MAYOR’S STATEMENT AS TO COMPLIANCE WITH P.L. 1975
Adequate Notice of this Meeting has been provided according to the Open Public Meetings Act, Assembly Bill 1030. Notice of this Meeting was included in the Annual Meeting Notice sent to the New Jersey Herald and the Daily Record on January 5, 2022 and was placed on the Official Bulletin Board in the Municipal Building and on the official website of the Borough of Stanhope.
In the event the Mayor and Council have not addressed all items on this Agenda by 10:00 PM and they are of the opinion that they cannot complete the Agenda in a reasonable time period, the Mayor and Council may exercise their option to continue this meeting at an agreed to date, time and place. Please turn off all cell phones for the duration of this meeting.

CITIZENS TO BE HEARD
Mayor Zdichocki opened the meeting to the public after advising attendees that there is a five (5) minute time limit for each speaker.
Seeing no one from the public wishing to speak, Mayor Zdichocki closed the public portion of the meeting.
Tunnel to Towers Run – Mayor Zdichocki stated the Tunnel to Towers Run took place this past Sunday. Mayor Zdichocki thanked the residents who participated, Jack and Maria from Bell’s Mansion for sponsoring the bus, members of the Stanhope Fire Department – Chief Mike Donahue and Ray Wexler, and council members Gene Wronko and Anthony Riccardi for joining her in representing the Borough of Stanhope. The Tunnel to Towers 403 Reasons to Run in New York City is a wonderful foundation that helps so many people. Mayor Zdichocki extended special thanks to Jackie and Mike Pelleck for all their hard work in making this fund raiser successful. Approximately 267 local residents took part and there were approximately 18 people from Stanhope who participated.

