda is the Sparta Road milling and resurfacing project which was awarded through the co-op in 2019. This has to be redone with the 2020 pricing due to the fact that the NJDOT continues to send review letters. Councilwoman Kuncken asked if the pricing will be better or worse. Mr. Keller stated the quantities have decreased but the cost of asphalt and milling has increased and it is still less than the Local Aid budget. Councilman Riccardi asked if there is any reason why the bid opening cannot be held virtually. Administrator McNeilly stated the bid notice will call out all the specifics. Attorney Leo has provided a template. Administrator McNeilly stated he is of the opinion that the bid opening will take place virtually.

Mayor Zdichocki stated the school has offered to let the Borough use the school to meet in one of the large meeting rooms or auditorium with ten people or less. Mayor Zdichocki asked if there is anything holding back the process and asked Brian for the dates. Mr. Keller stated the notice will be ready for publication early next week. Councilwoman Kuncken stated that bid openings are permitted to be held outside. Administrator McNeilly stated that works best if there is a portico or canopy like structure like what was done in Sandyston. Administrator McNeilly stated he will work on this. It is possible to use the canopy from Stanhope Day and have that placed on the lawn in front of the building.

WORK SESSION

Councilwoman Kuncken stated estimated tax bills will have to be generated. Administrator McNeilly stated this can be discussed later in the meeting when the resolution is brought up for consideration.

Mayor Zdichocki stated she would like to make it clear that Borough Hall is not closed and we are operating. The public is not allowed to enter at this time but the employees and the governing body are working every day. We have not stopped at all. The office personnel are working very hard to continue on.

SECTION 2. Salaries and wages for all Borough employees and officials shall be paid in bi-weekly installments as nearly equal as possible.

SECTION 3. Unless otherwise provided herein, remuneration for all employees shall be retroactive to January 1st of each year.

SECTION 4. The salaries and wages herein established shall be in lieu of any and all fees to which the respective incumbents of said offices might otherwise be entitled by statute or ordinance; which fees shall immediately upon collection therof be paid over to the Treasurer for use of the Borough except as otherwise provided herein.

SECTION 5. The Borough shall pay medical insurance premiums in accordance with State law, collective bargaining agreements and the Borough’s elected participation in any State health benefit program for all eligible employees and their eligible dependents.

SECTION 6. The terms and conditions of all collective bargaining agreements negotiated between the Borough and any bargaining unit representing Borough employees are hereby incorporated into this Ordinance.

SECTION 7. All Ordinances and Resolutions, or parts thereof, inconsistent herewith are hereby repealed.

SECTION 8. This Ordinance shall become effective immediately upon final adoption and publication as required by law.

On motion by Councilwoman Kuncken, seconded by Councilman Romano and unanimously carried by the following roll call vote, the foregoing ordinance was adopted.

Mayor Zdichocki opened the meeting to the public for questions or comments on this ordinance only. Seeing no one from the public wishing to speak, Mayor Zdichocki closed the public portion of the meeting.

NEW BUSINESS

RESOLUTIONS

Mayor Zdichocki offered the following resolutions which were read by title.

Resolution 090-20 RESOLUTION AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $4,115,302 BOND ANTICIPATION NOTES OF THE BOROUGH OF STANHOPE, IN THE COUNTY OF SUSSEX, NEW JERSEY.

BE IT RESOLVED BY THE BOROUGH COUNCIL OF THE BOROUGH OF STANHOPE, IN THE COUNTY OF SUSSEX, NEW JERSEY, AS FOLLOWS:

