MAYOR’S STATEMENT AS TO COMPLIANCE WITH P.L. 1975
Adequate Notice of this Meeting has been provided according to the Open Public Meetings Act, Assembly Bill 1030. Notice of this Meeting was included in the Annual Meeting Notice sent to the New Jersey Herald and the Daily Record on January 9, 2019 and was placed on the Official Bulletin Board in the Municipal Building.
In the event the Mayor and Council have not addressed all items on this Agenda by 10:00 PM and they are of the opinion that they cannot complete the Agenda in a reasonable time period, the Mayor and Council may exercise their option to continue this meeting at an agreed to date, time and place. Please turn off all cell phones for the duration of this meeting.
Mayor Maio stated the Borough had another fatality and loss of life of a two-year old boy. Mayor Maio asked all present to join her in a moment of silence in memory of Max Ramirez.

CITIZENS TO BE HEARD
Mayor Maio opened the meeting to the public after advising attendees there is a five (5) minute time limit for each speaker.
Carmen Pico, 25 New Street, spoke about a letter he recently received indicating he cannot park his car within 25 feet of the intersection on his street. Mr. Pico said he has since parked his car legally, but was told by a police officer that he had to move his car because the trucks could not get by. The officer also told him if he did not move his car by the time he counts to 5, he would issue him a ticket and tow the car. Mr. Pico said he believes he is being discriminated against by the police and questioned why he would have to move his legally parked car so trucks could go by. Mr. Pico said he drives a school bus and when he complained to one of the officers about cars blocking the intersection, he was told they have more important things to do than worry about cars blocking the intersection. Mr. Pico said he tried twice to make an appointment to speak with the Police Chief, but he has not responded to him. Mr. Pico stated he fears getting a ticket and having his car towed even though it’s legally parked. Mayor Maio asked the Administrator to set up a meeting between Mr. Pico and the Chief.
Seeing no one further from the public wishing to speak, Mayor Maio closed this public portion of the meeting.

On motion by Councilman Romano, seconded by Councilman Riccardi and carried by majority voice vote, the above listed minutes were approved. Councilwoman Kuncken abstained from the August 13, 2019 minutes.

On motion by Councilwoman Kuncken, seconded by Councilman Thornton and unanimously carried by voice vote, the list of correspondence was accepted and ordered placed on file.
COUNCIL COMMITTEE REPORTS
Public Safety – Councilwomen Kuncken/Thistleton
(Police, Fire, Ambulance, Court & Violations Bureau, Emergency Management)
Councilwoman Kuncken stated, for the month of August, the Fire Department reported 5 calls answered, 1 mutual aid, 1 assist to EMS, 4 drills and 3 details for a total of 413.5 hours.
Councilwoman Kuncken stated, for the month of August, the Fire Marshal reported one inspection at Heritage Crossing with regard to an alarm and sprinkler certification. There were no complaints or fire responses during the month.
Councilwoman Kuncken stated the Police Department reported 90 motor vehicle stops and a total of 242 calls for the month of August.
Councilwoman Kuncken stated the Ambulance Squad for the month of July reported 36 calls in Stanhope, 35 calls in Netcong and 2 stand-bys and 6 out-of-town calls for a total of 79 calls. They treated 59 patients and made 52 trips to the hospital. The total miles travelled was 1,608 miles.
Finance & Administration – Councilman Romano/Councilwoman Kuncken
Councilman Romano reported taxes collected in August month-to-date was $2,197.973.20 and year-to-date is $9,002,081.95. The percentage of collection for the third quarter is 94.5%.
Councilman Romano reported the water collections for August totaled $28,296.65 and year-to-date totals $394,130.07. The sewer collections for August totaled $37,268.49 and year-to-date totals $481,963.55.
Councilman Romano also reported the Finance Committee met and discussed Municipay. After review of the contract, and acknowledging a few of the things in the contract will never be to their liking, the Finance Committee is of the opinion they should move forward with Municipay. They will start with taxes and water/sewer first. Councilman Romano said all of the Finance Committee’s questions were answered to their satisfaction and he deferred to the Administrator to speak about the meeting during his Administrator’s Report.