COUNCIL COMMITTEE REPORTS
Public Safety – Councilwoman Kuncken/Councilman Vance
(Police, Fire, Ambulance, Court & Violations Bureau, Emergency Management)
Councilwoman Kuncken stated the Fire Department, for the month of August, reported 9 calls, 2 mutual aid calls, 1 assist to EMS, 5 drills, 1 meeting, 6 special details, 1 pump out, and 1 fire academy drill for a total of 344.25-man hours volunteered.
Councilwoman Kuncken stated the Sussex County Fire Marshal reported there were no responses to complaints or incidents during the month of August. There were two inspections; one at Capitol Care with no violations and one at Valley Road School with no violations.
Councilwoman Kuncken stated the Police Department, for the month of August, reported 162 motor vehicle stops out of 332 total calls for the month.
Finance & Administration – Councilman Romano/Councilman Thornton
Councilman Romano stated, for the month of August, the tax collection was $2,549,280.49. The year to date collection is $9,417,738.12. The percentages are exactly the same as last year. First quarter collection is 98%, second quarter is 97% and the third quarter is 95%.
Councilman Romano stated the water collections, for the month of August, were $29,015.67 and the year to date total is $430,128.96. The sewer collections for the month were $32,406.05 and year to date is $508,224.20.
Community Development – Councilman Wronko/Councilman Riccardi
Councilman Wronko stated six zoning permit applications were received, for the month of August, totaling $230.00 in fees collected. Four of the permits were approved and two were denied. There were 12 complaints which were addressed.
Councilman Wronko stated the Construction Department reported the fees collected for permits, for the month of August, total of $4,540.00.
Municipal Infrastructure – Councilman Thornton/Councilman Romano
(Water Distribution, Sewer Collection System, Road Construction & Maintenance, Buildings & Grounds)
Councilman Thornton stated the DPW collected brush during the week of September 12th, which has been completed. Leaf collection will begin next month. An Infrastructure Meeting is scheduled for October 18th.
Information Technology – Councilman Riccardi/Councilman Wronko
Councilman Riccardi stated he had no report for this evening.
Boards/Commissions – Councilman Vance/Councilwoman Kuncken
Councilman Vance stated the Environmental Commission will be holding the Clean Communities Cleanup on November 6th.
Councilman Vance asked the Clerk to contact the Shade Tree Commission Secretary to ask that the minutes be submitted monthly. Five months of minutes were received this month at one time. Ellen Horak, Clerk, stated the boards and commissions are notified when reports are missing and when that occurs multiple minutes may be sent in at one time. Ms. Horak stated she will contact the Shade Tree Secretary and let her know the minutes need to be submitted monthly.
Councilman Vance stated the Land Use Board had an application for a change of use variance. The application is for 30 Main Street and the owner wants to remove the commercial use and make both units into apartments. After quite a bit of discussion at the Land Use meeting, it became aware to the engineer for the applicant that the Land Use Board was not going to approve the change in the use. The applicant stepped down and will revisit the application in the future.
E-Waste Day – Councilman Thornton asked if the Clean Communities Day will also be an E-waste Day? Councilman Riccardi stated the electronic recycling is scheduled for the day before on Saturday. Councilwoman Kuncken asked if the shredding program will be taking place. Mayor Zdichocki stated no information has been provided to date. The shredding company is being contacted.
Stagnant Water Complaint – Mayor Zdichocki stated she received a complaint from a resident regarding the stagnant water in the area of the basketball court. Another area of concern was raised by the resident however, Mayor Zdichocki is of the opinion that area is located in Mt. Olive. Mayor Zdichocki is looking into different ways to address the problem, perhaps with a fountain and she is looking for available grants.
ENGINEER’S REPORT
Eric Keller, Borough Engineer, came forward to give his report.
Valley Road and Delaware Avenue Local Aid Project – Eric Keller, Borough Engineer, stated the bid opening for the sidewalk and ADA ramp improvements for Valley Road and Delaware Avenue was held last Tuesday, September 20th. There were three bidders and the low bidder is FDM Construction from Carteret. The bid price is $65,975.00. The engineer’s estimate was $90,025.00. All three bidders were below the engineer’s estimate. A pre-construction meeting will be scheduled at the earliest opportunity.
Mr. Keller stated the final payment requisition has been submitted for Tilcon NY for the milling and resurfacing of Valley Road and Delaware Avenue. Mr. Keller stated he held this payment back in order for the asphalt coring to be completed, which is a requirement of Local Aid. Tilcon received a penalty of 10% for the resurfacing, which did not meet the air void requirements. This means the asphalt was not compacted fully. Mr. Keller stated he is of the opinion this will not have an impact on the performance of the roadways or the lifecycle of the roadways. The payment recommendation was in the amount of $109,327.60, which is less than the engineer’s estimate of $124,147.40. Mr. Keller stated this project is under budget and there was a $181,200.00 Local Aid Grant.
Sunset Avenue / Ridge Road / Overhill Road Water Main Replacement – Mr. Keller stated he is continuing with the design services for the Sunset Avenue/Ridge Road/Overhill Road water main replacement project and he is working with the Borough’s DPW on the individual service connections. A meeting was held with the Administrator and the DPW Superintendent on September 9th to review the preliminary plans and to discuss the operational needs. The DPW is determining the service sizes and the water meter locations. Under the provisions, any galvanized services must be replaced due to the fact they may contain lead. The replacements will be included in the contract. How the costs will be covered has to be determined by the governing body. Typically, the replacements are done from the curb to the curb box, including the curb box. In this case the project will go all the way to the meter.
Stanhope School Crossing Study – Mr. Keller stated the counts and the gap study were conducted last week at five locations. The data is being processed and then the balance of the study will proceed.
Sparta Road Project Checklist – Mayor Zdichocki asked Mr. Keller when the lines will be repainted on Sparta Road. Mr. Keller stated he has attempted several times to contact the infrared pavement restoration contractor, who is part of the co-op. If the contractor does not contact Mr. Keller by tomorrow, he will be filing a complaint with the co-op stating the contractor is non-responsive.
Valley Road/Delaware Avenue Sidewalks – Councilwoman Kuncken asked what the timeframe is for completing the sidewalks for Valley Road and Delaware Avenue. Mr. Keller stated the project should not take any longer than two to three weeks. The sidewalk consists of 600-700 feet in length, which is not a lot. There is 335 square yards of sidewalk and 110 square yards of sidewalk across a driveway. There will be some driveway restoration and the installation of the curb ramps. Councilwoman Kuncken stated the contractor needs to be made aware that the Stanhope children walk to school and many of them walk in the project area.
Costanza Driveway – Councilman Vance stated at the September 13th Mayor and Council meeting a discussion was held with the Administrator regarding the Costanza’s driveway on Baker Avenue. The Administrator stated he was waiting for information from the Engineer. Mr. Keller stated he has provided an email and a sketch to the Administrator. Mr. Keller stated he spoke with the DPW Superintendent this morning and the job has been placed on the DPW’s schedule. Mr. Keller is of the opinion the Borough should not be involved in this. Mr. Keller stated he had a conversation with Mrs. Costanza who informed him that they are looking to redo their driveway. When the Constanza’s redo their driveway, they should have a berm installed across the frontage. The contractor can be instructed to adjust the height of the berm to accommodate their vehicles to prevent scraping. Currently, parts of the driveway are stone. The Borough is not installing an apron. A berm will be installed along the frontage. When you get to the retaining wall there will be a big divot. A berm has been installed in the past and the Costanza’s have had complaints in the past. They want an apron installed and that is not the Borough’s responsibility. Mayor Zdichocki asked if Mr. Keller has spoken with the Constanza’s. Mr. Keller stated no he has not. Generally he does not respond directly to residents. The information has been provided to the Administrator. Mayor Zdichocki stated the issue will be discussed with the Administrator at the next meeting. Councilman Thornton asked that updates be provided to the governing body, especially in this case, due to the fact the homeowner has contacted all of the governing body about this issue.
Denville Line Painting – Councilman Thornton asked if the Denville Line Painting has painted the stop lines and crosswalks for Valley Road and Delaware Avenue. Mr. Keller stated the painting will be done after the sidewalks are completed. Councilman Thornton asked if the lines at the beginning of Delaware Avenue, coming in off of Brooklyn Road, will be redone. Mr. Keller confirmed the lines will be redone. Councilwoman Kuncken stated those lines were originally added after a complaint was received from a resident regarding the speeding problem. The lines are used to try and slow traffic.
COUNCIL DISCUSSION
Board of Health Request (Increase Radon Test Fee) – Mayor Zdichocki stated a request has been received from the Board of Health requesting an increase be made for the sale cost of the radon test kits. The reason for the request is the purchase cost for the Borough has increased. Councilman Romano stated the request is before the Mayor and Council for approval due to the fact the cost is set by ordinance. The Borough purchases approximately five kits per year. Extras are not stored due to the expiration dates. The cost increase is from $10.00 to $15.00. The governing body had no objection to the price increase.
Stanhope BOE – November 22 Presentation on Special Election – Mayor Zdichocki stated the Stanhope Board of Education sent an email requesting to be placed on the agenda to give a presentation regarding an upcoming referendum. Mayor Zdichocki stated if any of the governing body members are approached with questions from residents, they should refer the residents to the school board. Councilwoman Kuncken stated she is in favor of having the school board make their presentation so the governing body can be informed. Mayor Zdichocki asked everyone to spread the word about the date of the presentation. The election will be taking place on December 13th. Councilman Romano stated he and the Administrator will not be attending the November 22nd meeting. Mayor Zdichocki stated the meeting will begin at 6:00pm.
One Lane Bridge – Councilman Thornton stated there is a trailer parked by the bike path near the one lane bridge and he asked if anyone knew why. Councilman Riccardi stated a resident did mention this to him as well. Mr. Keller stated a few years ago the EPA had a water issue in the Brookwood area in Byram Township and they wanted the Borough to provide water to the Brookwood area. The EPA may be doing investigations out in that area. The Borough chose not to supply water, due to the fact it is a dead end and the Borough has no ability to loop it back. Mayor Zdichocki will notify the Zoning Officer tomorrow and ask him to investigate.
OLD BUSINESS
ORDINANCE
Mayor Zdichocki offered the following ordinance for Public Hearing and Final Adoption which was read by title.