Section 1. Pursuant to a bond ordinance of the Borough of Stanhope, in the County of Sussex (the “Borough”), entitled: “Bond ordinance providing for the improvement of the water supply and distribution system (Sparta Road – Phase II) in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $120,000 therefor and authorizing the issuance of $120,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on May 22, 2012 (#2012-10), bond anticipation notes of the Borough in a principal amount not exceeding $28,100 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 2. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional vehicular equipment for use by the water utility of the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $60,000 therefor and authorizing the issuance of $60,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on June 26, 2012 (#2012-14), bond anticipation notes of the Borough in a principal amount not exceeding $14,150 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 3. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $359,000, and authorizing the issuance of $341,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on June 26, 2012 (#2012-15), bond anticipation notes of the Borough in a principal amount not exceeding $132,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 4. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $2,300,000 therefor and authorizing the issuance of $2,300,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on November 27, 2012 (#2012-18), bond anticipation notes of the Borough in a principal amount not exceeding $20,900 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 5. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional equipment for use by the water utility of the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $140,000 therefor and authorizing the issuance of $140,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on July 9, 2013 (#2013-11), bond anticipation notes of the Borough in a principal amount not exceeding $59,200 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 6. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $91,000, and authorizing the issuance of $86,450 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on July 9, 2013 (#2013-12), bond anticipation notes of the Borough in a principal amount not exceeding $41,550 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 7. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system (Maple Terrace/Mountain Terrace) in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $104,000 therefor and authorizing the issuance of $104,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on April 8, 2014 (#2014-07), bond anticipation notes of the Borough in a principal amount not exceeding $38,977 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 8. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of Maple Terrace/Mountain Terrace in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $245,000 therefor and authorizing the issuance of $233,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on April 8, 2014 (#2014-08), bond anticipation notes of the Borough in a principal amount not exceeding $127,441.20 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 9. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system (James Street) in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $256,000 therefor and authorizing the issuance of $256,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on June 24, 2014 (#2014-11), bond anticipation notes of the Borough in a principal amount not exceeding $180,516 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 10. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of James Street in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $392,000 therefor and authorizing the issuance of $133,300 bonds or notes of the Borough for financing such appropriation”, finally adopted on June 24, 2014 (#2014-12), bond anticipation notes of the Borough in a principal amount not exceeding $72,993.91 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 11. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $465,000, and authorizing the issuance of $191,955 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on August 12, 2014 (#2014 13) bond anticipation notes of the Borough in a principal amount not exceeding $116,215 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 12. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $35,000, and authorizing the issuance of $35,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on August 12, 2014 (#2014 14) bond anticipation notes of the Borough in a principal amount not exceeding $27,600 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 13. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $114,002.59 therefor and authorizing the issuance of $38,100 bonds or notes of the Borough for financing such appropriation”, finally adopted on August 26, 2014 (#2014 18) bond anticipation notes of the Borough in a principal amount not exceeding $30,700 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 14. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $271,750, and authorizing the issuance of $258,150 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on April 28, 2015 (#2015 10) bond anticipation notes of the Borough in a principal amount not exceeding $160,448.33 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 15. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $128,000, and authorizing the issuance of $128,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on April 28, 2015 (#2015 08) bond anticipation notes of the Borough in a principal amount not exceeding $113,500 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 16. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of various roads in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $120,000 therefor and authorizing the issuance of $114,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on July 28, 2015 (#2015-14), bond anticipation notes of the Borough in a principal amount not exceeding $79,795.56 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 17. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $338,034, and authorizing the issuance of $305,200 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on April 26, 2016 (#2016-04), bond anticipation notes of the Borough in a principal amount not exceeding $242,069 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 18. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $170,000 and authorizing the issuance of $161,500 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on May 9, 2017 (#2017-03), bond anticipation notes of the Borough in a principal amount not exceeding $134,666 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 19. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of Sparta Road and various trails in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $1,905,000 therefor and authorizing the issuance of $90,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on March 27, 2018 (#2018-03), bond anticipation notes of the Borough in a principal amount not exceeding $75,555 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 20. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $1,622,850, and authorizing the issuance of $1,328,740 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on May 8, 2018 (#2018-09), bond anticipation notes of the Borough in a principal amount not exceeding $1,274,650 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 21. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $688,525, and authorizing the issuance of $658,525 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the sanitary sewerage system of the Borough”, finally adopted on May 8, 2018 (#2018-10), bond anticipation notes of the Borough in a principal amount not exceeding $592,325 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 22. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $54,850, and authorizing the issuance of $54,850 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on May 8, 2018 (#2018-11), bond anticipation notes of the Borough in a principal amount not exceeding $50,850 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 23. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $431,800, and authorizing the issuance of $409,900 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on February 19, 2019 (#2019-01), bond anticipation notes of the Borough in a principal amount not exceeding $389,900 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 24. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $82,000, and authorizing the issuance of $82,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on February 19, 2019 (#2019-02), bond anticipation notes of the Borough in a principal amount not exceeding $77,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 25. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $38,000, and authorizing the issuance of $38,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the sanitary sewerage system of the Borough”, finally adopted on February 19, 2019 (#2019-03), bond anticipation notes of the Borough in a principal amount not exceeding $34,200 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 26. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional vehicular equipment for use by the sewer utility of the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $28,400 therefor and authorizing the issuance of $28,400 bonds or notes of the Borough for financing such appropriation”, finally adopted on January 28, 2020 (#2020-01), bond anticipation notes of the Borough in a principal amount not exceeding $28,400 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 27. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $461,300, and authorizing the issuance of $334,625 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on January 28, 2020 (#2020-02), bond anticipation notes of the Borough in a principal amount not exceeding $334,625 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 28. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $236,400 and authorizing the issuance of $236,400 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on January 28, 2020 (#2020-03), bond anticipation notes of the Borough in a principal amount not exceeding $236,400 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Section 29. All bond anticipation notes (the “notes”) issued hereunder shall mature at such times as may be determined by the treasurer, the chief financial officer or the acting chief financial officer of the Borough (the “Chief Financial Officer”), provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the Chief Financial Officer and shall be signed and sealed by officials and officers of the Borough in any manner permitted by N.J.S.A. §40A:2-25. The Chief Financial Officer shall determine all matters in connection with the notes issued hereunder, and the Chief Financial Officer’s signature upon the notes shall be conclusive evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. §40A:2-8. The Chief Financial Officer is hereby authorized to sell part or all of the notes at not less than par from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price. The Chief Financial Officer is directed to report in writing to the governing body of the Borough at the meeting next succeeding the date when any sale or delivery of the notes hereunder is made. Such report must include the principal amount, interest rate and maturities of the notes sold, the price obtained and the name of the purchaser.

