MAYOR’S STATEMENT AS TO COMPLIANCE WITH P.L. 1975
Adequate Notice of this Meeting has been provided according to the Open Public Meetings Act, Assembly Bill 1030. Notice of this Meeting was included in the Annual Meeting Notice sent to the New Jersey Herald and the Daily Record on January 5, 2022 and was placed on the Official Bulletin Board in the Municipal Building and on the official website of the Borough of Stanhope.
In the event the Mayor and Council have not addressed all items on this Agenda by 10:00 PM and they are of the opinion that they cannot complete the Agenda in a reasonable time period, the Mayor and Council may exercise their option to continue this meeting at an agreed to date, time and place. Please turn off all cell phones for the duration of this Meeting.

Mayor Zdichocki amended the agenda and moved the Administrator’s Report forward.
ADMINISTRATOR’S REPORT
DPW – Administrator McNeilly stated the hydrant flushing is expected to be completed this week. The DPW has been working nights on the hydrant flushing. New employees are being trained and pressure testing is being done. The pothole repairs will be ongoing throughout the month of April.
Community Clean Up Day – Administrator McNeilly stated he got an indication from Nicole Member that the Community Clean Up Day scheduled for April will not be taking place until the Fall. No official information has been received to date. The Paper Shredding Day will take place regardless. Councilman Thornton asked if the Borough would be collecting electronics. Administrator McNeilly stated SCMUA is collecting electronics free on that same day however, he will call the facility in Randolph to see if they are still accepting electronics. Councilman Riccardi stated he will confirm the clean-up day information at Thursday’s Environmental Commission meeting.
Sussex Warren Energy Co-op – Administrator McNeilly stated an email was received today stating the Sussex Warren Energy Co-op will potentially be going out for an energy auction on June 21, 2022, for a start date of either October 2022 or March 2023. If the market is not favorable, they will postpone the release of the bid to suppliers until such time that a decent savings can be obtained for the residents.
Road Opening Permit – Administrator McNeilly stated the road opening permit form has been completed with help from the Borough Engineer and Borough Attorney. NJ Natural Gas has requested the road opening permit form to begin the process for the gas main installation. NJ Natural Gas has not conducted the survey and marketing to date. The current plan is for the gas line to be run from Netcong to the backside of Furnace Street, up to Kelly Place, to Main Street, to Church Street, to Linden Avenue, across the highway up McKinley Street, and then up to Brooklyn Road all the way down to Landing. Then, in the future, the rest of the streets could be filled in. Eventually the lines will be run down Route 183 toward the Black Forest to tie in out through Exit 25 into the Mount Olive section. This will connect all the points including connection to Byram Township.
Budget 2022 – Administrator McNeilly stated the Budget Adoption and Public Hearing; Salary Adoption and Public Hearing; Salary Resolution; and Capital Ordinance – First Reading will take place on April 26th. The Capital Adoption and Public Hearing will take place on May 10th. Capital funds which are self-funded will be available 10 days after and bonded funds will be available 20 days after.
Banners – Mayor Zdichocki stated she noticed the DPW has changed out the seasonal banners on Main Street and Sparta Road. They are doing a good job. Administrator McNeilly stated the banners which used to be hung on Main Street were used for Sparta Road and additional flags were purchased for Main Street. There are 23 lights on Main Street and 25 lights on Sparta Road. The flags are being purchased from Project Graphics due to the quality of the fabric. The DPW do a good job of maintaining the flags. They spend time cleaning, drying and storing them properly.
Congressional FY2023 Community Projects – Administrator McNeilly stated he attended an online seminar on the upcoming cycle for congressional direct spending. The Borough was successful in the 2022 round of approved projects. The Borough was awarded funding in the amount of $677,000. News has spread that this type of program is available so the competition is expected to be fierce among the municipalities, non-profits and schools. The short deadline for submission requests is April 18, 2022, which is next Monday and this Friday is a holiday. The Congresswoman gets 15 projects, it was 10 last year, and there is some possibility for this to go the Senate side as well. The only project which has been prepared and is on hand for submission is the Borough Hall Improvement Project. The plans and the cost estimates were prepared in September 2018. Administrator McNeilly provided copies of the information to the governing body.