Ordinance 2022-09 AN ORDINANCE OF THE BOROUGH OF STANHOPE, SUSSEX COUNTY, NEW JERSEY AMENDING CHAPTER 133-33 “VEHICLES AND TRAFFIC”, ARTICLE XII, SCHEDULES”, SECTION 133-33 “SCHEDULE II: NO PARKING CERTAIN HOURS” OF THE CODE OF THE BOROUGH OF STANHOPE REGARDING LINDEN AVENUE
WHEREAS, the Borough Council determined that Chapter 133-33, “Schedule II: No Parking Certain Hours”, needs to be amended to reflect the removal of certain parking restrictions concerning Linden Avenue in the Borough of Stanhope.
NOW THEREFORE, BE IT ORDAINED, by the Mayor and Council of the Borough of Stanhope, Sussex County, New Jersey as follows:
SECTION 1
Section 133-33 “Schedule II: No Parking Certain Hours”, of Chapter 133, “Vehicles and Traffic” to delete the all no parking restrictions for Linden Avenue, as follows:

Hours: 7:00 a.m. to 4:00 p.m.; Monday through Friday while school is in session

SECTION 3 – SEVERABILITY
If any provision of this Ordinance or the application of this Ordinance to any person or circumstances is held invalid, the remainder of this Ordinance shall not be affected and shall remain in full force and effect.
SECTION 4 – REPEALER
All ordinances or parts of ordinances or resolutions that are inconsistent or in opposition to the provisions of this Ordinance are hereby repealed in their entirety.
SECTION 5: EFFECTIVE DATE
This Ordinance shall take effect immediately upon adoption and publication in accordance with law.