Section 30. Any note issued pursuant to this resolution shall be a general obligation of the Borough, and the Borough’s faith and credit are hereby pledged to the punctual payment of the principal of and interest on the notes and, unless otherwise paid or payment provided for, an amount sufficient for such payment shall be inserted in the budget and a tax sufficient to provide for the payment thereof shall be levied and collected.

Section 31. The Chief Financial Officer is hereby authorized and directed to do all other matters necessary, useful, convenient or desirable to accomplish the delivery of the notes to the purchasers thereof as promptly as possible, including (i) the preparation, execution and dissemination of a Preliminary Official Statement and Final Official Statement with respect to the notes, (ii) preparation, distribution and publication, if necessary, of a Notice of Sale with respect to the notes, (iii) execution of a Continuing Disclosure Undertaking, with respect to the notes in accordance with Rule 15c2 12 promulgated by the Securities and Exchange Commission and (iv) execution of an arbitrage and use of proceeds certificate certifying that, among other things, the Borough, to the extent it is empowered and allowed under applicable law, will do and perform all acts and things necessary or desirable to assure that interest paid on the notes is not included in gross income under Section 103 of the Internal Revenue Code of 1986, as amended.

Section 32. All action heretofore taken by Borough officials and professionals with regard to the sale and award of the notes is hereby ratified, confirmed, adopted and approved.

Section 33. This resolution shall take effect immediately.

Resolution 091-20 RESOLUTION ATTESTING THAT THE STANHOPE GOVERNING BODY HAS COMPLIED WITH THE PROMULGATION OF THE LOCAL FINANCE BOARD OF THE STATE OF NEW JERSEY RELATIVE TO THE 2019 ANNUAL REPORT OF AUDIT

WHEREAS, N.J.S.A. 40A: 5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions, and

WHEREAS, the Annual Report of Audit for the year 2019 has been filed by a Registered Municipal Accountant with the Borough Clerk pursuant to N.J.S.A. 40A: 5-6, and a copy has been received by each member of the governing body; and

WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs; and

WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the governing body of each municipality shall, by resolution, certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled “Comments and Recommendations; and

WHEREAS, the members of the governing body have personally reviewed, as a minimum, the Annual Report of Audit, and specifically the sections of the Annual Audit entitled “Comments and Recommendations,” as evidenced by the group affidavit form of the governing body attached hereto; and

WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the annual audit, pursuant to N.J.A.C. 5:30-6.5; and

WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board; and

WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52, to wit:

R.S. 52:27BB-52: A local officer or member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fined not more than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office.

NOW, THEREFORE BE IT RESOLVED, that the Mayor and Council of the Borough of Stanhope, hereby states that it has complied with N.J.A.C. 5:30-6.5 and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance.

