MAYOR’S STATEMENT AS TO COMPLIANCE WITH P.L. 1975
Adequate Notice of this Meeting has been provided according to the Open Public Meetings Act, Assembly Bill 1030. Notice of this Meeting was included in the Annual Meeting Notice sent to the New Jersey Herald and the Daily Record on January 5, 2022 and was placed on the Official Bulletin Board in the Municipal Building and on the official website of the Borough of Stanhope.
In the event the Mayor and Council have not addressed all items on this Agenda by 10:00 PM and they are of the opinion that they cannot complete the Agenda in a reasonable time period, the Mayor and Council may exercise their option to continue this meeting at an agreed to date, time and place. Please turn off all cell phones for the duration of this Meeting.

ADMINISTRATOR’S REPORT
Valley Road / Delaware Avenue / Elizabeth Avenue – Administrator McNeilly stated the Infrastructure Committee Meetings, which have been held on Monday afternoons, has done wonders for the timeline on something which we had a lot of concern for. Administrator McNeilly stated the DPW has completed all the water connections. They are repairing and paving the trenches and will be finished by August 9th. Tilcon is scheduled to mill all three roads on August 11th and 12th. Paving will take place on August 15th. Stanhope School has been notified and flyers will be distributed door to door by the DPW. The information has been placed on the Borough website and a Nixle message will be sent before the milling is done and again before the paving is done.
Lenape Path – Administrator McNeilly stated the DPW will be paving the 50-foot section of the Lenape Path that did not qualify under the TAP grant. The DPW will also be paving the Sunset Avenue to Valley Road path.
Engineer – Administrator McNeilly stated Eric Keller, Borough Engineer, has a family related conflict and is unable to attend tonight’s meeting. Mr. Keller will be attending the August 23rd meeting to discuss active and future projects. Mr. Keller did provide a written report for this evening.
NJ Low Income Household Water Assistance Program (LIHWAP) – Administrator McNeilly stated an email was sent to the governing body regarding the proposed resolution for the Low Income Household Water Assistance Program (LIHWAP). This program is offered through the NJDCA, which is promoted on our website. A resolution is required to enter into a vendor relationship with the DCA to allow for direct reimbursement from NJDCA. If agreeable, the resolution can be placed on the August 23rd agenda.
NJ Natural Gas – Administrator McNeilly stated the Mayor and Council are going to receive invitations to the NJ Natural Gas Partners in Safety Reception being held on October 5th. This annual event will enable the governing body to meet with the NJ Natural Gas team, engineers, Pressure Measurement Transmission (PMT) Operations, marketing, pipeline safety and the government affairs team. Administrator McNeilly stated he has requested an update on the Stanhope project. The information will be shared with the governing body once it is received.
Budget 2023 Timeline – Administrator McNeilly stated the Department Capital Requests are due back by August 18th; Department Budget Requests are due back by August 26th; Budget and Capital Requests will be presented to the governing body on September 27th; Proposed 2023 budget discussion will take place at the October 11th Work Session meeting and the Tax Assessor and the Borough Auditor will make their presentations on December 11th.
Councilman Thornton asked Administrator McNeilly if the fiber optic is available yet. Administrator McNeilly stated it is not.
Mayor Zdichocki stated she is of the opinion the Monday Infrastructure Committee meetings were an excellent idea. The Department of Public Works has done a great job. Administrator McNeilly confirmed the DPW did a great job and had to lay asphalt when it was 100 degrees.
Administrator McNeilly reviewed the Borough Engineer’s report with the governing body.
Sparta Road Speed Limit Study – Administrator McNeilly stated Mr. Keller has reviewed the draft ordinance for the speed reduction on Sparta Road and it is consistent with the study. The new signs need to be ready for installation once the ordinance is adopted. The speed limit is dropping more than 10MPH and therefore a “reduced speed ahead” sign is required by law. The sign will have to be placed in Hopatcong before the bridge where the transition takes place.
Valley Road & Delaware Avenue Local Aid Project – Administrator McNeilly stated the curb work and milling and paving for Valley Road and Delaware Avenue are being done through the co-op. Reivax completed the curb work in just one day and they did a good job.
Elizabeth Avenue – Administrator McNeilly stated Elizabeth Avenue will be paved on Monday, August 15th. Elizabeth Avenue is a long road and having the work done for under $100,000 is a good deal. Councilman Vance stated there was a drainage issue in the past for the residence located at the bend in the road. Administrator McNeilly replied he will take a look at that area with the DPW Superintendent where Elizabeth Avenue meets Mountain Terrace.
Sunset Avenue / Ridge Road / Overhill Road Water Main Replacement – Administrator McNeilly stated this project will not be able to be done until next year and it will be rescheduled for the Spring of 2023.