Municipal Infrastructure – Councilman Thornton/Councilwoman Zdichocki

Councilman Thornton reported the paving on Young and Maryann is not yet completed and he deferred to the Administrator’s Report.
Information Technology – Councilmen Riccardi/Romano
Councilman Riccardi had no report.

In Councilwoman Thistleton’s absence there was no report.
ADMINISTRATOR’S REPORT
Water Break – Administrator McNeilly reported the DPW was on a water service break on Linden Avenue today. They will be back working on Young Drive and Maryann Terrace tomorrow. Administrator McNeilly noted this is the fourth water main break.
Young Drive and Maryann Terrace – Administrator McNeilly reported the trench, driveway and yard repair is ongoing. He is hopeful to be finished by the end of next week. Eric Keller, Borough Engineer, is in contact with Tilcon and they are still waiting for a schedule date. Administrator McNeilly said he expects scheduling to be within the next three weeks.
2019 Best Practice Checklist – Administrator McNeilly stated the governing body will receive the checklist for review the second week of October and Council discussion will take place at the October 22nd meeting.
Towing Ordinance – Administrator McNeilly stated he requested the Borough Attorney revise the Borough’s towing and storage ordinance to be in conformance with the revised Predatory Towing Prevention Act. The new rate system is consistent with the NJ State Police rate and by this ordinance will be able to be revised and kept current without the need to update the ordinance. Chief Pittigher has had an opportunity to review the proposed ordinance and is pleased with it.
Walk to School Day – Administrator McNeilly reported Walk to School Day is scheduled for October 2nd. The message board and Nixle will be provided.
Animal Licensing – Administrator McNeilly reported he received an email from Chief Pittigher regarding extending licensing to 3 years in line with the length of time the rabies vaccination is valid. Administrator McNeilly noted the governing body would need input from the Board of Health and also the Clerk’s Office since that office issues the licenses. Administrator McNeilly expressed his opinion that a three year license would be a benefit to the resident and time savings for the staff.
Storm Water Training – Administrator McNeilly reported he reached out to the Musconetcong Watershed Association to provide the required yearly training. Kyle has confirmed that he will give his presentation at the October 8th meeting.
Tax Sale – Administrator McNeilly reported the tax sale for unpaid 2018 taxes, water and sewer bills will be on October 8th. The CFO informed him we are down to 36 unpaid on the list. We are hoping for a good turnout of bidders.
Lake Musconetcong – HAB Update – Administrator McNeilly deferred to Mayor Maio. Mayor Maio reported she received an email from Earl Riley, Chairman of the Lake Musconetcong Regional Planning Board informing that the DEP conducted another test of the lake and it appears to be clear. There had been previous tests of the locations and the lake is now clear.
Condominium Service Calculations – Administrator McNeilly reported the condominium services calculation was completed and sent to the attorney for the condominium.
Councilman Thornton noted the Administrator mentioned the Linden Avenue water main break was the fourth break and he asked if it was the fourth break on Linden Avenue. Administrator McNeilly responded it was the second on Linden Avenue. The other was one on Hill Road and one on Brooklyn Road.
Councilman Thornton noted a flatbed truck from the business across the street from Borough Hall is consistently parked on Main Street and there are now about 4 parking spaces not available to the cars that usually park there. In addition to the flatbed truck there is the overflow of cars from that business parked on the street. Administrator McNeilly said there is nothing that states they cannot park on the street other than off-street parking which begins November 1st. Councilman Thornton noted in the past they had an issue with the overflow of cars from that business being parked on the street and when the owner was informed of the concern, he found a place to store the cars. The building he used to store the vehicles is no longer available and now the cars are parked on the street again. Councilman Thornton said he believes it is the same owner and he asked that the owner be approached again. Administrator McNeilly will reach out to the business owner and bring this issue to his attention.