Mayor Zdichocki stated Congresswoman Sherrill will be in Stanhope on Friday, April 22nd, at 2:15PM to present the check to the Borough for the funding of the water main replacement project which was just awarded. The plan is to take Congresswoman Sherrill and Senator Menendez, who also supported this project, and the other attendees from her cabinet, on a tour and explain what the water main project will entail. There will be newspaper coverage. Mayor Zdichocki invited the governing body and hopes the residents who will benefit from this project will attend. A tour of the municipal offices will also be given. Administrator McNeilly stated the Borough’s ADA needs will be outlined and if the offices had been set up in a different format, the building would not have had to be shut down like it was during the pandemic if space was allocated differently. The new plans account for these needs along with training space. The Police Department now needs male and female locker rooms on the other side of the building. The Borough cannot afford to bond this type of project. An additional $10,000 should be added to adjust to today’s costs. Administrator McNeilly stated the grant request should be north of one million. Discussion took place regarding the last round of grant submissions and awards and how to best present this project. Administrator McNeilly stated the cost for the project should be submitted at $1.2 million. The Borough would still need to provide some of the funding. The commitment would not be provided until this time next year. The budget has to be signed by the President first. Administrator McNeilly stated he will ask Millennium Strategies to provide the narrative for the grant submission. During the seminar, it was mentioned that the funding may be spread out more nation-wide. If the Borough receives any funding, it may be less than the requested amount.
NJ Natural Gas – Councilman Thornton asked Administrator McNeilly if there is a possibility that NJ Natural Gas will run the gas main and then determine there is not enough interest within the Borough to connect to the residences. Administrator McNeilly stated that is a possibility but not probable. The businesses and the rental properties in this area will most likely want to convert to natural gas. When the gas company starts marketing the availability, they will inform residents that if they need to update their heating systems in the near future, and they are interested in switching over to natural gas, they should install a propane system which could then be converted over to natural gas. Administrator McNeilly stated the ordinance which was just adopted for streets and sidewalks contains a regulation which states if a road is newly paved, it cannot be opened to install any lines for five years. Residents are encouraged to decide as soon as they are contacted by NJ Natural Gas if they want to be able to gain access. Administrator McNeilly stated NJ Natural Gas and PSE&G are regulated by the BPU. They cannot expand into an area which does not have enough customers to support it because they cannot use monies from other areas to make the expansion.
Administrator McNeilly left the meeting at this time.
ENGINEER’S REPORT
Sparta Road TAP Grant Project – Eric Keller, Borough Engineer, stated the replacement of the spalled sidewalk panels for the Sparta Road TAP Grant Project will be completed in the next couple of weeks, pending suitable weather conditions. Mayor Zdichocki stated she has been asked by the residents in the area if they can remove the netting now that the grass is beginning to grow. Mr. Keller stated the netting should remain in place to stabilize the areas until the grass is well established. Mr. Keller will check to see if the netting is biodegradable. Mr. Keller stated all the manuals, keys, warranties, etc. are being compiled and they will be delivered to the Administrator. The remaining project close out documents will be processed.
Kelly Place, Waterloo Road & Furnace Street Project – Mr. Keller stated the contractor for the Kelly Place, Waterloo Road and Furnace Street Project needs to provide the schedule to install the shrubs, weather permitting, and the remaining punch list items. Upon completion of that work, we will process the final payment request, which will include a final change order addressing all of the as-built quantities.
2022 Capital Budget – Mr. Keller stated the proposals were previously submitted for three (3) capital projects, the FY 2021 Local Aid Grant for improvements to Valley Road and Delaware Avenue; the Sunset Avenue/Ridge Road water main replacement; and Elizabeth Avenue milling and resurfacing. Design efforts for these projects will begin upon execution of the contracts. The proposal for the school crossing guard study, requested by the Police Chief, will be resubmitted soon.
Sparta Road Speed Limit Study – Mr. Keller stated the data is being reviewed from the variable speed signs installed along the roadway to assess the current speed distributions. This will be used in the study to assess support for a reduction in the posted speed limit. It is anticipated that the study will be completed by the end of the month. The traffic counting firm provided a quote which included something that was not asked for. The quote has to be updated.