Resolution 093-20 RESOLUTION AUTHORIZING THE TAX COLLECTOR TO ISSUE ESTIMATED 3RD QUARTER TAX BILLS

WHEREAS, in light of the disruption caused by the coronavirus outbreak, the State delayed the adoption of the State Fiscal Year 2021 Budget to September 30, 2020; and

WHEREAS, THE Division of Local Government Services (DLGS) cannot certify State Aid allocations to municipal budgets until State Aid Appropriations are known; and

WHEREAS, although the Borough of Stanhope 2020 Municipal Budget has been adopted, the DLGS cannot approve municipal budgets and the Sussex County Board of Taxation cannot certify the 2020 Tax rates until long after the June 30, 2020 deadline to process third quarter tax bills due August 1, 2020; and

WHEREAS, without a 2020 Certified Tax Rate, the Tax Collector cannot process the final 2020 Tax Levy and will be unable to mail the 2020 tax bills on a timely basis; and

WHEREAS, the DLGS “strongly recommends” under Local Finance Notice 2020-07 “that municipalities prepare to issue estimated property tax bills for 2020:” and

WHEREAS, N.J.S.A. 54:4-66.3 allows the Tax Collector in consultation with the Chief Financial Officer to compute and certify an estimated tax levy, summarizing the tax levies for the previous year, the tax rates and estimated tax levies for the 2020 calendar year;

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope as follows:

  1. The Tax Collector is hereby authorized and directed to prepare and issue estimated tax bills for the Third (3rd) installment of 2020 taxes. The Tax Collector shall proceed and take such actions as permitted and required by N.J.S.A. 54:4-66.2 and 54:4-66.3.
  2. The estimated calendar year tax levy for 2020 is hereby calculated at $12,465,268.32
  3. This amount is less than 105% of the 2019 calendar year tax levy.
  4. In accordance with New Jersey Statutes, the third quarterly installment of 2020 taxes shall not be subject to interest until the later of August 10, 2020 or the Twenty-fifth (25) calendar day after the date the estimated tax bills were mailed. The estimated tax bills shall contain a notice specifying the date on which interest may begin to accrue.

On motion by Councilwoman Kuncken, seconded by Councilman Romano and unanimously carried by the following roll call vote the foregoing resolution was duly adopted.

Administrator McNeilly asked if the governing body had any questions. Councilwoman Kuncken asked Administrator McNeilly to hold up a chart. Administrator McNeilly displayed the chart and stated there are three settled budgets which are Stanhope Borough’s and both of the schools. The County budget is not set and there is no clear answer on State aid, which will not be determined until September 30th. The CFO ordered the forms to be used for the estimated tax bills on March 1st. The governing body has to determine the estimated tax rate to be used. The rate can be 5% less than in 2019 or 5% more than 2019. Administrator McNeilly stated the CFO did a very good job of pulling all of this together and she has reached out to the County CFO and has a recommendation. The Borough Auditor has been contacted as well. The CFO recommends 1.92%. If the 3rd quarter is too low, it moves all of the balance to the 4th quarter. The goal is to split the cost as evenly as possible. Administrator McNeilly stated he agrees with the CFO’s rate of 1.92%. The average household ($192,100) will have an average tax bill of $8,138.57 for 2019 which is an overall increase of $107.27. Of that amount, $85.13 will be included on the August 1st payment. Councilwoman Kuncken stated the Finance Committee, Administrator McNeilly and Ray Sarinelli, Borough Auditor, all agree with the CFO Dana Mooney’s recommendation and are comfortable with the figure. Mayor Zdichocki stated that the CFO and the Auditor have both done a very good job. This has been thought through and it seems to be the best answer we have right now.

Resolution 094-20 RESOLUTION rE-AUTHORIZING use OF TILCON NEW YORK, INC. & DENVILLE LINE PAINTING, INC. AS SET FORTH IN THE MORRIS COUNTY co-op PUBLIC BIDS FOR SPARTA ROAD milling, paving AND LIMITED STRIPING NJDOT LOCAL AID PROJECT

WHEREAS, the Borough of Stanhope is in need of roadway milling, paving and limited striping for Sparta Road (“Sparta Road Project”);

WHEREAS, the Borough applied for and received a Local Aid Grant from the New Jersey Department of Transportation; and

WHEREAS, the Borough previously awarded these improvements through the Morris County Co-Op per Resolution 102-19; and

WHEREAS, the Borough Engineer’s updated estimate for milling, paving and limited striping on Sparta Road is $192,362.87; and

WHEREAS, the Borough is a member of the Morris County Co-Op which has already publicly bid milling, paving and striping services for the year 2020 and has awarded contracts therefore for the various services needed; and

WHEREAS, the Borough may utilize the Co-Op bid price as a member of the Co-Op without the need for further public bidding; and

WHEREAS, the Borough Engineer has recommended the use of the Co-Op bids for the various construction items for the Sparta Road Local Aid Project; and