Fire Hydrant on Linden Avenue – Administrator McNeilly stated the DPW Superintendent looked at the fire hydrant on Linden Avenue, located near the newly built house. It has been determined that the hydrant will need a twelve-inch rise installed.
Councilwoman Kuncken asked who makes the determination as to what sidewalks need to be replaced for the Valley Road and Delaware Avenue project. Administrator McNeilly stated that decision comes from the Borough Engineer who has already made those determinations based on cracks and trip hazards. Sidewalks are not changed for beautification purposes.
Councilman Riccardi asked if the speed reduction will encompass the entire roadway in the Borough. Administrator McNeilly replied yes, from the municipal boundary to Brooklyn Road.
Mayor Zdichocki asked if something will be done about the Stanhope sign. Administrator McNeilly stated that item is still on the punch list because it was not done correctly. Administrator McNeilly stated he has been complaining about the striping job on Sparta Road since day one because it is awful. The sign has also been an issue. Both of these issues are being followed up on.
WORK SESSION
Mayor’s Conference Call – Mayor Zdichocki stated there was a Mayor’s Conference Call last Tuesday and the topic of discussion was Monkey Pox. Although there are over 200 cases in New Jersey, none have been reported in Sussex County to date.
LUB Budget – Councilman Vance stated the Land Use Board met last night and approved the budget for next year.
Speeding Sign on Dell Road – Councilman Vance asked Administrator McNeilly if the speeding sign on Dell Road has been repaired. Administrator McNeilly stated he took the sign down to charge it.
Young Drive – Councilman Vance stated he sent a message to Administrator McNeilly regarding a rodent issue on the left-hand side of Young Drive and asked if that was addressed. Administrator McNeilly replied he has not received word back as yet.
Lloyd Avenue & Brooklyn Road Property Maintenance Issue – Councilman Vance asked for an update on the property maintenance issue on Lloyd Avenue. Administrator McNeilly stated the Code Enforcement/Zoning Official has been working on this. A notice of violation has been sent and a summons will be issued if necessary. Administrator McNeilly stated there is another property maintenance issue on Brooklyn Road which is being addressed. Discussion took place regarding how violations and summonses are issued and the timeframes. Administrator McNeilly stated the Zoning Officer does his best to work with everyone in order for the violations to be resolved.
Trees – Councilwoman Kuncken stated there are two dead trees near the detention basin which are most likely on Borough property. Administrator McNeilly stated we are in the process of removing dead trees at the top of the basin on Valley Road. Administrator McNeilly stated he will take a look at the trees in question. Administrator McNeilly stated there is a paper street near Lloyd Avenue where three Ash Trees will be removed this week. This street, Hude, may be vacated in the future. Once the ordinance is adopted to vacate the street, the property is divided among the neighboring property owners.
Fair Display Board – Councilwoman Kuncken shared a picture of the display board done by Linda Chirip and Maria Mascuch for the Sussex County Fair. Councilwoman Kuncken asked the governing body to go look at the boards if they attend the fair and she stated Linda and Maria did a great job.
NEW BUSINESS
Mayor Zdichocki offered the following resolutions which were read by title.
Resolution 141-22 AMENDED RESOLUTION AUTHORIZING USE OF TILCON NEW YORK, INC. AS SET FORTH IN THE MORRIS COUNTY CO-OP PUBLIC BIDS FOR VALLEY ROAD & DELAWARE AVENUE MILLING AND PAVING, RECOMMENDATION OF AWARD NJDOT LOCAL AID PROJECT
WHEREAS, the Borough of Stanhope is in need of roadway milling and paving for Valley Road and Delaware Avenue (the “Project”);
WHEREAS, the Borough applied for and received a Local Aid Grant from the New Jersey Department of Transportation; and
WHEREAS, the Borough Engineer’s estimate for milling and paving, including asphalt and fuel price adjustments on Valley Road and Delaware Avenue is $124,147.40; and
WHEREAS, the Borough is a member of the Morris County Co-Op which has already publicly bid milling and paving services for the year 2022 and has awarded a contract therefore for the services needed; and
WHEREAS, the Borough may utilize the Co-Op bid price as a member of the Co-Op without the need for further public bidding; and
WHEREAS, the Borough Engineer has recommended the use of the Co-Op bids for the above noted and various construction items for the “Project”; and
WHEREAS, the Borough awards the milling and resurfacing to Tilcon New York, Inc. for District #2 for the total amount of $124,147.40 subject to the approval of the New Jersey Department of Transportation (see attached bid tabulation);
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stanhope, that the Borough shall utilize Tilcon New York, Inc. for milling and paving for the Valley Road and Delaware Avenue Local Aid Project at the 2022 Morris County Co-Op awarded bid prices and quantities as set forth in the attached bid tabulation.
On motion by Councilman Vance seconded by Councilman Thornton and unanimously carried by the following roll call vote, the foregoing resolution was duly adopted.