School Crossing Guard Study – Councilwoman Kuncken stated the Police Chief communicated to the Public Safety Committee that the traffic study is needed in order for him to be able to rewrite his policy based on the study. Mr. Keller stated the proposal was first drafted two years ago. At that point, the study had not been budgeted. The pandemic hit and then the schools were being held remotely which made it impossible to conduct the traffic volume study. The proposal will be submitted to Administrator McNeilly within the week. The counts will have to be completed before school closes, but there are a few months left. Councilwoman Kuncken will inform the Police Chief of the timeframe. Mr. Keller stated the Police Chief is welcome to reach out to him directly if he has any additional questions. The study will be done at Brooklyn Road and Lloyd Avenue; Brooklyn Road and Crestview Drive; Brooklyn Road and Maple Terrace; Sparta Road at the Little League Field; and Dell Road at Maryann Terrace. Mayor Zdichocki asked if the there would be changes due to the installation of the additional crosswalk light. Mr. Keller replied no there will not be changes due to the fact there is still a crossing guard at Crestview Drive even though there is a rectangular rapid flashing beacon installed by the County. This is different than what has been installed on Sparta Road. Mr. Keller stated the locations for the study were supplied by the Police Chief. Councilwoman Kuncken asked if the Borough will still be receiving the flashing lights to be installed at Maple Terrace and Lloyd Avenue. Mr. Keller stated that is a County project.
NJDOT Study for Route 183 at the American Legion – Mr. Keller stated the DPW Superintendent forwarded an email he received from the NJDOT regarding a study the State will be conducting at Route 183 at the American Legion location.
WORK SESSION
Easter Egg Hunt – Councilwoman Kuncken stated the Easter Egg Hunt was very successful. There was a huge turnout this year. The people were so appreciative. Unfortunately, the playground area was under water. Rosemarie Maio, present in the audience, volunteered at the event and confirmed the event was a success.
St. Patrick’s Day Fundraiser – Councilwoman Kuncken stated the St. Patrick’s Day Fundraiser which was held for the Fire Department and the Ambulance Squad raised $2,900. Each organization received $1,450. Councilwoman Kuncken thanked all the residents who participated and all the volunteers who assisted. The event was very successful.
Mayor Zdichocki thanked the members of the Council and the residents who helped out during the Easter Egg Hunt and the St. Patrick’s Day Fundraiser.

SECTION 2. Salaries and wages for all Borough employees and officials shall be paid in bi-weekly installments as nearly equal as possible.
SECTION 3. Unless otherwise provided herein, remuneration for all employees shall be retroactive to January 1st of each year.
SECTION 4. The salaries and wages herein established shall be in lieu of any and all fees to which the respective incumbents of said offices might otherwise be entitled by statute or ordinance; which fees shall immediately upon collection therof be paid over to the Treasurer for use of the Borough except as otherwise provided herein.
SECTION 5. The Borough shall pay medical insurance premiums in accordance with State law, collective bargaining agreements and the Borough’s elected participation in any State health benefit program for all eligible employees and their eligible dependents.
SECTION 6. The terms and conditions of all collective bargaining agreements negotiated between the Borough and any bargaining unit representing Borough employees are hereby incorporated into this Ordinance.
SECTION 7. All Ordinances and Resolutions, or parts thereof, inconsistent herewith are hereby repealed.
SECTION 8. This Ordinance shall become effective immediately upon final adoption and publication as required by law.

RESOLUTIONS
Mayor Zdichocki offered the following resolutions which were read by title.