COUNCIL DISCUSSION
Municipay – Mayor Maio deferred to the Administrator. Administrator McNeilly reported the Finance Committee met to discuss Municipay. Administrator McNeilly noted they want the municipal account number to be used to look up an account, not the name, block or lot number. Since the account number is on the tax bill, if it changed you would have it available or you could call Borough Hall. This would be the identifier to the account for Municipay. Municipay has the ability for the Borough to provide on-line collection of taxes and water/sewer utilizing a credit card and also utilizing a credit card at Borough Hall. There was a question raised regarding accepting partial payments. Municipay is set up to be able to allow for partial payments. The fee is charged to the user as a convenience fee. The fee is 3% of whatever is charged and if the payment is below $50 the fee decreases. There was a concern about potentially having payments trying to be made after the tax sale has been posted. Once posted you must pay the amount in full at Borough Hall. Municipay has the ability to block the list of customers that you inform them are on the tax sale list and the customer will not be able to make a payment. If the credit card is declined an error message will appear and a support number will be given for the customer to call. If a payment is disputed, there will be an alert by the charge back center. The customer would be required to provide bills and receipts showing the transaction was approved. While the transaction is under review, the customer will see funds pulled from the account. Administrator McNeilly stated he does not anticipate this being a common occurrence. There will be two card swipe devices installed at both front counters at Borough Hall. The cost is $65.00 per device. Councilman Riccardi asked if the card readers are new and use a chip. Administrator McNeilly responded in the affirmative, adding a receipt will be provided. Councilman Thornton asked if it would be difficult or any penalty to get out of the contract if they decide after a while that they no longer wish to use Municipay. Administrator McNeilly responded there is no penalty and no contract obligation other than a 30-day notification requirement. Council agreed to move forward with Municipay. An authorizing resolution will be adopted at the next meeting.
TAP Grant – Mayor Maio deferred to the Administrator. Administrator McNeilly stated he received a large packet from Eric Keller’s office containing all the maps and specifications that needed to be updated and which have been submitted to the State. Administrator McNeilly said the State also requested three letters from him which he submitted. Administrator McNeilly noted in the specifications the notice to bidders calls out a bid date of November 20, 2019. The Borough is ready to go; we are just waiting on the State.
NEW BUSINESS
RESOLUTIONS
Mayor Maio offered the following resolutions which were read by title:
Resolution 133-19 RESOLUTION AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $4,639,302 BOND ANTICIPATION NOTES OF THE BOROUGH OF STANHOPE, IN THE COUNTY OF SUSSEX, NEW JERSEY
Section 1. Pursuant to a bond ordinance of the Borough of Stanhope, in the County of Sussex (the “Borough”), entitled “Bond ordinance providing for the improvement of the water supply and distribution system in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $250,000 therefor and authorizing the issuance of $237,500 bonds or notes of the Borough for financing such appropriation”, finally adopted on May 25, 2010 (#2010-03), bond anticipation notes of the Borough in a principal amount not exceeding $3,400 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 2. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $500,000, and authorizing the issuance of $285,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on May 25, 2010 (#2010 04), bond anticipation notes of the Borough in a principal amount not exceeding $56,200 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 3. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional equipment by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $90,000 therefor and authorizing the issuance of $85,500 bonds or notes of the Borough for financing such appropriation”, finally adopted on November 23, 2010 (#2010-13), bond anticipation notes of the Borough in a principal amount not exceeding $15,900 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 4. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional fire fighting equipment by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $37,000 therefor and authorizing the issuance of $35,200 bonds or notes of the Borough for financing such appropriation”, finally adopted on July 12, 2011 (#2011-13), bond anticipation notes of the Borough in a principal amount not exceeding $8,500 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 5. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system (Sparta Road – Phase II) in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $120,000 therefor and authorizing the issuance of $120,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on May 22, 2012 (#2012-10), bond anticipation notes of the Borough in a principal amount not exceeding $37,500 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 6. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional vehicular equipment for use by the water utility of the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $60,000 therefor and authorizing the issuance of $60,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on June 26, 2012 (#2012-14), bond anticipation notes of the Borough in a principal amount not exceeding $18,650 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 7. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $359,000, and authorizing the issuance of $341,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the county of Sussex, New Jersey”, finally adopted on June 26, 2012 (#2012-15), bond anticipation notes of the Borough in a principal amount not exceeding $176,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 8. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $2,300,000 therefor and authorizing the issuance of $2,300,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on November 27, 2012 (#2012-18), bond anticipation notes of the Borough in a principal amount not exceeding $27,600 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 9. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional equipment for use by the water utility of the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $140,000 therefor and authorizing the issuance of $140,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on July 9, 2013 (#2013-11), bond anticipation notes of the Borough in a principal amount not exceeding $69,200 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 10. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $91,000, and authorizing the issuance of $86,450 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the county of Sussex, New Jersey”, finally adopted on July 9, 2013 (#2013-12), bond anticipation notes of the Borough in a principal amount not exceeding $50,950 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 11. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system (Maple Terrace/Mountain Terrace) in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $104,000 therefor and authorizing the issuance of $104,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on April 8, 2014 (#2014-07), bond anticipation notes of the Borough in a principal amount not exceeding $46,977 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 12. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of Maple Terrace/Mountain Terrace in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $245,000 therefor and authorizing the issuance of $233,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on April 8, 2014 (#2014-08), bond anticipation notes of the Borough in a principal amount not exceeding $159,301.20 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 13. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system (James Street) in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $256,000 therefor and authorizing the issuance of $256,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on June 24, 2014 (#2014-11), bond anticipation notes of the Borough in a principal amount not exceeding $190,516 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 14. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of James Street in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $392,000 therefor and authorizing the issuance of $133,300 bonds or notes of the Borough for financing such appropriation”, finally adopted on June 24, 2014 (#2014-12), bond anticipation notes of the Borough in a principal amount not exceeding $91,243.91 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 15. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $465,000, and authorizing the issuance of $191,955 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on August 12, 2014 (#2014 13) bond anticipation notes of the Borough in a principal amount not exceeding $139,455 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 16. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $35,000, and authorizing the issuance of $35,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on August 12, 2014 (#2014 14) bond anticipation notes of the Borough in a principal amount not exceeding $30,600 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 17. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $114,002.59 therefor and authorizing the issuance of $38,100 bonds or notes of the Borough for financing such appropriation”, finally adopted on August 26, 2014 (#2014 18) bond anticipation notes of the Borough in a principal amount not exceeding $33,700 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 18. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $271,750, and authorizing the issuance of $258,150 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on April 28, 2015 (#2015 10) bond anticipation notes of the Borough in a principal amount not exceeding $187,148.33 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 19. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $128,000, and authorizing the issuance of $128,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on April 28, 2015 (#2015 08) bond anticipation notes of the Borough in a principal amount not exceeding $118,500 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 20. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of various roads in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $120,000 therefor and authorizing the issuance of $114,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on July 28, 2015 (#2015-14), bond anticipation notes of the Borough in a principal amount not exceeding $92,795.56 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 21. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $338,034, and authorizing the issuance of $305,200 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on April 26, 2016 (#2016-04), bond anticipation notes of the Borough in a principal amount not exceeding $276,650 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 22. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $170,000 and authorizing the issuance of $161,500 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on May 9, 2017 (#2017-03), bond anticipation notes of the Borough in a principal amount not exceeding $151,500 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 23. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of Sparta Road and various trails in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $1,905,000 therefor and authorizing the issuance of $90,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on March 27, 2018 (#2018-03), bond anticipation notes of the Borough in a principal amount not exceeding $85,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 24. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $1,622,850, and authorizing the issuance of $1,328,740 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on May 8, 2018 (#2018-09), bond anticipation notes of the Borough in a principal amount not exceeding $1,328,740 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 25. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $688,525, and authorizing the issuance of $658,525 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the sanitary sewerage system of the Borough”, finally adopted on May 8, 2018 (#2018-10), bond anticipation notes of the Borough in a principal amount not exceeding $658,525 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 26. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $54,850, and authorizing the issuance of $54,850 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on May 8, 2018 (#2018-11), bond anticipation notes of the Borough in a principal amount not exceeding $54,850 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 27. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $431,800, and authorizing the issuance of $409,900 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on February 19, 2019 (#2019-01), bond anticipation notes of the Borough in a principal amount not exceeding $409,900 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 28. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $82,000, and authorizing the issuance of $82,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on February 19, 2019 (#2019-02), bond anticipation notes of the Borough in a principal amount not exceeding $82,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 29. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $38,000, and authorizing the issuance of $38,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the sanitary sewerage system of the Borough”, finally adopted on February 19, 2019 (#2019-03), bond anticipation notes of the Borough in a principal amount not exceeding $38,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 30. All bond anticipation notes (the “notes”) issued hereunder shall mature at such times as may be determined by the treasurer, the chief financial officer or the acting chief financial officer of the Borough (the “Chief Financial Officer”), provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the Chief Financial Officer and shall be signed and sealed by officials and officers of the Borough in any manner permitted by N.J.S.A. §40A:2-25. The Chief Financial Officer shall determine all matters in connection with the notes issued hereunder, and the Chief Financial Officer’s signature upon the notes shall be conclusive evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. §40A:2-8. The Chief Financial Officer is hereby authorized to sell part or all of the notes at not less than par from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price. The Chief Financial Officer is directed to report in writing to the governing body of the Borough at the meeting next succeeding the date when any sale or delivery of the notes hereunder is made. Such report must include the principal amount, interest rate and maturities of the notes sold, the price obtained and the name of the purchaser.
Section 31. Any note issued pursuant to this resolution shall be a general obligation of the Borough, and the Borough’s faith and credit are hereby pledged to the punctual payment of the principal of and interest on the notes and, unless otherwise paid or payment provided for, an amount sufficient for such payment shall be inserted in the budget and a tax sufficient to provide for the payment thereof shall be levied and collected.
Section 32. The Chief Financial Officer is hereby authorized and directed to do all other matters necessary, useful, convenient or desirable to accomplish the delivery of the notes to the purchasers thereof as promptly as possible, including (i) the preparation, execution and dissemination of a Preliminary Official Statement and Final Official Statement with respect to the notes, (ii) preparation, distribution and publication, if necessary, of a Notice of Sale with respect to the notes, (iii) execution of a Continuing Disclosure Undertaking, with respect to the notes in accordance with Rule 15c2 12 promulgated by the Securities and Exchange Commission and (iv) execution of an arbitrage and use of proceeds certificate certifying that, among other things, the Borough, to the extent it is empowered and allowed under applicable law, will do and perform all acts and things necessary or desirable to assure that interest paid on the notes is not included in gross income under Section 103 of the Internal Revenue Code of 1986, as amended.
Section 33. All action heretofore taken by Borough officials and professionals with regard to the sale and award of the notes is hereby ratified, confirmed, adopted and approved.
Section 34. This resolution shall take effect immediately.

Resolution 134-19 RESOLUTION REAPPOINTING AND GRANTING TENURE TO JASON LALIKER, TAX ASSESSOR
WHEREAS, Jason Laliker was previously appointed to fulfill the statutory duties of the part-time position of Tax Assessor for the Borough of Stanhope effective July 1, 2015, and has now served for four consecutive years in that position; and
WHEREAS, the Borough Council is desirous of reappointing Jason Laliker as the Borough’s Tax Assessor, thereby granting him tenure of office in that position, pursuant to N.J.S.A. 40A:9-148.
NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope in the County of Sussex and State of New Jersey, that Jason Laliker be and he is hereby appointed Tax Assessor of the Borough of Stanhope to be effective as of July 1, 2019 at an annual salary rate of $20,636.00. Said term of appointment shall be for four years, thus being eligible for tenure; and
BE IT FURTHER RESOLVED that said Jason Laliker shall perform such duties as are now or herein after imposed by statute, regulation, by Borough Ordinance and Employee Handbook; and
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be forwarded to Melissa Rockwell, CTA, Sussex County Tax Administrator.