Resolution 142-22 AMENDED RESOLUTION AUTHORIZING USE OF DENVILLE LINE PAINTING, INC. AS SET FORTH IN THE MORRIS COUNTY CO-OP PUBLIC BIDS FOR VALLEY ROAD & DELAWARE AVENUE LIMITED STRIPING, RECOMMENDATION OF AWARD NJDOT LOCAL AID PROJECT
WHEREAS, the Borough of Stanhope is in need of limited striping for Valley Road and Delaware Avenue (the “Project”);
WHEREAS, the Borough applied for and received a Local Aid Grant from the New Jersey Department of Transportation; and
WHEREAS, the Borough Engineer’s estimate for limited striping on Valley Road and Delaware Avenue is $2,251.92; and
WHEREAS, the Borough is a member of the Morris County Co-Op which has already publicly bid striping services for the year 2022 and has awarded a contract therefore for the various services needed; and
WHEREAS, the Borough may utilize the Co-Op bid price as a member of the Co-Op without the need for further public bidding; and
WHEREAS, the Borough Engineer has recommended the use of the Co-Op bids for the above noted and various construction items for the “Project”; and
WHEREAS, the Borough awards the limited striping to Denville Line Painting, Inc, for traffic striping on roadways for District #2 for the total amount of $2,251.92 subject to the approval of the New Jersey Department of Transportation (see attached bid tabulation);
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stanhope, that the Borough shall utilize Denville Line Painting, Inc, for traffic striping on roadways for the Valley Road and Delaware Avenue Local Aid Project at the 2022 Morris County Co-Op awarded bid prices and quantities as set forth in the attached bid tabulation.