Resolution 080-22 RESOLUTION AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $3,623,679 BOND ANTICIPATION NOTES OF THE BOROUGH OF STANHOPE, IN THE COUNTY OF SUSSEX, NEW JERSEY BE IT RESOLVED BY THE BOROUGH COUNCIL OF THE BOROUGH OF STANHOPE, IN THE COUNTY OF SUSSEX, NEW JERSEY, AS FOLLOWS:
Section 1. Pursuant to a bond ordinance of the Borough of Stanhope, in the County of Sussex (the “Borough”), entitled: “Bond ordinance providing for the improvement of the water supply and distribution system (Sparta Road – Phase II) in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $120,000 therefor and authorizing the issuance of $120,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on May 22, 2012 (#2012-10), bond anticipation notes of the Borough in a principal amount not exceeding $10,500 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 2. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional vehicular equipment for use by the water utility of the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $60,000 therefor and authorizing the issuance of $60,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on June 26, 2012 (#2012-14), bond anticipation notes of the Borough in a principal amount not exceeding $5,250 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 3. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $359,000, and authorizing the issuance of $341,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on June 26, 2012 (#2012-15), bond anticipation notes of the Borough in a principal amount not exceeding $47,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 4. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $2,300,000 therefor and authorizing the issuance of $2,300,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on November 27, 2012 (#2012-18), bond anticipation notes of the Borough in a principal amount not exceeding $7,900 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 5. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional equipment for use by the water utility of the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $140,000 therefor and authorizing the issuance of $140,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on July 9, 2013 (#2013-11), bond anticipation notes of the Borough in a principal amount not exceeding $31,500 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 6. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $91,000, and authorizing the issuance of $86,450 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on July 9, 2013 (#2013-12), bond anticipation notes of the Borough in a principal amount not exceeding $21,050 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 7. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system (Maple Terrace/Mountain Terrace) in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $104,000 therefor and authorizing the issuance of $104,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on April 8, 2014 (#2014-07), bond anticipation notes of the Borough in a principal amount not exceeding $21,647 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 8. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of Maple Terrace/Mountain Terrace in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $245,000 therefor and authorizing the issuance of $233,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on April 8, 2014 (#2014-08), bond anticipation notes of the Borough in a principal amount not exceeding $70,291 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 9. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system (James Street) in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $256,000 therefor and authorizing the issuance of $256,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on June 24, 2014 (#2014-11), bond anticipation notes of the Borough in a principal amount not exceeding $120,516 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 10. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of James Street in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $392,000 therefor and authorizing the issuance of $133,300 bonds or notes of the Borough for financing such appropriation”, finally adopted on June 24, 2014 (#2014-12), bond anticipation notes of the Borough in a principal amount not exceeding $39,993 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 11. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $465,000, and authorizing the issuance of $191,955 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on August 12, 2014 (#2014‑13) bond anticipation notes of the Borough in a principal amount not exceeding $72,155 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 12. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $35,000, and authorizing the issuance of $35,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on August 12, 2014 (#2014‑14) bond anticipation notes of the Borough in a principal amount not exceeding $17,760 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 13. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water supply and distribution system in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $114,002.59 therefor and authorizing the issuance of $38,100 bonds or notes of the Borough for financing such appropriation”, finally adopted on August 26, 2014 (#2014‑18) bond anticipation notes of the Borough in a principal amount not exceeding $25,700 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 14. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $271,750, and authorizing the issuance of $258,150 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on April 28, 2015 (#2015‑10) bond anticipation notes of the Borough in a principal amount not exceeding $109,948 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 15. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $128,000, and authorizing the issuance of $128,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on April 28, 2015 (#2015‑08) bond anticipation notes of the Borough in a principal amount not exceeding $97,870 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 16. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of various roads in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $120,000 therefor and authorizing the issuance of $114,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on July 28, 2015 (#2015-14), bond anticipation notes of the Borough in a principal amount not exceeding $54,235 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 17. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $338,034, and authorizing the issuance of $305,200 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on April 26, 2016 (#2016-04), bond anticipation notes of the Borough in a principal amount not exceeding $145,741 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 18. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $170,000 and authorizing the issuance of $161,500 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on May 9, 2017 (#2017-03), bond anticipation notes of the Borough in a principal amount not exceeding $97,136 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 19. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of Sparta Road and various trails in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $1,905,000 therefor and authorizing the issuance of $90,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on March 27, 2018 (#2018-03), bond anticipation notes of the Borough in a principal amount not exceeding $56,615 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 20. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $1,622,850, and authorizing the issuance of $1,328,740 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on May 8, 2018 (#2018-09), bond anticipation notes of the Borough in a principal amount not exceeding $991,500 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 21. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $688,525, and authorizing the issuance of $658,525 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the sanitary sewerage system of the Borough”, finally adopted on May 8, 2018 (#2018-10), bond anticipation notes of the Borough in a principal amount not exceeding $458,165 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 22. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $54,850, and authorizing the issuance of $54,850 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on May 8, 2018 (#2018-11), bond anticipation notes of the Borough in a principal amount not exceeding $47,350 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 23. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $431,800, and authorizing the issuance of $409,900 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on February 19, 2019 (#2019-01), bond anticipation notes of the Borough in a principal amount not exceeding $321,402 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 24. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $82,000, and authorizing the issuance of $82,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on February 19, 2019 (#2019-02), bond anticipation notes of the Borough in a principal amount not exceeding $72,500 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 25. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $38,000, and authorizing the issuance of $38,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the sanitary sewerage system of the Borough”, finally adopted on February 19, 2019 (#2019-03), bond anticipation notes of the Borough in a principal amount not exceeding $26,860 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 26. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional vehicular equipment for use by the sewer utility of the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $28,400 therefor and authorizing the issuance of $28,400 bonds or notes of the Borough for financing such appropriation”, finally adopted on January 28, 2020 (#2020-01), bond anticipation notes of the Borough in a principal amount not exceeding $25,900 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 27. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $461,300, and authorizing the issuance of $334,625 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey”, finally adopted on January 28, 2020 (#2020-02), bond anticipation notes of the Borough in a principal amount not exceeding $321,625 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 28. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $236,400 and authorizing the issuance of $236,400 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stanhope, in the County of Sussex, New Jersey, for the water supply and distribution system of the Borough”, finally adopted on January 28, 2020 (#2020-03), bond anticipation notes of the Borough in a principal amount not exceeding $236,400 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 29. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the acquisition of new and additional equipment for the Department of Public Works of the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $27,810 therefor and authorizing the issuance of $26,420 bonds or notes of the Borough for financing such appropriation”, finally adopted on April 27, 2021 (#2021-07), bond anticipation notes of the Borough in a principal amount not exceeding $26,420 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 30. Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of various roads in and by the Borough of Stanhope, in the County of Sussex, New Jersey, appropriating $294,000 therefor and authorizing the issuance of $42,750 bonds or notes of the Borough for financing such appropriation”, finally adopted on May 25, 2021 (#2021-11), bond anticipation notes of the Borough in a principal amount not exceeding $42,750 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
Section 31. All bond anticipation notes (the “notes”) issued hereunder shall mature at such times as may be determined by the treasurer, the chief financial officer or the acting chief financial officer of the Borough (the “Chief Financial Officer”), provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the Chief Financial Officer and shall be signed and sealed by officials and officers of the Borough in any manner permitted by N.J.S.A. §40A:2-25. The Chief Financial Officer shall determine all matters in connection with the notes issued hereunder, and the Chief Financial Officer’s signature upon the notes shall be conclusive evidence as to all such determinations. All notes issued hereunder may be renewed from time to time subject to the provisions of N.J.S.A. §40A:2-8. The Chief Financial Officer is hereby authorized to sell part or all of the notes at not less than par from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price. The Chief Financial Officer is directed to report in writing to the governing body of the Borough at the meeting next succeeding the date when any sale or delivery of the notes hereunder is made. Such report must include the principal amount, interest rate and maturities of the notes sold, the price obtained and the name of the purchaser.
Section 32. Any note issued pursuant to this resolution shall be a general obligation of the Borough, and the Borough’s faith and credit are hereby pledged to the punctual payment of the principal of and interest on the notes and, unless otherwise paid or payment provided for, an amount sufficient for such payment shall be inserted in the budget and a tax sufficient to provide for the payment thereof shall be levied and collected.
Section 33. The Chief Financial Officer is hereby authorized and directed to do all other matters necessary, useful, convenient or desirable to accomplish the delivery of the notes to the purchasers thereof as promptly as possible, including (i) the preparation, execution and dissemination of a Preliminary Official Statement and Final Official Statement with respect to the notes, (ii) preparation, distribution and publication, if necessary, of a Notice of Sale with respect to the notes, (iii) execution of a Continuing Disclosure Undertaking, with respect to the notes in accordance with Rule 15c2‑12 promulgated by the Securities and Exchange Commission and (iv) execution of an arbitrage and use of proceeds certificate certifying that, among other things, the Borough, to the extent it is empowered and allowed under applicable law, will do and perform all acts and things necessary or desirable to assure that interest paid on the notes is not included in gross income under Section 103 of the Internal Revenue Code of 1986, as amended.
Section 34. All action heretofore taken by Borough officials and professionals with regard to the sale and award of the notes is hereby ratified, confirmed, adopted and approved.
Section 35. This resolution shall take effect immediately.