Resolution 135-19 RESOLUTION AWARDING CONTRACT FOR YOUNG DRIVE AND MARYANN TERRACE CURB REPLACEMENT
WHEREAS, a need exists for curb replacement on Young Drive and Maryann Terrace within Stanhope Borough; and
WHEREAS, the Borough of Stanhope may, without advertising for bids, purchase such materials through the Morris County Cooperative Purchasing Pricing Council Cooperative (“MCCPC”) Contract #6, pursuant to N.J.S.A. 40A:11-10, et seq. and N.J.A.C. 5:34-7.1 et. seq., and
WHEREAS, under MCCPC #6 award, the Vendor, Cifelli & Son General Contracting, Inc., 81 Franklin Avenue, Nutley, New Jersey 07110, has been awarded the contract for curb replacement on Young Drive and Maryann Terrace in the amount of $42,759.75, under MCCPC Contract #6.
NOW, THEREFORE BE IT RESOLVED, by the Borough of Stanhope that it authorizes award of the contract or curb replacement on Young Drive and Maryann Terrace to Cifelli & Son General Contracting, Inc., 81 Franklin Avenue, Nutley, New Jersey 07110, in the total amount of $42,759.75.

Resolution 136-19 RESOLUTION OF THE MAYOR AND COUNCIL OF THE BOROUGH OF STANHOPE AUTHORIZING THE ISSUANCE OF A TAXICAB LICENSE TO STANHOPE LIMO LLC
WHEREAS, Chapter 126 of the Stanhope Code of Ordinances requires that anyone operating a taxicab service within the Borough must obtain a license for same; and
WHEREAS, Stanhope Limo LLC, operating at 249 Route 206, Stanhope have applied to the Borough Clerk for a taxicab license and have complied with all the provisions of Chapter 126; and
WHEREAS, the following vehicles are to be operated by Jorge Ardon within the Borough of Stanhope:
Vehicle #1 – 2006 Honda, Odyssey VIN # 5FNRL38706B058279; and
WHEREAS, the Municipal Clerk and the Zoning Officer have reviewed said application and recommend approval; and
WHEREAS, said approval is contingent upon receipt by the Borough Clerk of proof of required insurance and payment of all fees;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope, County of Sussex, State of New Jersey, that the Borough Clerk is hereby authorized to issue, for the year 2019, said taxicab license to operate expiring at midnight December 31, 2019.
Resolution 137-19 RESOLUTION AUTHORIZING REFUND OF
OVERPAYMENT OF TAXES
WHEREAS, the homeowners refinanced their mortgage, and a payment by their previous bank as well as the new one has resulted in duplicate payments paid toward the 3rd Quarter 2019 taxes, creating an overpayment of taxes on this property; and
WHEREAS, the homeowners’ new bank will be escrowing and paying the property taxes from this point forward, and the homeowners have requested a refund of the overpayment of taxes.
NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Stanhope, that a warrant be drawn to the homeowners in the designated amount representing an overpayment of taxes, as follows:

CITIZENS TO BE HEARD
Mayor Maio opened the meeting to the public after advising attendees that there is a five (5) minute time limit for each speaker.
Ray Cipollini, 11 Towpath Lane, noted the discussion on using the services of Munipay and he asked if there will be any effect on residents who continue to pay by check or through their bank. Administrator McNeilly responded there will be no effect, Municipay is just an added convenience.
Rich Perry, 43 Sparta Road, said he wants to make the governing body aware that there are no stop signs at Walton Street and Central Avenue and at Hillside Avenue and Port Morris Avenue. Administrator McNeilly stated he does not know if there ever were stop signs at those locations. Mr. Perry said he was almost t-boned by another vehicle because there was no stop sign. Administrator McNeilly said if the stop signs are missing, he will have them replaced.
Seeing no one further from the public wishing to speak, Mayor Maio closed the public portion of the meeting.