Resolution 143-22 AMENDED RESOLUTION AUTHORIZING USE OF REIVAX CONTRACTING CORPORATION AS SET FORTH IN THE MORRIS COUNTY CO-OP PUBLIC BIDS FOR VALLEY ROAD & DELAWARE AVENUE CONCRETE CURB REPLACEMENT, RECOMMENDATION OF AWARD NJDOT LOCAL AID PROJECT
WHEREAS, the Borough of Stanhope is in need of concrete curb replacement for Valley Road and Delaware Avenue (the “Project”);
WHEREAS, the Borough applied for and received a Local Aid Grant from the New Jersey Department of Transportation; and
WHEREAS, the Borough Engineer’s estimate for concrete curb replacement on Valley Road and Delaware Avenue is $10,260.00; and
WHEREAS, the Borough is a member of the Morris County Co-Op which has already publicly bid concrete curb replacement services for the year 2022 and has awarded a contract therefore for the services needed; and
WHEREAS, the Borough may utilize the Co-Op bid price as a member of the Co-Op without the need for further public bidding; and
WHEREAS, the Borough Engineer has recommended the use of the Co-Op bids for the above noted construction item for the “Project”; and
WHEREAS, the Borough awards the concrete curb replacement to Reivax Contracting Corporation for District #2 for the total amount of $10,260.00 subject to the approval of the New Jersey Department of Transportation (see attached bid tabulation);
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stanhope, that the Borough shall utilize Reivax Contracting Corporation for concrete curb replacement for the Valley Road and Delaware Avenue Local Aid Project at the 2022 Morris County Co-Op awarded bid price and quantity as set forth in the attached bid tabulation.

Resolution 144-22 RESOLUTION AUTHORIZING USE OF KEY TECH LABORATORIES FOR VALLEY ROAD & DELAWARE AVENUE CONCRETE CORE SAMPLING AND TESTING FOR NJDOT LOCAL AID PROJECT
WHEREAS, the Borough of Stanhope is in need of bituminous concrete core sampling and testing for the paving of Valley Road and Delaware Avenue (the “Project”);
WHEREAS, the Borough applied for and received a Local Aid Grant from the New Jersey Department of Transportation related to this Project; and
WHEREAS, Key Tech Laboratories has submitted a proposal dated August 4, 2022, for bituminous concrete core sampling and testing for the paving of Valley Road and Delaware Avenue for $1,820.00; and
WHEREAS, the Borough Engineer has recommended the use of Key Tech Laboratories for this testing for the “Project”; and
WHEREAS, the Borough awards the bituminous concrete core sampling and testing for the paving of Valley Road and Delaware Avenue to Key Tech Laboratories for the total amount of $1,820.00 subject to the approval of the New Jersey Department of Transportation;
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stanhope, that the Borough shall utilize Key Tech Laboratories bituminous concrete core sampling and testing for the paving of Valley Road and Delaware Avenue as part of the Local Aid Project in the amount of $1,820.00, as set forth in the attached proposal.

Resolution 145-22 AWARD OF CONTRACT TO BOWMAN CONSULTING GROUP FOR PROFESSIONAL SERVICES FOR SCHOOL ROUTE PLAN AND SCHOOL CROSSING LOCATION ASSESSMENT
WHEREAS, the Borough of Stanhope is seeking professional services to review, evaluate and assess the sufficiency of the walking routes for students to the Valley Road School and Lenape Valley Regional High School; and
WHEREAS, Bowman Consulting Group, Ltd. has submitted a Proposal to prepare a preliminary School Route Plan detailing proposed school walk routes, any proposed modifications to existing signage/markings and any modifications to crossing guard locations for this project; and
WHEREAS, the Borough desires to retain Bowman Consulting Group for said services;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope, New Jersey as follows:
- That the Borough Administrator is hereby authorized to execute a contract on the Borough’s behalf with Bowman Consulting Group, Ltd., 54 Horsehill Road, Suite 100, Cedar Knolls, NJ 07927 for the School Route Plan detailing proposed school walk routes, any proposed modifications to existing signage/markings and any modifications to crossing guard locations.
- This contract is awarded without competitive bidding as a “professional service” in accordance with N.J.S.A. 40A:11-5(1)(a) of the Local Public Contracts Law.
- Award of this contract is contingent upon the certification as to the availability of funds by the Chief Financial Officer.
- The term of service shall be from the date of acceptance of the Professional Services Agreement until its completion, in full accord with the terms and conditions thereof. The total fee for this service shall not exceed $9,775.00, unless an addendum is prepared for any out of scope services that may be required.
- Notice of this action shall be published in the New Jersey Herald within ten (10) days of the passage thereof.