WHEREAS, the Borough awards the milling and resurfacing to Tilcon New York, Inc. for District #2 at $3.05 per square yard for milling 0” – 2” in a total amount of $46,887.65; and for HMA 9.5M64 at $74.40 per ton in a total amount of $143,145.60 (see attached bid tabulation); and

WHEREAS, the Borough awards the limited striping to Denville Line Painting, Inc, for traffic striping on roadways, 4” wide using “Epoxy” at $0.30 per linear foot in a total of $2,074.20; and striping, 4” wide, long life thermoplastic at $0.86 per linear foot in a total amount of $255.42 (see attached bid tabulation);

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stanhope, that the Borough shall utilize Tilcon New York, Inc. for milling and paving; and Denville Line Painting, Inc. for striping for the Sparta Road Local Aid Project at the 2020 Morris County Co-Op awarded bid prices and quantities as set forth in the attached bid tabulation.

Resolution 095-20 RESOLUTION OF THE MAYOR AND COUNCIL AUTHORIZING ADVERTISEMENT FOR RECEIPT OF BIDS FOR BROOKLYN ROAD AND BAKER PLACE WATER SYSTEM IMPROVEMENTS

WHEREAS, the Mayor and Council have determined that improvements are necessary to replace and upgrade portions of the water system located in Brooklyn Road and Baker Place; and

WHEREAS, the Borough Engineer has prepared construction documents related to the replacement and upgrade of the water system located in Brooklyn Road and Baker Place;

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope, County of Sussex, State of New Jersey hereby authorize the advertisement for the receipt of bids for the Brooklyn Road and Baker Place Water System Improvements.

Resolution 096-20 RESOLUTION OF THE MAYOR AND COUNCIL AUTHORIZING ADVERTISEMENT FOR RECEIPT OF BIDS FOR THE RECLAMATION AND RESURFACING OF HIGHLAND AVENUE, BAKER PLACE AND NORTH CENTRAL AVENUE

WHEREAS, the Mayor and Council have determined that road reclamation and resurfacing is necessary for Highland Avenue, Baker Place and North Central Avenue; and

WHEREAS, the Borough Engineer has prepared engineering documents related to the reclamation and resurfacing of Highland Avenue, Baker Place and North Central Avenue;

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope, County of Sussex, State of New Jersey hereby authorize the advertisement for the receipt of bids for the reclamation and resurfacing of Highland Avenue, Baker Place and North Central Avenue.

Resolution 097-20 RESOLUTION AUTHORIZING THE DONATION OF FACE MASKS TO THE STANHOPE POLICE DEPARTMENT

WHEREAS, the Stanhope Police Department currently holds an Access Agreement with Ring, LLC, in order to access their Neighbors Portal to share real-time crime and safety alerts for public safety; and

WHEREAS, in response to the COVID-19 outbreak, Ring, LLC has provided 4 small 50-ct boxes of non-medical grade disposal face masks to assist the Stanhope Police Department with its emergency response efforts; and

WHEREAS, N.J.S.A. 40A:5-29 authorizes the Borough to accept gifts such as the donation being made by Ring, LLC.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope that the donation of 4 small 50-ct boxes of non-medical grade disposal face masks from Ring, LLC is hereby accepted.

On motion by Councilman Romano, seconded by Councilman Riccardi and unanimously carried by the following roll call vote, the foregoing resolutions were duly adopted.

PAYMENT OF BILLS

Resolution 098-20 RESOLUTION OF THE MAYOR AND COUNCIL OF THE BOROUGH OF STANHOPE AUTHORIZING PAYMENT OF BILLS

WHEREAS, the Chief Finance Officer has certified that funds are available in the proper account; and

WHEREAS, the Chief Finance Officer has approved payment upon certification from the Borough Department Heads that the goods and/or services have been rendered to the Borough;

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope that the current bills list, dated May 12, 2020 and on file and available for public inspection in the Office of the Chief Finance Officer and approved by the Chief Finance Officer for payment, be paid.

On motion by Councilman Romano, seconded by Councilwoman Kuncken and unanimously carried by the following roll call vote the foregoing resolution was duly adopted.

CITIZEN’S TO BE HEARD

Mayor Zdichocki opened the meeting to the public after advising attendees that there is a five (5) minute time limit for each speaker.

Seeing no one from the public wishing to speak, Mayor Zdichocki closed the public portion of the meeting.

ADJOURNMENT

On motion by Councilwoman Kuncken, seconded by Councilman Cipollini, and unanimously carried by voice vote the meeting was adjourned at 7:35 P.M.