Mayor Zdichocki offered the following ordinance for Introduction and First Reading which was read by title.
Ordinance for Introduction and First Reading [Public Hearing on October 11, 2022]
Ordinance 2022-10 AN ORDINANCE OF THE BOROUGH OF STANHOPE, SUSSEX COUNTY, NEW JERSEY AMENDING CHAPTER 133, VEHICLES AND TRAFFIC TO REDUCE THE SPEED LIMIT ON STANHOPE-SPARTA ROAD
WHEREAS, the Mayor and Council of the Borough of Stanhope has, in the interest of public safety, investigated the existing speed limit for a portion of Stanhope-Sparta Road from Stanhope-Hopatcong Road (Brooklyn Road) to the Byram Township municipal boundary; and
WHEREAS, the Borough Engineer prepared and submitted a Speed Assessment Study for Stanhope-Sparta Road dated May 27, 2022, consisting of summarized findings; and
WHEREAS, the final recommendation of said Speed Assessment is that the speed limit of 35 mph for the portion of Stanhope-Sparta Road located in the Borough should be reduced to 30 mph; and
WHEREAS, having evaluated the Borough Engineer’s report, the Borough finds it in the interest of public safety to amend Chapter 133, Vehicles and Traffic, Article XII, Schedules by reducing the speed limit in both directions for the portion of Stanhope-Sparta Road located in the Borough from 35 mph to 30 mph, pursuant to the powers vested in the Borough of Stanhope by N.J.S.A 39:4-8.b(1), N.J.S.A 39:4-197(1) and N.J.S.A 39:4-98.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Stanhope, Sussex County, New Jersey, as follows:
SECTION 1.
Section 133-50, Schedule XIX: Speed Limits, shall be revised as to the speed limit on Stanhope-Sparta Road as follows:

SECTION 2. Larger speed limit signs shall be erected and maintained on Stanhope-Sparta Road to post the new designated speed limits.
SECTION 3. Every person convicted of a violation of any provision of this Ordinance or any supplement thereto shall be subject to a penalty or imprisonment as expressly provided by New Jersey Statute.
SECTION 4. If any provision of this Ordinance or the application of this Ordinance to any person or circumstances is held invalid, the remainder of this Ordinance shall not be affected and shall remain in full force and effect.
SECTION 5. All ordinances or parts of ordinances or resolutions that are inconsistent or in opposition to the provisions of this Ordinance are hereby repealed in their entirety.
SECTION 6. This Ordinance shall take effect immediately upon adoption and publication in accordance with law.
SECTION 7. Copies of this Ordinance shall be supplied to the Commissioner of New Jersey Department of Transportation, the Sussex County Division of Public Works Office of Roads and to the Township Clerks of the Township of Byram and Township of Hopatcong, Sussex County, New Jersey.

RESOLUTIONS

Resolution 160-22 RESOLUTION AWARDING BID TO FDM CONSTRUCTION LIMITED LIABILITY COMPANY FOR THE VALLEY ROAD & DELAWARE AVENUE SIDEWALK AND ADA RAMP IMPROVEMENTS PROJECT
WHEREAS, the Borough of Stanhope accepted sealed, competitive bids on Tuesday, September 20, 2022 for the Valley Road & Delaware Avenue Sidewalk and ADA Ramp Improvements Project (the “Project”); and
WHEREAS, the Borough Attorney has reviewed the bids for compliance with the Local Public Contracts Law and the Borough’s bidding requirements; and
WHEREAS, the lowest, responsive, responsible bidder for the Project was FDM Construction Limited Liability Company with a bid of $65,975.00; and
WHEREAS, the Borough Engineer concurs in the recommendation of the award of the contract to FDM Construction Limited Liability Company.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stanhope that the Borough does hereby award the contract to FDM Construction Limited Liability Company, in an amount not to exceed $65,975.00 for the Project, subject to concurrence by the NJDOT Bureau of Local Aid; and
BE IT FURTHER RESOLVED that the award of this bid is subject to issuance of a certification of available funds by the Borough’s Chief Financial Officer.

PAYMENT OF BILLS
Resolution 166-22 RESOLUTION OF THE MAYOR AND COUNCIL OF THE BOROUGH OF STANHOPE AUTHORIZING PAYMENT OF BILLS
WHEREAS, the Chief Finance Officer has certified that funds are available in the proper account; and
WHEREAS, the Chief Finance Officer has approved payment upon certification from the Borough Department Heads that the goods and/or services have been rendered to the Borough;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stanhope that the current bills list, dated September 27, 2022 and on file and available for public inspection in the Office of the Chief Finance Officer and approved by the Chief Finance Officer for payment, be paid.
On motion by Councilman Romano, seconded by Councilman Wronko and unanimously carried by the following roll call vote the foregoing resolution was duly adopted.

Angelo Bolcato, Borough Attorney, stated he had no report this evening.
CITIZENS TO BE HEARD
Mayor Zdichocki opened the meeting to the public after advising attendees that there is a five (5) minute time limit for each speaker.
Seeing no one from the public wishing to speak, Mayor Zdichocki closed the public portion of the meeting.
ADJOURNMENT
On motion by Councilman Romano, seconded by Councilman Wronko, and unanimously carried by voice vote the meeting was adjourned at 7:30 P.M.