Resolution 081-22 RESOLUTION REQUESTING APPROVAL FROM THE DIVISION OF LOCAL GOVERNMENT SERVICES TO ESTABLISH A DEDICATED TRUST BY RIDER FOR A DEVELOPER’S ESCROW FUND PURSUANT TO N.J.S.A. 40:55D-53.1
WHEREAS, permission is required of the Director of the Division of Local Government Services for approval as a dedication by rider of revenues received by a municipality when the revenue is not subject to reasonable accurate estimates in advance, and
WHEREAS, N.J.S.A. 40:55D-53.1 provides for receipt of Developer’s Escrow funds by the municipality to provide for the operating costs to administer this act; and,
WHEREAS, N.J.S.A. 40:55D-53.1 provides the dedicated revenues anticipated from the Developer’s Escrow Fund are hereby anticipated as revenue and are hereby appropriated for the purpose to which said revenue is dedicated by statute or other legal requirement,
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Stanhope, County of Sussex, State of New Jersey as follows:

Resolution 082-22 RESOLUTION AUTHORIZING CHANGE IN CUSTODIAN OF PETTY CASH FUND
WHEREAS, N.J.S.A. 40A:5-21 authorizes the establishment of a Petty Cash Fund, and,
WHEREAS, Dana J. Mooney was custodian of the Borough of Stanhope Petty Cash Fund, and
WHEREAS, in accordance with N.J.S.A. 40:5-21, the Borough of Stanhope is custodians to changing custodians as of April 1, 2022 to Angelica Sabatini; and
WHEREAS, Angelica Sabatini is bonded in the amount of $1,000,000.00 by virtue of surety bond.
NOW, THEREFORE BE IT RESOLVED that the Borough of Stanhope hereby authorizes such action and that two copies of this resolution be filed with the Division of Local Government Services, New Jersey Department of Community Affairs for approval.
Resolution 083-22 RESOLUTION AUTHORIZING EMPLOYMENT OF SCHOOL CROSSING GUARD
WHEREAS, the Borough of Stanhope provides crossing guards during school days throughout the Borough under the supervision of the Chief of Police; and
WHEREAS, the Chief has identified a need for a new school crossing guard, commencing on or about April 12, 2022; and
WHEREAS, the Chief has recommended Kenneth R. Cerni to act as the school crossing guard to be assigned to such duties as may be required by the Chief of Police.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stanhope that the Chief be and is hereby authorized to employ Kenneth R. Cerni as an alternate crossing guard, effective April 12, 2022.
Resolution 084-22 RESOLUTION WAIVING WATER AND SEWER FEES
WHEREAS, Allan and Shawn Flood, the owners of the property located at 159 Brooklyn Road in Stanhope Borough (the “Property”), had their house on the Property severely damaged due to a fire on October 9, 2021; and
WHEREAS, Mr. and Mrs. Flood have continued to receive bills in the amount of $112.00 per quarter for sewer and $93.00 per quarter for water for the Property, as set forth in Section 82-2.J(1)(a) and 82.2.P(1)(a); and
WHEREAS, since October 9, 2021, the Property has not been occupied by the homeowner and has not used any water and sewer; and
WHEREAS, Mr. and Mrs. Flood have requested a waiver of water and sewer fees via correspondence to the Borough Clerk dated March 10, 2022; and
WHEREAS, the Borough Council has considered Mr. and Mrs. Flood’s request and has determined that they should be responsible for all water and sewer fees up through the end of the 4th quarter of 2021, but should be exempt from paying water and sewer fees after the 4th quarter of 2021 through the time a certificate of occupancy is obtained for the Property;
NOW, THEREFORE, BE IT RESOLVED, that Mr. and Mrs. Flood shall be relieved from the payment of water and sewer fees in the amount of $205.00 per quarter from the end of the 4th quarter of 2021 through the time a Certificate of Occupancy is obtained for the Property.

Mayor Zdichocki opened the meeting to the public after advising attendees that there is a five (5) minute time limit for each speaker.
Rosemarie Maio, Maple Terrace, suggested if the governing body is going to apply for funding for the municipal building, she strongly recommends that the lack of ADA standards should be stressed. The governing body agreed the lack of ADA accessibility is an issue.
Seeing no one further from the public wishing to speak, Mayor Zdichocki closed the public portion of the meeting.