CONSENT AGENDA (All items listed on the Consent Agenda are considered routine by the Borough Council and were enacted by one motion of the Borough Council with no separate discussion.)
Resolution 146-22 RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH RUTGERS UNIVERSITY FOR
ONE-DAY CROSSING GUARD TRAINING CLASS
WHEREAS, the Sussex County Chiefs’ Association is sponsoring crossing guard training to crossing guards in Sussex County; and
WHEREAS, the Alan M. Voorhees Transportation at Rutgers University will be offering a one-day training class on August 26, 2022, providing all materials needed, as indicated on the attached agreement; and
WHEREAS, the Borough of Stanhope desires to enter into this agreement with the Alan M. Voorhees Transportation at Rutgers University regarding the one-day crossing guard training class.
NOW, THEREFORE BE IT RESOLVED, by the Borough Council of the Borough of Stanhope, County of Sussex, State of New Jersey, that the Mayor is hereby authorized to execute this Agreement.
Resolution 147-22 RESOLUTION TO REFUND OVERPAYMENT OF TAXES FOR 100% DISABLED VETERAN
WHEREAS, the homeowner was approved to receive the property tax exemption of a totally disable veteran as of the date of application, May 3, 2022, and is therefore exempt from property taxes from the date forward; and
WHEREAS, the total amount due for 2022 was $4,894.77; and
WHEREAS, the total liability is now pro-rated for 123 days from January 1, 2022 to May 3, 2022, or a total payable of $1,672.38; and
WHEREAS, the property owner has in good faith paid the amount of $2,434.36 in 2022, creating an overpayment of $761.99 in taxes on this property;
NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Stanhope, that a check be drawn to the homeowner in the designated amount representing an overpayment of taxes, as follows:

Resolution 148-22 RESOLUTION OF THE MAYOR AND COUNCIL OF THE BOROUGH OF STANHOPE GRANTING APPROVAL FOR A BLOCK PARTY
WHEREAS, the Borough of Stanhope received a request from the residents of Lakeview Estates to conduct their annual block party; and
WHEREAS, said block party is scheduled for Saturday, September 18, 2022 from the hours of 12:00 p.m. to 11:00 p.m. on Towpath Lane between house numbers 10 and 14.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope, County of Sussex, State of New Jersey, does hereby grant approval to Lakeview Estates to hold a block party on Saturday, September 18, 2022 from the hours of 12:00 p.m. to 11:00 p.m. on Towpath Lane between house numbers 10 and 14.
Resolution 149-22 RESOLUTION AUTHORIZING REFUND OF REDEMPTION MONIES TO OUTSIDE LIEN HOLDER
WHEREAS, the Tax Collector has received payment for the redemption of Tax Title Lien No. 2021-010 representing 2020 property taxes and/or utility charges on Block 11501, Lot 2, Qual C0300 known as 16300 Dell Pl, assessed to Mark Martini, and;
WHEREAS, the Tax Collector certifies that reimbursement is now required to be made to the following lien holder for the required redemption amounts as shown below:

Resolution 151-22 RESOLUTION OF THE MAYOR AND COUNCIL OF THE BOROUGH OF STANHOPE AUTHORIZING PAYMENT OF BILLS
WHEREAS, the Chief Finance Officer has certified that funds are available in the proper account; and
WHEREAS, the Chief Finance Officer has approved payment upon certification from the Borough Department Heads that the goods and/or services have been rendered to the Borough;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope that the current bills list, dated August 9, 2022 and on file and available for public inspection in the Office of the Chief Finance Officer and approved by the Chief Finance Officer for payment, be paid.

CITIZEN’S TO BE HEARD
Mayor Zdichocki opened the meeting to the public after advising attendees that there is a five (5) minute time limit for each speaker.
Seeing no one from the public wishing to speak, Mayor Zdichocki closed the public portion of the meeting.
